3094 To amend Zoning By-Law Number 1994, as amended, (Canadian Tire)THE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER 3094 A By -Law to amend Zoning By -Law Number 1994, as amended. WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg deems it advisable to amend By -Law Number 1994, as amended. THEREFORE, the Municipal Council of the Corporation of the Town of Tillsonburg, enacts as follows: 1. That Schedule "A" to By -Law Number 1994, as amended, is hereby amended by changing to C1-8 the zone symbol of the lands so designated C1-8 on Schedule "A" attached hereto. 2. That Section 11.3 to By -Law Number 1994, as amended, is hereby amended by adding the following subsection at the end thereof: "11.3.8 LOCATION: NORTH SIDE OF BRIDGE STREET, BETWEEN BROADWAY AND TILLSON AVE (Part of Lots 989, 990, 994, 1013, 1026, 1045, 1046, 1050-1052, Part of Hale Street,, Market Street & Raynes Street, all of lots 991, 1047-1049 & 1053, Plan 5100),C1-8 11.3.8.1 Notwithstanding any provisions of By -Law Number 1994 to the contrary, no person shall within any C1-8 Zone use any lot, or erect, alter or use any building or structure for any purpose except the following: all uses permitted in Section 11.1.2 to this By -Law; and a home and auto supply store and outdoor garden centre. 11.3.8.2 Notwithstanding any provision of By -Law Number 1994 to the contrary, no person shall within any C1-8 Zone use any lot, or erect, alter or use any building or structure except in accordance with the following provisions: 11.3.8.2.1 SETBACK ADJACENT TO RESIDENTIAL ZONES: The required yard for that portion of the subject property abutting a Residential Zone on the west side of the ravine shall be a minimum of 1.5 m (4.9 ft). 11.3.8.2.2 OUTDOOR GARDEN CENTRE Any portion of the lot used for an outdoor garden centre shall also comply with the following provisions: The Corporation of the Town of Tillsonburg By -Law Number 3094 Page 2 3. 11.3.8.2.2.1 Such outdoor garden centre shall be fully enclosed by a fence with a minimum height of 2.4 m (8 ft), and screened from street allowances and abutting properties by fencing, shrub planting or similar screening. 11.3.8.2.2.2 No portion of the outdoor garden centre shall be located closer than 5 m (16.4 ft) to the Broadway street line, or 3 m (9.8 ft) to the Bridge Street, street line. 11.3.8.2.3 NUMBER OF PARKING SPACES REQUIRED: Minimum: 290 parking spaces, or 1 space per 25 m2 (269.1 ft2), of gross floor area, whichever is the greater. All required spaces shall be located within the C 1-8 zone. 11.3.8.2.4 TWO ZONE FLOOD PLAIN AREA: Any construction or site alteration within the Two Zone Flood Plain Area, as defined by the Long Point Region Conservation Authority, shall require the prior approval of the Long Point Region Conservation Authority. 11.3.8.3 That all other provisions of the C1 Zone in Section 11.2 to By -Law Number 1994, as amended, shall apply, and further that all other provisions of By - Law Number 1994, as amended, that are consistent with the provisions herein contained shall continue to apply "mutatis mutandis". That Section 5.17.1, Parking Area Re ui-ements, to By -Law Number 1994, as amended, is hereby amended by deleting the following: "Shopping Centre, Public Market, Commercial Sports and Recreation Establishment and replacing it with the following: "Public Market, Commercial Sports and Recreation Establishment Shopping Centre Parking Area to be 3 times the Gross Floor Area. 39 Parking Area to be 3 times the Gross Floor Area 1 parking space per 30 m2 (323 ftz) of gross floor area" 4. This By -Law comes into force in accordance with Sections 34(21) and (30) of the Planning Act, R.S.O. 1990, as amended.
