BY-LAW NUMBER
A By -Law to amend Zoning By -Law Number 1994, as amended.
WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg
deems it advisable to amend By -Law Number 1994, as amended.
THEREFORE, the Municipal Council of the Corporation of the Town of
Tillsonburg, enacts as follows:
1. That Schedule "A" to By -Law Number 1994, as amended, is hereby amended by
changing to R1(H), O and R3 -23(H) the zone symbols of the lands so designated
R1 (H), O and R3 -23(H) on Schedule "A" attached hereto.
2. That Section 6.3 to By -Law Number 1994, as amended, is hereby amended by
adding the following subsections at the end thereof:
"6.3.25 LOCATION: SOUTHEAST CORNER OF BALDWIN STREET AND
QUARTERTOWN LINE, R1(H)
6.3.25.1 Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any R1 (H) Zone use any lot, or erect, alter or use any
building or structure for any purpose except the following:
all uses permitted in Section 6.1, provided the Holding (H) symbol is
removed in accordance with Section 6.3.25.2.1 of this By -Law
6.3.25.2. Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any R1 Zone shall use any lot, or erect, alter or use any
building or structure except in accordance with the following provisions:
6.3.25.2.1. REMOVAL OF THE HOLDING PROVISION:
Development for any use in Section 6.1 of this By -Law shall only be
permitted at such time as written confirmation of water allocation has been
obtained from the County of Oxford and the holding provision has been
removed in accordance with the requirements of the Planning Act, RSO
1990, as amended.

6.3.25.2.2. That all other provisions of the R1 Zone in Section 6.2 to By -Law Number
1994, as amended, shall apply, and further that all other provisions of By -
Law Number 1994, as amended, that are consistent with the provisions
herein contained shall continue to apply "mutatis mutandis".
4. That Section 8.3 to By -Law Number 1994, as amended, is hereby amended by
adding the following subsections at the end thereof:
"8.3.23 LOCATION: SOUTHEAST CORNER OF BALDWIN STREET AND
QUARTERTOWN LINE, R3 -23(H)
8.3.23.1 Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any R3 -23(H) Zone use any lot, or erect, alter or use any
building or structure for any purpose except the following:
a row dwelling house and a home occupation, provided the Holding (H)
symbol is removed in accordance with Section 8.3.23.2.6 of this By -Law
8.3.23.2. Notwithstanding any provision of By -Law Number 1994 to the contrary, no
person shall within any R3-23 Zone shall use any lot, or erect, alter or use
any building or structure except in accordance with the following provisions:
8.3.23.2.1 NUMBER OF DWELLING HOUSES PER LOT:
The minimum number of dwelling houses that may be constructed on the
lands to which the R3-23 zone applies shall be 17, and in no case shall the
number of dwelling houses on such lands exceed 25.
8.3.23.2.2 DEFINITION OF A PRIVATE STREET:
For the purposes of this section, a private street means a primary means of
access, by way of a private right-of-way or right of access contained in an
easement or condominium agreement, and is not under the jurisdiction of
the Corporation, the County or the Province.
8.3.23.2.3 SETBACK FROM A STREET LINE:
The minimum setback of a dwelling from a streetline shall be 7.5 m (24.6 ft)
8.3.23.2.4 FRONT YARD SETBACK FOR A ROW DWELLING HOUSE FROM A
PRIVATE STREET:
Minimum Depth: 6 m (19.7 ft) from the curb of
the private street
8.3.23.2.5 SETBACK BETWEEN A ROW DWELLING HOUSE AND A LOT LINE,
OTHER THAN A STREETLINE:

Minimum setback between a
row dwelling house and an R1 zoned lot: 7.5 m (24.6 ft)
Minimum setback between a
row dwelling house and any other lot line: 3 m (9.8 ft)
8.3.23.2.6 DISTANCE BETWEEN THE EXTERIOR WALLS OF END DWELLING
UNITS:
Minimum Distance: 3 m (9.84 ft)
8.3.23.2.7. REMOVAL OF HOLDING (H) PROVISION:
Development for any use in Section 8.3.23.1 of this By -Law shall only be
permitted at such time as written confirmation of water allocation has been
obtained from the County of Oxford and the holding provision has been
removed in accordance with the requirements of the Planning Act, RSO
1990, as amended.
8.3.23.2.8. That all other provisions of the R3 Zone in Section 8.2 to By -Law Number
1994, as amended, shall apply, and further that all other provisions of By -
Law Number 1994, as amended, that are consistent with the provisions
herein contained shall continue to apply "mutatis mutandis".
4. This By -Law comes into force in accordance with Sections 34(21) and (30) of the
Planning Act, R.S.O. 1990, as amended.
