PA THE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER -�-, t;t, A By -Law to amend Zoning By -Law Number 1994, as amended. WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg deems it advisable to amend By -Law Number 1994, as amended. THEREFORE, the Municipal Council of the Corporation of the Town of Tillsonburg, enacts as follows: That Schedule "A" to By -Law Number 1994, as amended, is hereby amended by changing to R1 -24(H), R2 -11(H), R2 -12(H), R3 -24(H), R3 -25(H) and O on Schedule "A" attached hereto. That Section 6.3 to By -Law Number 1994, as amended, is hereby amended by adding the following subsections at the end thereof: "6.3.27 6.3.27.1 6.3.27.2 6.3.27.2.1 6.3.27.2.2 LOCATION: LANDS EAST OF QUARTER TOWN LINE, NORTH OF BALDWIN STREET AND SOUTH OF CONCESSION STREET, R1 -24(H) Notwithstanding any provision of By -Law Number 1994 to the contrary, no person shall within any R1 -24(H) Zone use any lot, or erect, alter or use any building or structure for any purpose except the following: all uses permitted in Section 6.1, provided the Holding (H) symbol is removed in accordance with Section 6.3.27.3 of this By -Law Notwithstanding any provision of By -Law Number 1994 to the contrary, no person shall within any R1-24 Zone shall use any lot, or erect, alter or use any building or structure except in accordance with the following provisions: LOT FRONTAGE: Minimum Lot Frontage: 12.5 m (41 ft.) or 16 m (52.5 ft.) in the case of a corner lot LOT AREA: Minimum Lot Area: 395 mZ (4,251 ftZ) or 495 m2 (5,328.3 ftZ) in the case of a corner lot The Corporation of the Town of Tillsonburg By -Law Number Page 2 6.3.27.2.3 LOT DEPTH: Minimum Lot Depth 30 m (98.4 ft.) 6.3.27.2.4 FRONT YARD: Minimum Depth: 6 m (19.7 ft.) except where the front or exterior 'yard abuts an arterial road, in which case the minimum front or exterior side yard abutting such road shall be 7.5 m (24.6 ft). 6.3.27.2.5 REAR YARD: Minimum Depth: 10.5 m (34.4 ft.) 6.3.27.2.6 INTERIOR SIDE YARD: Minimum Width: 3 m (9.8 ft.) on one side and 1.2 m (3.9 ft.) on the narrow side, provided that where a garage or carport is attached to or is within the main building, or the lot is a corner lot, the minimum width shall be 1.2 m (3.9 ft.). 6.3.27.2.7 EXTERIOR SIDE YARD: Minimum Depth 6.0 m (19.7 ft.) 6.3.27.2.8 LOT COVERAGE: Maximum Coverage: 35% 6.3.27.2.9 LANDSCAPED OPEN SPACE: Minimum: 30% 6.3.27.2.10 GROSS FLOOR AREA: Minimum: 93m2 (1CIO 1.1 ft2) 6.3.27.2.11 HEIGHT OF DWELLING: Maximum Height: 10.5 m (;34.4 ft.) 6.3.27.2.12 EXTERIOR SIDE YARD EXCEPTION Notwithstanding section 6.3.27.2.7, where two abutting corner lots share the same rear lot line and their exterior side yards abut a local road, then the minimum exterior side yard setback for such lots may be reduced to 4.5 m (14.8 ft). This exterior side yard reduction may also be applied where the rear lot line of a corner lot abuts a street and the exterior side yard abuts a The Corporation of the Town of Tillsonburg By -Law Number Page 3 local road. 6.3.27.3 REMOVAL OF THE HOLDING PROVISION: Development for any use in Section 6.3.27.1 of this By -Law shall only be permitted at such time as written confirmation of water allocation has been obtained from the County of Oxford and the holding provision has been removed in accordance with the requirements of the Planning Act, RSO 1990, as amended. 6.3.27.4 That all other provisions of the R1 Zone in Section 6.2 to By -Law Number 1994, as amended, shall apply, and further that all other provisions of By - Law Number 1994, as amended, that: are consistent with the provisions herein contained shall continue- to apply "mutatis mutandis". 3. That Section 8.3 to By -Law Number 1994, as amended, is hereby amended by adding the following subsections at the end thereof: "8.3.25 LOCATION: LANDS EAST OF QUARTER TOWN LINE, NORTH OF BALDWIN STREET AND SOUTH OF CONCESSION STREET, R3 -24(H) 8.3.25.1 Notwithstanding any provision of By -Law Number 1994 to the contrary, no person shall within any R3 -24(H) Zone use any lot, or erect, alter or use any building or structure for any purpose except the following: a street fronting townhouse and a home occupation, provided the Holding (H) symbol is removed in accordance with Section 8.3.25.3 of this By -Law. 8.3.25.1.1 For purposes of this subsection, a "Stireet Fronting Townhouse", means a dwelling consisting of three or more dwelling units that are aligned horizontally and divided vertically in whole or in part by common walls, with a minimum area above the grade of 10 rn2 (107.6 ft2), and each of which has an independent entrance directly from the outside and fronts onto a public street. 8.3.25.2 Notwithstanding any provision of By -Law Number 1994 to the contrary, no person shall within any R3-24 Zone shall use any lot, or erect, alter or use any building or structure except in accordance with the following provisions: 8.3.25.2.1 LOT FRONTAGE: Minimum: 8.0 m (26.2 ft.) Except in the case of an end unit, where the minimum frontage shall be 9.0 m (29.5 ft.) for an interior lot and 14 m (45.9 ft.) for a corner lot. 8.3.25.2.2 LOT DEPTH: Minimum: 30 m (98.4 ft.)
