3083 To authorize the continuation of the tax benefit to elected officials remuneration.CORPORATION OF THE TOWN OF TILLSONBURG By-law Number 3083 Being a by-law to authorize the continuation of the tax benefit to elected officials remuneration. WHEREAS subsection 255(1) of the Municipal Act, R. S.O. 1990, c. M.45, as amended, provides that one-third of the remuneration paid to elected members of councils and their local boards shall be considered as expenses incident to the discharge of their duties as members of council or local board; AND WHEREAS subsection 255(2) of the Municipal Act, R.S.O. 1990, c. M.45, as amended provides that the provisions of subsection 255(1) shall only continue to apply to members of council or its local boards after January 1, 2003 if the municipality passes a resolution or by-law before January 1, 2003 stating its intention that the provisions of subsection 255(1) shall continue to apply to elected members of council and its local boards; AND WHEREAS the Council of the Town of Tillsonburg passed a resolution on September 9, 2002 to continue the provisions of subsection 255(1) of the Municipal Act beyond January 1, 2003. AND WHEREAS 283(5) of the Municipal Act, 2001 S.O. 2001, CHAPTER 25 states that if a resolution of a municipality under subsection 255 (2) or (3) of the old Act is not revoked before January 1, 2003, the resolution shall be deemed to be a by-law. AND WHEREAS On or after December 1, 2003, a council shall review a by-law under subsection 283(5) of the Municipal Act, 2001 S.O. 2001, CHAPTER 25 at a public meeting at least once during the three-year period corresponding to the term of office of its members after a regular election. AND WHEREAS the Council of the Town of Tillsonburg deems it desirable to continue the provisions of subsection 255(1) of the Municipal Act during the term of Council from 2003-2006. NOW THEREFORE THE COUNCIL OF THE TOWN OF TILLSONBURG ENACTS AS FOLLOWS: 1. THAT the provisions of subsection 255(1) continue to apply to the elected members of this Council for the term 2003 to 2006. 2. THAT this by-law shall come into force and take effect upon enactment.
