3269 To adopt a Town of Tillsonburg Rules and Regulations For Columbaria In The Tillsonburg Cemetery.THE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW 3269 A by-law to adopt a Town of Tillsonburg Rules and Regulations For Columbaria In The Tillsonburg Cemetery. WHEREAS R.S.O. 1990, Chapter 4, s 50 (2), of the Cemeteries Act (Revised) authorizes the Council of the Corporation of the Town of Tillsonburg to establish by- laws affecting the operation of the cemetery. AND WHEREAS it is deemed necessary and expedient by the Council of the Corporation of the Town of Tillsonburg adopt rules and regulations for the Columbaria in the Tillsonburg Cemetery THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of Tillsonburg enacts as follows: THAT the Agreement attached hereto as Schedule "A" forms this By-law THAT the Mayor and Clerk be hereby authorized to execute the attached agreement marked as Schedule "A" on behalf of the Corporation of the Town of Tillsonburg. Mayor Clerk Schedule A RULES AND REGULATIONS FOR COLUMBARIA 1. General Rules All By-laws of the Tillsonburg Cemetery shall apply to the Columbaria, as far as the nature of the situation permits. 2. Placement of Floral Tributes Except at the time of inurnment and on Decoration Day, no floral tributes will be permitted. However, floral tributes will be allowed in bud vases approved by the Tillsonburg Cemetery and that are attached to the Columbarium niche. Flowers and wreaths placed against or near any part of the Columbarium that are liable to stain or deface the structure, will be removed. Glass vases or other breakable items, such as statuary, shall not be placed round the Columbarium. No ornaments of any kind will be permitted on or near the Columbaria niche units nor on the vases attached to the niche units. 3. Trees and Planting All landscaping will be completed by the Tillsonburg Cemetery. 4. Urns and Receptacles 'The number of cremated human remains to be placed in each niche is determined by the urn size and niche dimensions and in accordance with the designated policy for each Columbarium. 5. Inurnments A Burial Permit issued by the Divisional Registrar, showing the death has been properly registered, or a Certificate of Cremation issued by the Crematorium shall accompany all cremated remains that are to be placed in the niche. No transfer of burial rights to a Columbarium shall be valid until approved by and recorded in the books of the Tillsonburg Cemetery. No inurnment shall be made without the permission from the burial rights holder or a proper representative of the estate if the burial rights holder is deceased. 6. Opening and Closing of Niche 'The Superintendent or his designate shall be in attendance at all inurnments, and only they shall be responsible for the opening and closing of the niche. 7. Inurnment Fee Persons ordering an inurnment shall be held responsible for all charges incurred. The inurnment fee shall be at a rate as specified in the Tariff of Rates and shall include the opening and closing of the niche. 8. 'Time of Inurnment An inurnment shall not take place later than 4:00 p.m., Monday to Friday and not later than 4:00 p.m. on Saturday, for which a surcharge will be in effect. 9. Disinurnments No disinurnments will take place without the written authorization of the niche owner or his or her legal representative. 10. Plaques To maintain uniformity of the Columbaria, only the plaque included in the purchase of the niche will be permitted. 11. Pictures Pictures will not be allowed on any plaque. This includes sandblasted and/or etched photographic images and reproductions on the face of the niche. 12. Lower Animals The cremated remains of the lower animals will not be allowed to be placed in any niche. 13. Repairs The Tillsonburg Cemetery shall keep the columbaria in good repair at all times but shall not be required to rebuild the columbaria in the case of destruction due to war or insurrection. 6/16/06
