BY-LAW NUMBER 3174
A By -Law to amend Zoning By -Law Number 1994, as amended.
WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg
deems it advisable to amend By -Law Number 1994, as amended.
THEREFORE, the Municipal Council of the Corporation of the Town of
Tillsonburg, enacts as follows:
1. That Schedule "A" to By -Law Number 1994, as amended, is hereby amended by
changing to C2-26 the zone symbol of the lands so designated C2-26 on Schedule
g g
"A" attached hereto.
2. That Section 12.3 to By -Law Number 1994, as amended, is hereby amended by
adding -the following subsection at the end thereof:
12.3.26 LOCATION: WEST SIDE OF TILLSON AVENUE, BETWEEN
CONCESSION STREET AND FIRST STREET, (Lot 393 & 394, Plan 500) -
C2-26
12.3.26.1 Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any C2-26 Zone use any lot, or erect, alter or use any
building or structure for any purpose except the following:
all uses permitted in Section 12.1.2 to this By -Law; and
a motor vehicle repair garage and accessory vehicle storage.
12.3.26.2. Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any C2-26 Zone shall use any lot, or erect, alter or use
any building or structure except in accordance with the following provisions:
12.3.26.2.1 SOUTHERLY INTERIOR SIDE YARD
Minimum width 3 m
12.3.26.2.2 ACCESSORY MOTOR VEHICLE STORAGE AREA
A motor vehicle storage area, accessory to a motor vehicle repair garage,
shall only be located in the rear yard and shall be completed enclosed by a
fence.

15.3.5.2.3 That all other provisions of the C2 Zone in Section 12.2 to By -Law Number
1994, as amended, shall apply, and further that all other provisions of By
Law Number 1994, as amended, that are consistent with the provisions
herein contained shall continue to apply "mutatis mutandis".
3. This By -Law comes into force in accordance with Sections 34(21) and (30) of the
Planning Act, R.S.O. 1990, as amended.

EXPLANATORY NOTE
The purpose of By -Law Number 3174 is to rezone lands located at lots 393 & 394
plan 500, in the Town of Tillsonburg, from `General Industrial (M2)'to Special `Highway
Commercial (C2-26)'. The amendment would allow for the establishment of a motor
vehicle repair garage and accessory vehicle storage on the property and allow for a
reduction in the interior side yard to 3 m (9.8 ft). The subject properties are owned by
Michael Dean.
The Municipal Council, after conducting the public hearing necessary to consider any
comments to the proposed change in zone desi nation, approved By -Law
Number 3174 . The public hearing was held on July 11 t , 2005.
