BY-LAW NO, 2989
BEING A BY-LAW TO AUTHORIZE THE ENTERING INTO A SUBDIVISION
AGREEMENT BETWEEN TILLSONBURG DEVELOPMENTS INC.
TOWN OF TILLSONBURG AND COUNTY OF OXFORD
WHEREAS, the Owner (Tillsonburg Development Inc.), proposed to subdivide and register a
Plan of Subdivision of Part Lot 8,, Concession 12 (Dereham), Plan 41R-5075for the Town of
Tillsonburg as shown on a proposed Plan of Subdivision appended as Schedule "A" to
Appendix "1" of this By-law;
AND WHEREAS the revised draft plan of the land to be subdivided was approved by the
County of Oxford on the 12'hday of September 2001. , under file 32T-01002;
AND WHEREAS prior to the signing of the plan for registration by the County of Oxford,
certain conditions,, as set out 'in the draft plan conditions of approval dated the 12th day of
September, 2001 must be fulfilled to the satisfaction of Town;
AND WHEREAS the entering into of an Agreement has been made as a condition of approval
by the County of Oxford and contains all the requirements, financial and otherwise of the Town
regarding the construction of roads installation of services and drainage facilities, and any other
matters pertaining to the development of the subdivision;
AND WHEREAS the County of Oxford has required as a condition precedent to its approval of
the said Plan of Subdivision that the Subdivider enter into an Agreement.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
TILLSONBURG ENACTS AS FOLLOWS:
1. THAT the Agreement attached hereto and marked Appendix "I" to this by-law be and
is hereby approved and the Mayor and Clerk are hereby authorized to execute the same
on behalf of the Corporation of the Town of Tillsonburg and to affix the Corporate Seal
thereonto.
2, 1' T the said Appendix rr. F,) annexed hereto is declared to be part of this By-law in the
same manner as if written and incorporated herein.
3. THAT this by-law is enacted pursuant to Section 51(26) of the Planning Act, R. S. O.
1990 and shall come into force and take effect on the date of its final passing.
