3451 To provide for the sale of certain lands being Harvey Street, Plan 500, south of London Street to the end, except Part 2 on reference Plan 41R-5782, designated as Parts 1 to 6 on Reference Plan 41R-7894, in the Town of Tillsonburg, County ofTHE CORPORATION OF THE TOWN OF TII..LSONBURG BY-LAW NUMBER 3451 A BY-LAW to provide for the sale of certain lands being Harvey Street, Plan 500, south of London Street to the end, except Part 2 on reference Plan 41R-5782, designated as Parts 1 to 6 on Reference Plan 41R-7894, in the Town of Tillsonburg, County of Oxford. WHEREAS pursuant to Section 8 of the Municipal Act, 2001, S.O. 2001, C. 25, a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS pursuant to Section 34 of The Municipal Act, 2001 S.O. 2001, C 25, The Corporation of the Town of Tillsonburg is declaring surplus a road allowance being the south portion of Harvey Street, South of London Street and declaring that those lands should be sold. AND WHEREAS pursuant to Section 67(2) of The Municipal Act, 2001 S.O. 2001, C 25, if more than one person is in possession of the road allowance, each person is entitled to the soil and freehold of and a conveyance of that part of the allowance abutting their land to the middle line of the allowance. NOW THEREFORE the Council of The Corporation of the Town of Tillsonburg HEREBY ENACTS AS FOLLOWS: 1. That The Corporation of the Town of Tillsonburg sell the lands described as Part of Harvey Street, Plan 500, except Part 2 on RP 41R-5782, designated as Parts 1, 2 & 3 on Reference Plan 41R-7894 to Julie Ann Dawley and William Samuel Irwin being the property owners to the west, for the sale price of Five Thousand Dollars ($5,000.00) plus Six Hundred and Fifty Dollars and Eighty Two cents ($650.82) for the cost of preparation and deposit of the Reference Plan, provided that the Purchaser shall pay for all legal costs associated with this transaction, including legal costs of the Purchaser and the Vendor, and all costs associated with the preparation and deposit of the deed herein. 2. That The Corporation of the Town of Tillsonburg sell the lands described as Part of Harvey Street, Plan 500, except Part 2 on RP 41R-5782, designated as Parts 4, 5 & 6 on Reference Plan 41R-7894 to Jane Ann McLean being the property owner to the east, for the sale price of Five Thousand Dollars ($5,000.00), plus Six Hundred and Fifty Dollars and Eighty Two cents ($650.82) for the cost of preparation and deposit of the Reference Plan, provided that the Purchaser shall pay for all legal costs associated with this transaction, including legal costs of the Purchaser and the Vendor, and all costs associated with the preparation and deposit of the deed herein. 3. That the Mayor and Clerk are hereby authorized and instructed to perform all acts and to take such steps and execute such documents under the seal of the Corporation as may be necessary to affect such a conveyance. 4. This By -Law shall come into force and take effect immediately after the final passing hereof.
