A By -Law to amend Zoning By -Law Number 1994, as amended.
WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg
deems it advisable to amend By -Law Number 1994, as amended.
THEREFORE, the Municipal Council of the Corporation of the Town of
Tillsonburg, enacts as follows:
1. That Schedule "A" to By -Law Number 1994, as amended, is hereby amended by
changing to O, R1, R1-14 and R1-16 the zone symbols of the lands so designated
O, R1, R1-14 and R1-16 on Schedule "A" attached hereto.
2. That Section 6.3 to By -Law Number 1994, as amended, is hereby amended by
deleting subsection 6.3.17 and replacing it with the following subsection:
"6.3.17 LOCATION: SOUTHWEST CORNER OF NORTH SIDE OF LYNDALE
ROAD AND BROOKSIDE LANE: (Part of Lots 52, 53 & 54 and Block 131,
Plan 41 M-147), R1-14
6.3.17.1 Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any R1-14 Zone use any lot, or erect, alter or use any
building or structure except in accordance with the following provisions:
6.3.17.1.1 EXTERIOR SIDE YARD:
Minimum Width:
3.5 m (11.5 ft)
6.3.17.2 That all other provisions of the R1 Zone in Section 6.2 to By -Law Number
1994, as amended, shall apply, and further that all other provisions of By -
Law Number 1994, as amended, that are consistent with the provisions
herein contained shall continue to apply "mutatis mutandis".
3. That Section 6.3 to By -Law Number 1994, as amended, is hereby amended by
deleting subsection 6.3.18 and 6.13.19 and replacing them with the following
subsection:

ABUTTING THE CREEK (Part of Lots 125 and Lot 124, Plan 41 M-147), R1_

6.3.19.1 Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any R1-16 Zone use any lot, or erect, alter or use any
building or structure except in accordance with the following provisions:
6.3.19.1.1 No construction or buildings shall be located within 4.6 m (15 ft) of Block
130, Plan 41 M-147.
6.3.19.2 That all other provisions of the R:1 Zone in Section 6.2 to By -Law Number
1994, as amended, shall apply, and further that all other provisions of By -
Law Number 1994, as amended, that are consistent with the provisions
herein contained shall continue to apply "mutatis mutandis".
4. This By -Law comes into force in accordance with Sections 34(21) and (30) of the
Planning Act, R.S.O. 1990, as amended.

EXPLANATORY NOTE
The purpose of By -Law Number :,st rezone lands located at Part of Lots 11, 191
56 84 and 98, lots 20-55 inclusive, lots 78 to 83 inclusive, lots 99 to 123 inclusive and lot
125, part of blocks 127 and 131, part of Allen Street, Part of Belmont Avenue and Part of
LY ndale Road, Registered Plan 41M-147, in the Town of Tillsonburg, from Special
`Residential First Density (R1-14)', `Residential First Density (Rl)'and Special Residential
First Density (R1-15)' to `Open Space (0)', `Residential First Density (R1)', amended
Special `Residential First Density (R1-14)' and amended Special `Residential First Density
(R1-16). The amendment would allow for the reconfiguration of the northerly portion of an
existing registered plan of subdivision 41M-147. The subject property is owned by
Broadway Estates Inc.
The Municipal Council, after conducting the public hearing necessary to consider any
comments to the proposed change in zone designation, approved By -Law
Number I. * The public hearing was held on January 12th, 2004.
