BY -LAW NUMBER 3899
A BY-LAW, TO APPOINT AMUNICIPALLAWENFORCEMENTOFFICERAND
PROPERTY STANDARDS OFFICER FOR THE TOWN OF TILLSONBURG.
WHEREAS pursuant to The Municipal Act, 2001, S.O. 2001, c.25, as amended, the Council of a
Municipality has the capacity, rights, powers and privileges of a natural person for the purpose of
exercising its authority under this or any other Act, to enable them to govern their affairs as they
consider appropriate and to enhance their ability to respond to municipal issues;
AND WHEREAS pursuant the Municipal Act, 2001, S.O. 2001, c. 25, as amended, requires that a
municipality's capacity, rights, powers and privileges, shall be exercised by by-law;
AND WHEREAS pursuant to the provisions of the Police Services Act, R. S. 0. 1990, cP.15, as
amended, the Council of any municipality may appoint one or more Municipal Law Enforcement
Officers who shall be Peace Officers for the purpose of enforcing the By-Laws of the Municipality;
AND WHEREAS pursuant to The Building Code Act, S.O. 1992, c. 23, as amended, defmes
"officer" as a property standards officer who has been assigned the responsibility of administering
and enforcing by-laws passed under Section 15.1 of The Building Code Act;
AND WHEREAS the Council of the Corporation of the Town ofTillsonburg considers it desirable
to appoint a By-Law Enforcement Officer and Property Standards Officer;
NOW THEREFORE BE IT RESOLVED THAT the Council of The Corporation of the Town of
Tillsonburg enacts as follows:
1. THAT Dan Smukavich be and is hereby appointed By-Law Enforcement Officer and
Property Standards Officer for the Town of Tillsonburg.
2. THAT this appointment shall be effective April 27, 2015.
3. THAT By-Law 3737 to appoint a By-Law Enforcement Officer of the Corporation of the
Town ofTillsonburg is hereby repealed.
4. THAT this by-law comes into full force and effect upon the day of passing.
