3028 To amend Zoning By-Law Number 1994, as amended. (Mill Pond Estates)THE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER« A By -Law to amend Zoning By -Law Number 1994, as amended. WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg deems it advisable to amend By -Law Number 1994, as amended. THEREFORE, the Municipal Council of the Corporation of the Town of Tillsonburg, enacts as follows: 1. That Schedule "A" to By -Law Number 1994, as amended, is hereby amended by changing to R3-22 the zone symbol of the lands so designated R3-22 on Schedule "A" attached hereto. 2. That Section 8.3 to By -Law Number 1994, as amended, is hereby amended by adding the following subsection at the end thereof. 8.3.22 LOCATION: JOHN POUND ROAD AND BIDWELL, PARTS 1, 3 AND 41 PLAN 41 R-64461 (R3-22) 8.3.22.1 Notwithstanding any provisions of By -Law Number 1994 to the contrary, no person shall within any R3-22 Zone use any lot, or erect, alter or use any building or structure for any purpose except the following: a detached single family dwelling house; and an apartment dwelling house, not exceeding 40 dwelling units. 8.3.22.2 Notwithstanding any provision of By -Law Number 1994 to the contrary, no person shall within any R3-22 Zone use any lot, or erect, alter or use any building or structure except in accordance with the following provisions: 8.3.22.2.1. DEFINITION OF A PRIVATE STREET: For the purposes of this By -Law, a private street means a primary means of access, by way of a private right-of-way or right of access contained either in an easement, lease or agreement, and is not under the jurisdiction of the Corporation, the County, or the Province. 8.3.22.2.2 NUMBER OF DWELLING HOUSES PER LOT: Notwithstanding any provisions of this By -Law to the contrary, the maximum number of dwelling houses that may be constructed on the lands to which The Corporation of the Town of Tillsonbu ~ By -Law Number U- Page 2 the R3-22 zone applies shall be 26 single family dwelling houses and one apartment dwelling house, containing not more than 40 dwelling units. 8.3.22.2.3. SETBACK OF ALL BUILDINGS FROM A STREET LINE: The minimum setback for all dwellings and accessory buildings or structures, including patios and decks, from a street line shall be 4.5 m (14.7 ft). 8.3.22.2.4. FRONT YARD SETBACK FOR A SINGLE FAMILY DWELLING HOUSE FROM A PRIVATE STREET: Minimum Depth: 6 m (19.7 ft) from the front wall of an attached garage to the curb of the private street. 8.3.22.2.5. DISTANCE BETWEEN SINGLE FAMILY DWELLING HOUSES: Minimum distance: 2.4 m (7.9 ft) 8.3.22.2.6. DISTANCE BETWEEN A SINGLE FAMILY DWELLING HOUSE AND A LOT LINE: Minimum distance between a single family dwelling house and a lot line, other than a street line: 1.2 m (3.9 ft) 8.3.22.2.7. DISTANCE BETWEEN AN APARTMENT DWELLING HOUSE AND A LOT LINE Minimum distance between an apartment dwelling house and a lot line or street line: 4.5 m (14.7 ft) 8.3.22.2.8. NUMBER OF PARKING SPACES REQUIRED FOR A 40 UNIT APARTMENT DWELLING HOUSE Minimum Number of Parking Spaces: 66 8.3.22.2.9. That all other provisions of By -Law Number 1994, as amended, that are consistent with the provisions herein contained shall continue to apply mutatis mutandis.
