3128 To adopt a Health and Safety PolicyCORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NO. 3128 BEING A BY-LAW TO ADOPT A HEALTH AND SAFETY POLICY WHEREAS the Council of the Town of Tillsonburg recognizes the need for a clear and concise set of policies conceming health and safety management; AND WHEREAS the Council of the Corporation of the Town of Tillsonburg deems it advisable that the Health and Safety Policy be confi reed and adopted by by-law; THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF TILLSONBURG ENACTS AS FOLLOWS: I. THAT the Health and Safety Policy attached hereto as Schedule "A" is hereby adopted as the policy to be used in the management of Health and Safety; 2. THAT said Policy is attached hereto as Schedule "A" and forms a part of this by-law; 3. THAT by-laws and amendments thereto enacted by the Town of Tillsonburg pertaining to health and safety policies are hereby repealed; 4. AND THAT this by-law shall come into force and effect upon final passing. READ A FIRST and SECOND TIME ON THIS THE 8 r" DAY OF NOVEMBER, 2004; AND READ A THIRD TIME, PASSED, SIGNED, SEALED AND NUMBERED 3128 ON THIS THE 22nd DAY OF NOVEMBER, 2004. yor -- Stephen Molnar L f10 '0� � Clerk — Michac Graves TOWN OF TILLSONB UR G Health Sarfiety Policy Application: This Health and Safety policy of the Corporation of the Town of Tillsonburg applies to all operations owned and operated by the Corporation and must be reviewed annually as required by the Occupational Health and Safety Act. Obiective of Policy: It is the Policy of the Corporation of the Town of Tillsonburg to conduct all operations, services and programs in a safe and healthy manner in order to prevent injury or illness to employees. It is the Town's responsibility in its capacity as the employer for carrying out the responsibilities and duties outlined in the Occupational Health and Safety Act, and its Regulations, through the delegation of these functions to individuals in the corporation. The Occupational Health and Safety Act is based on a system of internal responsibility. This means that each level of our employees must be familiar with and in compliance with the Occupational Health and Safety Act and its applicable Regulations. All individuals in the workforce, at all levels and functions, are responsible for understanding and carrying out their Health and Safety responsibilities and duties. Principles: • Every employee has the right to work in a healthy and safe work environment. • Employees are encouraged to be actively involved in maintaining a healthy and safe environment in the workplace. • Co-operation between Council and the employees is desirable in developing and maintaining healthy and safe workplaces. • The prevention of accidents, injury and occupational illness should be an integral part of every job activity. • An effective internal responsibility system recognizing the roles of every workplace participant, from the employee to Council, is the key to an effective health and safety program. In furtherance of these goals, management and workers are acknowledged to have the following specific responsibilities: TOWN OF T1LS0NBURG -2— Health 2— Health & Safety Policy Responsibilities of the Corporation: (a) Provide a healthy and safe workplace. (h) Provide inionnation, instruction and supervision to employees to protect their health and safety. (c) Acquaint workers with hazards in the workplace. (d) Appoint competent supervisors. (e) Ensure that equipment, materials and protective devices as prescribed are provided, used and maintained in good condition. (� Ensure that the requirements under the Occupational Health and Safety Act and its regulations are carried out. (g) Establish and maintain a Joint Health and Safety Committee as required by the Occupational Health and Safety Act (h) Only employ in or about the workplace a person over such age as may be prescribed. (i) Take every precaution reasonable in the circumstances for worker protection. (j) Post in the workplace, a copy of the Occupational Health and Safety Act and this Policy. (k) Where management contracts out any of its functions, to ensure that the contractor acknowledges, accepts and complies with each of the above responsibilities. Responsibilities of Management (CAO, Department Heads): (a) Ensure the working environment is maintained in a healthy and safe condition. (b) Establish and maintain a written health and safety program, with objectives and standards consistent with applicable legislation as a minimum. (c) Provide ongoing safety education, including but not restricted to WHMIS and First Aid. (d) Ensure safety meetings and crew visits are conducted and attend these meetings as appropriate. (e) Evaluate the health and safety performance of subordinates and divisions. (0 Ensure the performance of workplace inspections. (g) Provide first aid facilities as required. (h) Ensure that personal protective equipment (PPE), where required, is provided, used and properly maintained. (i) Investigate and report accidents/cases of occupational disease to appropriate authority. (j) Ensure workers comply with this Policy, with the Health and Safety Programme, and with the Occupational Health and Safety Act. (k) Enforce health and safety rules. (1) Participate in the investigation of all work refusals due to unsafe working conditions. 1) TOW'S' OF TILLSO BURG -3— Health 3— Health & Safety Policy Responsibilities of Supervisors (First Line Supervisor, Department Heads): (a) Taking care of the occupational health and safety of the employees within their respective area. (b) Be familiar with the applicable requirements of the Occupational Health and Safety Act and the Regulations, and ensure compliance. (c) Understand and enforce the Town's Health & Safety Policy and Terns of Reference, Responsibilities and Procedures. (d) Perform workplace inspections. (e) Ensure that employees wear the appropriate personal protective equipment (PPE). Wear appropriate PPE where required. (f) Advise each worker of the existence of any potential or actual danger to the health and safety of the worker, of which the supervisor is aware. Conduct safety meetings and crew visits. (g) Investigate and determine the causes of all incidents, accidents and injuries and initiate or recommend corrective action. (h) Notify the Finance department of any compensable accidents/incidents and update on changes to an employee's return to work status. (i) Take every precaution reasonable in the circumstance for the protection of a worker. (j) Assess physical capabilities for new or transferring employees. Ensure all workers receive proper training and instructions prior to commencement of work. (k) Identify and inform superiors of occupational health and safety concerns. Responsibilities of the Joint Occupational Health and Safety Committee: The department head and workplace supervisor are responsible for ensuring that a Health and Safety Committee is established and maintained. At least one-half of the members are required to be non-inanagement employees selected by the workers and/or union. The Health and Safety Committee is responsible for, among other things, identifying the source of danger or hazard to workers, making recommendations to the Town for improvement to health and safety, recommending the establishment, maintenance and monitoring of programs, measures and procedures for health and safety, and participating in work refusals. The Town is required to respond to written recommendations from Health and Safety Committee within 21 days. Responsibilities of Workers and Contract Workers: (a) To review and comply with all legal duties on workers under the Occupational Health and Safety Act and to co-operate with manager/supervisors and management in the compliance and implementation of this policy. (b) Learning, understanding and practicing standard operating procedures. health and safety hazards and unsafe situations. (c) "Taking every possible precaution to protect themselves and fellow workers from health and safety hazards and unsafe situations. TOWN0 0 1*1 LLSO N B U RG - 4 — licalth & Safety Policy (d) Reporting unsafe acts or conditions to their supervisor or health and safety committee or health and safety representative. (e) Reporting any occupational injury or illness immediately to their supervisor and to keep hire/her advised of their return to work status. (f) Using personal protective equipment, where required. (g) Refrain from ever making any protective equipment, device or clothing ineffective. (h) Report any contraventions of the Occupational Health and Safety Act or regulations to their supervisor or employer. Responsibilities of Contractors and Sub -Contractors (a) Demonstrate the establishment and maintenance of a health and safety program, with objectives and standards consistent with applicable legislation and this corporation's health and safety policy and requirements. (b) Include health and safety provisions in their management system to reach and maintain a consistently high level of health and safety. (c) Ensure the workers in their employ are aware of the hazardous substances that may be in use at the workplace and wear the appropriate personal protective equipment required for the area. (d) Provide WSIB clearance certificate or equivalent insurance. (e) Comply with the health and safety policies and procedures of the Town. (f) Comply with all requirements under the Occupational Health and Safety Act and its regulations. This section will be included in all contracts tendered and proof of the above may be required by the Town at any time from tendering to project completion. Responsibilities of visitors and General Public Where appropriate, signs will be posted at entrances to inform visitors and the general public about restricted access or the requirement to report to a receptionist before proceeding further. Visitors and general public will not be allowed to wander unescorted, through areas that are normally restricted to employees. In the event that a visitor is required to enter a work area that is normally restricted to employees: (a) The supervisor will be responsible for ensuring that the visitor is aware of the relevant workplace safety rules and is under the supervision of a regular employee. (b) The visitor will use any and all required personal protective equipment. The Town values each and every employee and worker, and places their health and safety on the job as a current and ongoing priority in corporate decision-making and in day-to-day operations. 11 TOWN OF TILLSONBURG 11'ealth & Safety Policy We ask and require that you do your part and work together with your fellow employees/workers and with management in complying xvith the objectives of this health and safety policy and the provisions of the Occupational Health and Safety Act.
