Water Meter Replacement Program Presented By: Deborah Goudreau Delegation - County of Oxford Presentation Deborah Goudreau appeared before council to speak to the Water Meter Replacement Program. The County has awarded Corix Water Products the contract for the water meter replacement program in Tillsonburg, which will also include the installation of Electronic Radio Transmitters. Mandatory participation is required. A manual meter reading charge will be applied to a bill if a resident does not participate in the program. Council Meeting Minutes, February 08, 2016 - 3 - Booklets explaining the process will be mailed to properties and appointments can be booked on-line or by calling Corix. The program is anticipated to be completed by the end of the spring. There will not be a cost to the ratepayer or increased rates. Brian Moorehouse of Reinders & Rieder Ltd., agent for the applicant appeared before Council and spoke to the application. Mr. Moorehouse provided a slide presentation outlining the proposed revisions within the development. The Director of Operations noted that angled parking was brought forward with the original application, but is not advised north of Bridge Street before the downtown grows to accommodate this. Mr. James Battin, Solicitor for the neighbouring Verhoeve Funeral Home spoke against the application. DISCUSSION Background APPLICANT: The Corporation of the Town of Tillsonburg 200 Broadway, Tillsonburg ON, N4G 5A7 PROPOSAL: The Town of Tillsonburg has initiated a zone change application to update Zoning By-law No. 3295 to address a number of minor errors, omissions and zone duplications, which affect both text and key maps. New accessibility parking standards are also proposed to be consistent with the requirements of the Accessibility for Ontarian’s with Disabilities Act, 2005 (AODA). For Council’s information, this is the second housekeeping review since approval of the Zoning By-law in 2008. The following table provides a summary of the proposed housekeeping amendments: SECTION PROPOSED AMENDMENT Section 5.24.2.2 – Accessible Parking New accessible parking standards, as per the AODA, will be introduced. Comments 2014 PROVINCIAL POLICY STATEMENT: The 2014 Provincial Policy Statement (PPS) provides policy direction on matters of provincial interest related to land use planning and development. Under Section 3 of the Planning Act, where a municipality is exercising its authority affecting a planning matter, such decisions “shall be consistent with” all policy statements issued under the Act. Section 1.1.1 of the PPS directs that healthy, liveable and safe communities are sustained by improving accessibility for persons with disabilities and older persons by identifying, preventing and removing land use barriers which restrict their full participation in society. COUNTY OF OXFORD OFFICIAL PLAN: No specific sections of the Official Plan are impacted by the proposal as the zoning amendment proposes to address a number of minor errors, omissions and zone duplications, as well as introduce new accessible parking standards, as per the AODA. TOWN OF TILLSONBURG ZONING BY-LAW: The minor amendments affect the General Provisions (Section 5), Low Density Residential – Type 1 Zone (Section 6), Low Density Residential – Type 3 Zone (Section 8), Medium Density Residential Zone (Section 9), Central Commercial Zone (Section 13), Key Maps and Schedule “C-3” (Parking Space Requirements). The Town Building Services Department, Town Engineering Services Department, Town Recreation, Culture & Parks Department, Tillsonburg District Chamber of Commerce, County Public Health & Emergency Services Department and County Public Works Department had no concerns. PUBLIC CONSULTATION: Notice of the zone change application was posted in the Tillsonburg News on two occasions, November 24, 2015 and January 15, 2016. Individual notice was also sent to two property owners directly affected by the proposal. At the time this report was written, no comments or concerns had been received from the public. Planning Analysis The Town of Tillsonburg Zoning By-law No. 3295 was passed by Council on April 14, 2008. Based on discussions with Town staff, minor changes are required to correct minor errors of omission and site specific zone duplications. An analysis of the proposed housekeeping amendment is provided below. Text and Zone Duplications A large portion of the proposed amendments pertain to zone duplications that require minor changes to both text and key maps. There are two zone duplications that are required to be amended to ensure consistency (‘R1-13 and ‘IN1-1’). In both cases, a special zone was created to implement a site specific amendment to the By-law but the assigned zone number was already in use for another site. Over time, as site specific zones are added and deleted from the Zoning By-law, it is not uncommon for zone duplications to occur. The proposed minor housekeeping amendments related to such duplications serve to ensure correct provisions are properly reflected for each site specific zone. Staff is of the opinion that the proposed change is administrative in nature and has no impact on any provisions contained in the Zoning By-law. Key Maps There are five existing public parks and stormwater management ponds currently owned by the Town that are not currently zoned appropriately to reflect the use. The proposed amendment seeks to rezone these properties ‘Open Space (OS)’. As a result, five keys maps are required to be amended. Accessible Parking Standards On December 27, 2012, the Ontario government enacted the Design of Public Spaces Standards (O. Reg. 413/12 under the Accessibility for Ontarians with Disabilities Act, 2005), which includes new accessible parking requirements. The introduction of the updated accessible parking standards will ensure the Town’s Zoning By-law is consistent with current development standards and legislative requirements. The proposed amendment will introduce two types of accessible parking spaces into the Zoning By-law. A ‘Type A’ space, also known as ‘van accessible’ is required to have a minimum width of 3.4 m (11.2 ft), while a ‘Type B’ space is required to have a minimum width of 2.7 m (8.9 ft). The number of each type of accessible parking space is determined based on the number of standard parking spaces that are required. An access aisle with a width of 1.5 m (4.9 ft), extending the full length of the parking space, is also required for each accessible parking space. Such aisles shall also be marked with diagonal lines to discourage parking. Projections into Required Side Yard Through regular usage of the Zoning By-law it has been determined that a minimum setback between a projection (i.e. uncovered and covered decks) and a side lot line is required to ensure consistency with the remaining setback requirements from the front, rear and exterior side lot lines. Typically, through regular usage of the By-law, certain provisions are identified as being either unclear, or not reflective of the intent for which the provision was drafted. In this case, the proposed amendment will ensure the Zoning By-law is consistent and interpreted in the manner intended by the Town. Place of Worship in the ‘CC’ Zone The Zoning By-law currently permits a place of worship in the entire ‘CC’ zone. The ‘CC’ zone reflects the Central Area, representing the most functionally diverse area of the Town and primary business, cultural and administrative centre. This area is to remain a viable regional retail shopping district and people place. To maintain this vision and the existing character of the commercial core along Broadway, the proposed amendment seeks prohibit a place of worship on lands fronting or flanking on Broadway within the ‘CC’ zone. As churches often do not exhibit the same vibrancy and visual characteristics as downtown commercial uses, it would seem appropriate to limit the establishment of such uses in the commercial artery of the Town. Planning staff is of the opinion that the proposed amendment will ensure the visual characteristics of the downtown commercial core are maintained. WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg deems it advisable to amend By-Law Number 3295, as amended. THEREFORE, the Municipal Council of the Corporation of the Town of Tillsonburg, enacts as follows: 1. That Section 5.24.2.2 to By-Law Number 3295, as amended, is hereby deleted and replaced with the following: “5.24.2.2 ACCESSIBLE PARKING 5.24.2.2.1 Accessible parking spaces are to be provided in two sizes for all non-residential and multiple residential uses including, an apartment dwelling, boarding or lodging house and multiple unit dwelling, as identified on Schedule “C-3”: (i) Type A shall have a minimum width of 3.4 m (11.2 ft) and a minimum length of 5.5 m (18 ft). The applicant has requested a 5 year extension to the draft plan until February 2021. For Council’s information, Oxford County granted draft plan approval for a residential plan of subdivision on the subject property in February 2007. The draft plan proposed development of 290 lots for single detached dwellings, 6 blocks for townhouses, 4 blocks for either townhouses or single detached dwellings, 6 blocks for walkways, 3 blocks for road widenings, 1 reserve block, 2 stormwater management blocks, 2 parkland blocks, 1 block to be conveyed to an adjacent property owner and 11 local streets. Approval was granted subject to 26 conditions and an original lapsing date of February 14, 2010. An extension was granted in 2010 for one year, and a 5 year extension was granted in 2011. Since the original draft approval, two phases have been registered. Phase 1 was registered in 2007 and consisted of 42 single detached dwelling lots, 3 blocks for townhouses, a storm water management block and a park block. Phase 2 was registered in 2013 and included 52 single detached dwelling lots, a storm water management block and a park block. The balance of the lands are currently vacant and comprise approximately 15.6 ha (38.53 ac). Plate 1, Location Map, shows the location of the subject lands, with an overlay of the draft approved plan of subdivision. Plate 2, Draft Approved Plan of Subdivision, shows the proposed lot and road configuration of the draft plan approved subdivision. Planning Analysis The applicant has requested to extend draft plan approval of the above noted subdivision for an additional five (5) year period. As indicated in the request, the applicant is currently in the process of completing the required conditions implemented in the draft approval from 2007, and feel that due to the large number of lots outstanding, they will not be in a position to have all conditions met for additional phases of the development within the typical 2 year period and are therefore requesting an extension of 5 years. Page 2 of 3 57 Report No: CASPO 2016-23 COMMUNITY AND STRATEGIC PLANNING Council Date: February 8, 2016 It is noted that since this development was approved, the process for water and sanitary sewer servicing allocation has changed. Holding provisions are no longer used to allocate servicing allocation. Servicing allocation is available for 50 lots at a time, with further allocations possible once 30 of the 50 lots have been developed. Staff are recommending that a two (2) year extension be granted, as is the practise to ensure that sufficient water/wastewater capacity continues to exist, and to ensure the applicant continues to actively work towards registration of the approved plan. It is also noted that none of the agencies circulated had any concerns with the proposed extension. As such planning staff are recommending a two (2) year extension to the approved plan. At such time as the two (2) year period draws to a close, an application for an additional extension would be considered. In light of the foregoing, Planning Staff are supportive of a two (2) year extension of the draft approved plan of subdivision as it will allow the applicant additional time to clear the outstanding conditions of draft plan approval and register additional phases of the draft plan of subdivision. A resolution of Town Council, in support of the owner’s request, is requested in order to grant an extension of the approval period. RECOMMENDATION It is recommended that the Council of the Town of Tillsonburg advise Oxford County that the Town supports an extension of draft approval for a plan of subdivision submitted by Victoria Wood Tillsonburg GP., for lands described as Lots 1, 2, 3, 4 & Part of Block A, Plan 1082, Part Lot 7, Concession 12 (Dereham), Town of Tillsonburg, to February 14, 2018, to grant additional time to satisfy the conditions of draft plan approval and register the draft plan of subdivision. WHEREAS, in accordance with Section 15 of the Planning Act, R.S.O. 1990, as amended, the Council of an upper-tier municipality, on such conditions as may be agreed upon with the Council of a lower-tier municipality, may: (a) Assume any authority, responsibility, duty or function of a planning nature that the lower-tier municipality has under this or any other Act; or, (b) Provide advice and assistance to the Local Area Municipality in respect of planning matters generally. AND WHEREAS, the Corporation of the Town of Tillsonburg deems it desirable to enter into an agreement providing for Planning Advisory and Administrative Services from the County of Oxford Community & Strategic Planning Office; NOW THEREFORE, the Council of the Corporation of the Town of Tillsonburg enacts as follows: 1. That the Mayor and Clerk be authorized and are hereby instructed to execute on behalf of the Corporation of the Town of Tillsonburg an Agreement with the County of Oxford for the provision of planning advisory and administrative services. 2. Purpose: The purpose of this Agreement is to set out the general terms regarding Planning Advisory and Administrative Services to the Corporation of the Town of Tillsonburg pursuant to Section 15 of the Planning Act, R.S.O. 1990, as amended. B. Terms and Definitions: a) “County Clerk” shall mean the person duly appointed to hold the position of the Clerk of the County of Oxford, or his/her duly appointed delegate. b) “County Council” means the Council of the County of Oxford. c) “County Planning Office” means the Community and Strategic Planning Office of the County of Oxford, or other similarly constituted office or department of the County having the mandate and responsibility for reviewing matters related to land use planning under the Planning Act, R.S.O. 1990, as amended. d) “Director of Planning” means the person duly appointed to hold the position of the Director of Planning of the County Planning Office, or a person appointed by the Director as his/her delegate. e) “Local Area Council” means the Council of the Town of Tillsonburg. f) “Local Area Municipality” means The Corporation of the Town of Tillsonburg. g) “Municipal Clerk” means the person, duly appointed to hold the position of the Clerk of the Local Area Municipality, or his/her duly appointed delegate. h) “County of Oxford” or “County” means the County of Oxford. C. Development Review Services: The County Planning Office will provide professional planning advisory and administrative services to the Local Area Municipality as follows: 1. Provide information and advice to the general public, developers, agents, etc., municipal staff and other departments, boards and/or committees of the Local Area Municipality regarding land use planning matters within the Local Area Municipality. This may include attendance at meetings of said departments, boards and/or committees as may be necessary from time to time. 2. Maintain office hours in the Local Area Municipality to meet the needs of the municipality as is deemed by the Director of Planning, in consultation with the Local Area Municipality, to be appropriate and within the resources and capabilities of the County Planning Office. Where it is agreed that on-site service is appropriate, the Local Area Municipality shall be responsible for providing adequate work space for County Planning staff, to the satisfaction of the Director of Planning. 3. Serve as liaison between the Local Area Municipality and the County of Oxford’s Geographic Information Systems (GIS) Department with respect to matters pertaining to the collection and use of GIS and related data. 4. Assist and advise applicants and/or their agents regarding the completion and submission of applications for amendments to the Local Area Municipality’s Zoning By-law (including applications for Minor Variance) and applications for Site Plan Approval. 72 5. Undertake administrative activities and provide professional planning advisory services associated with development applications as follows: i) Zoning By-laws / Amendments a) Undertake pre-consultation with respect to applications as may be requested by an applicant/agent and/or the Local Area Municipality. b) Receive applications filed directly with the County Planning Office or with the Local Area Municipality and review same for completeness. The completeness of an application will be determined by the County Planning Office in accordance with the applicable policies of the Oxford County Official Plan and/or as prescribed in the Planning Act, R.S.O. 1990, as amended. The County Planning Office will issue the required notice(s) regarding the completeness of an application in accordance with the applicable provisions and regulations of the Planning Act and will, as necessary, contact the applicant to obtain such additional information as may be required to deem an application to be complete. The determination of the completeness of an application, or the information necessary for an application to be considered complete, will be at the discretion of the County Planning Office. c) Circulate applications to prescribed persons and public bodies and prepare and circulate public notices in accordance with the applicable provisions and regulations of the Planning Act, R.S.O. 1990, as amended, or in accordance with the relevant modified or alternative notification policies contained in the County Official Plan and where such modified or alternative provisions have been adopted by the Local Area Municipality. d) Prepare reports for presentation to the Local Area Council based on a detailed review of the application and related information. Such reports will provide the details of the application; the comments received from agency circulation and public consultation; an overview of the relevant Provincial and Official Plan policies and other planning considerations; and the County Planning Office’s professional planning opinion(s) and recommendation(s) with respect to the application. Reports will be provided to the Municipal Clerk prior to the Local Area Council meeting in a format suitable for publishing in the Local Area Council’s agenda. e) Prepare Zoning By-law amendments, including all text and schedules, for consideration by the Local Area Council, as required. f) Attend Local Area Council meetings for the purpose of presenting the planning report and professional planning opinion(s) and recommendation(s) of the County Planning Office with respect to the application. The County Planning Office will respond to all relevant questions of the Local Area Council, the public and any other interested stakeholders during the Local Area Council’s public meeting(s) at which the application is considered. g) The responsibilities of the Local Area Municipality regarding Zoning By-laws / Amendments are as follows: 1. The Local Area Municipality shall provide to the County Planning Office a mailing list of all neighbouring properties to be notified of a complete application and any public meetings related to a development application, as prescribed by the Planning Act, R.S.O. 1990, as amended and/or the alternative notification policies contained in the County Official Plan where such alternative policies have been adopted by the Local Area Municipality. 73 2. The Local Area Municipality shall provide to the County Planning Office, in a timely manner and as prescribed by the Planning Act, R.S. O. 1990, as amended, all documents related to the decision(s) of the Local Area Council in respect of a development application. ii) Minor Variance Applications a) Prepare reports for presentation to the Local Area Committee of Adjustment providing the details of the application, the comments received from agency and public circulation, the County Planning Office’s professional planning opinion(s) and recommendation(s) with respect to the application. Reports will be provided to the Municipal Clerk prior to the Local Area Committee of Adjustment meeting in a format suitable for publishing in the Local Area Municipality’s agenda. b) Attend Local Area Committee of Adjustment meetings for the purpose of presenting the planning report and related information and the professional planning opinion(s) and recommendation(s) of the County Planning Office. The County Planning Office will respond to all relevant questions of the Local Area Committee of Adjustment, the public and any other interested stakeholders during the Local Area Committee’s public meeting(s) at which the application is considered. iii) Site Plan Applications / Amendments a) Provide comments to the Local Area Municipality regarding applications for site plan approval or applications to amend an existing site plan approval and/or prepare reports for presentation to the Local Area Council, where requested. The County Planning Office will provide professional planning advice, project management services and/or otherwise assist the Local Area Municipality in identifying and completing land use planning related studies and projects that are within the resources and capabilities of the County Planning Office. 2. The determination of what constitutes a land use planning related study or project and the ability and/or capacity of the County Planning Office to assist with such study or project, taking into consideration the Office’s resources and capabilities, will be at the discretion of the Director of Planning. 3. The costs associated with any land use planning related study or project undertaken by the County Planning Office will be shared between the Local Area Municipality and the County in a manner determined by the respective Councils to be appropriate for the scope of the study or project. E. Minor Variances Directly Related to Consent Applications: 1. The Local Area Council hereby transfers the administration and approval authority powers of the Local Area Council (as a “lower-tier municipality”) under Sections 44 and 45 of the Planning Act, R.S.O. 1990, as amended, to the County of Oxford for those applications for Minor Variance from the Local Area Municipality’s Zoning By-law that are directly related to any application for Consent submitted to the County under Section 53 of the Planning Act, R.S.O. 1990, as amended, subject to the following conditions: a) that the application is for Minor Variance from the provisions of the Local Area Municipality’s Zoning By-law that are deemed to be required as the direct result of the approval of an application filed with the County of Oxford for Consent pursuant to Section 53 of the Planning Act, R.S.O. 1990, as amended; b) the determination as to whether a Minor Variance is the direct result of the approval of an application for Consent will be at the discretion of the Director of Planning; c) the County of Oxford may delegate the approval authority for Minor Variances as described in a), above, to a duly appointed committee of the County of Oxford as constituted under Section 51.2 of the Planning Act, R.S.O. 1990, as amended. BACKGROUND INFORMATION Wise Line Metal Sales Inc is a custom manufacturer of metal siding, roofing, garages and steel products for the agricultural and construction industries. They have been in business for over ten years and are currently growing. As they are unable to expand at their current location, they are looking for a new location for their business. Staff has been working with representatives from Wise Line since November to find a suitable location in Tillsonburg. 79 An offer to purchase has been submitted for a portion of the Town-owned property located on Clearview Dr (see below sketch). The Buyer has submitted an offer for 7 acres shown as the South Block and has also requested a Right of First Refusal for the 6.3 Acre North Block. Town-Owned Clearview Drive Property Wise Line is planning to construct a 30,000 square foot building on the seven acre site if approved by Council. A 30,000 square foot building would cover approximately ten percent of the lands being purchased with the remainder being used for parking, truck movement, outdoor storage and lands for future expansion. The ROFR has been reduced to a 5 year period. A ROFR is generally preferable to a land option as it only gives the Buyer the right to match the terms of a third party offer received whereas a land option gives the Buyer the right to buy the land on their own terms and conditions. In this case, if a third party offer were received by the Town, Wise Line would have ten business days to match the offer after which the Town would be free to proceed with the third party offer. Lot coverage Municipal land sales typically have a requirement to construct a minimum portion of the lot and the lot coverage for this sale is 10%. 10% lot coverage is somewhat low so it could be argued that the Buyer is purchasing too much land for their proposed building footprint. However, they have indicated that they require excess lands for both some of their business operations and also for a future doubling of the plant size if they continue to grow. Most industrial developments in this area do not exceed 40% lot coverage so the additional land is reasonable. Financing Condition Buyer has submitted the offer conditional on them arranging financing on Feb 18 This is a fairly standard condition for industrial/commercial offers to purchase. There is less risk of the offer proceeding due to the shorter conditional period. Price The Offer has been submitted at a price of $21,428.57/acre, which is below the asking price of $26,000/acre Although the price is below the asking price, the Buyer has indicated that $150,000 is their budget for land acquisition. The Town has not received any significant interest in this property since 2011 and the sale of the land will result in development, tax and other revenues for the Town while supporting private sector construction and growth. The Offer to Purchase has been reviewed by Duncan, Linton LLP and they have provided advice on clarifying the legal description and the easements related to the property. FINANCIAL IMPACT/FUNDING SOURCE The Clearview Drive property has been marketed for a number of years at $26,000 per acre and the Town had previously sold 3.88 acres at $24,000 per acre in 2011. These lands were subsequently repurchased by the Town due to the Buyer not meeting the Town’s covenants. The current offer has been submitted at price of $150,000 or $21,428.57 per acre. The cost charged against these lands is approximately $2,541 per acre. SUMMARY In November of 2015 the Town entered into an agreement with the Ministry of Transportation for the design and rehabilitation of Broadway Street from the north Town limits southerly by 765m towards North Street. The remaining 150m was excluded from the MTO agreement due to the potential servicing work with Oxford County’s anticipated projects in 2016 and 2017 in the proximity to Broadway and North Street (Broadway/North Street intersection work, North Street reconstruction east of Broadway Street, North Street watermain work west of Broadway Street). The Agreement with the MTO considered a milestone after the design phase to provide the Town an opportunity to review and assess the geotechnical investigation, consultant recommendations, final design drawings and updated cost estimate before providing the Ministry with direction to proceed with including the Town’s scope of work. The geotechnical investigation included extracting core samples to conduct a detailed condition assessment of the pavement structure. Results revealed that the pavement base structure is in worse condition than initially anticipated and will require more Page 1 / 3 84 rehabilitation work than originally estimated when identifying preliminary construction cost estimates. Based on the assessed condition, the consultant recommends a pavement design with partial depth extensive road base rehabilitation through a sustained portion of the road segment. Ministry and Town staff originally anticipated limited road base rehabilitation work at the time of executing the Ministry agreement based on the 2015 road condition survey results and the corresponding OGRA pavement condition decision matrix for arterial roads, which indicated surface rehabilitation in the 1-5 year timeframe. Based on the geotechnical engineer’s recommended design to address the extensive structural deficiencies, the revised cost estimate is summarized below: Item Preliminary Town Est. The application was updated before submission to include the results of the geotechnical investigation, consultant recommendations and revised detailed cost-estimates for the full road segment. Should the application be successful and the project receive 90% funding, the remaining 10% of the project can be funded from the 2016 budget. It should be noted that the project submitted is a strong candidate for funding based on the objectives of the program, with investments that: • Address critical connecting link improvement needs; • Extend the life of the asset; • Are cost effective and appropriate to address connecting link needs; and • Ensure the safe and efficient movement of provincial traffic. Page 2 / 3 85 Additionally, the Town has been proactive in establishing an agreement with the MTO and investing in detailed analysis and design for this segment to ensure the opportunity to partner with the Ministry was available and to appropriately address the critical needs of this segment. The Town has positioned itself to demonstrate: • Project criticality; • Project urgency; • Cost-effectiveness and appropriateness to address the need; • Appropriate project and eligible costs identified; • Documentation of asset management and maintenance programs; and • Project coordination with adjacent highway projects. FINANCIAL IMPACT/FUNDING SOURCE Given the significant change in the scope of work to address the severely deteriorated road base structure the estimated project cost now ranges from $460,400 to $604,500. Based on the revised estimates, which do not consider the current economy, there is the potential of a budget shortfall of $25,000 to $170,000. The extent of budget impact would be dependent on the actual Tender results and on the outcome of the Connecting Link funding application. Without a committed funding source for the full scope of Town work, it is not recommended by Town or Ministry staff to continue with the procurement process at this time. If the Tender results are significantly higher than the available 2016 project budget, and the Town is not successful in securing Connecting Link funding, the Town would be required to make up the budget shortfall. If the Connecting Link funding application is successful (announcements estimated by the Ministry in Spring 2016) the Town’s work can be added to the construction contract through an addendum during the Tendering Phase or through a Change Order during the Construction Phase with anticipated minor incidental costs due to the structure of the Town’s Agreement with the Ministry. Between 2009 and 2011 Oxford County began the Universal Metering project with the Woodstock water distribution system that included the installation of new water meters on all residential services and the retrofitting/replacement of existing meters on Industrial, Commercial and Institutional (ICI) services as necessary. The project also included the installation of low frequency radio transmitters on every meter (new or existing) that would allow water meter readings to be completed from the street. In early 2015 Oxford County began the planning process for Phase 2 of the Universal Meter project which would upgrade all remaining water distribution systems within the County, including Tillsonburg. Town and County staff have collaborated throughout the planning process that lead to the County tender call and subsequent County Council award for the supply and installation of new water meters and radio transmitters in December 2015 to Corix Water Products Limited Partnership. The Tillsonburg water distribution system is already a metered system, however any water meter ten (10) years or older is scheduled to be replaced as part of this project in addition to retrofitting every water meter (new or existing) with the low frequency radio transmitters to allow drive-by water meter reading. With the water distribution system of Tillsonburg being the second largest in Oxford County the installation process of Phase 2 is scheduled to begin on February 29th 2015. Page 1 / 2 87 Part of the installation process will require all homeowners and business to schedule an appointment to have an identifiable, certified technician perform the water meter replacement (if required) and installation of the radio transmitter. Customers will also be required to ensure the area around the existing water meter is clear to provide adequate working space. CONSULTATION/COMMUNICATION Oxford County, as the Owner of the Tillsonburg water system is responsible for the communication to all customers. The communication process for Tillsonburg is scheduled to begin the week of February 8th 2016 with the delivery of pamphlets to residents on a zone by zone basis. Other communication is to include special radio and newspaper advertisements. Oxford County has also scheduled a Public Information Session (PIC) for February 17th 2016 at the Tillsonburg Community Centre Marwood Lounge from 4:00pm to 7:00pm. BACKGROUND At the Council Meeting of September 28, 2015, a resolution was passed: THAT Council receives report RCP 15-36 – Trans Canada Trail Expansion Project for information; AND THAT Council approves proceeding with development of the Trans Canada Trail link to Norfolk County as outlined in report RCP 15-36; AND THAT Staff be authorized to develop a partnership agreement with the County of Oxford for the development and on-going maintenance of the Trans Canada Trail within Oxford County including: a) Sharing net capital costs on an 85/15 (County/Town) basis; b) Repayment terms to the County for the Town of Tillsonburg’s 15% capital contribution; c) 50/50 sharing of annual operating costs of the proposed Trans Canada Trail. The attached Agreement was drafted by the County and is submitted for Council consideration. It meets the requirements of the resolution noted above. RCP 16-05 - Trans-Canada Trail Expansion 1/2 91 CONSULTATION/COMMUNICATION The draft Agreement was reviewed by the Town’s legal advisors and their suggested changes were incorporated into the draft. Town staff has discussed the repayment terms contained within the Agreement with County staff. FINANCIAL IMPACT/FUNDING SOURCE The Town’s 15% of the capital cost is currently set at $46,500 to be repaid to the County in equal installments over 10 years. As the trail will not open until 2017, the impact of this payment and the operational costs of the Trail Expansion will be incorporated into the 2017 Town Budget process. The terms of the financing will be arranged at the best possible interest rate. It is not possible for the loan to be interest free unless County Council authorizes a change or a waiving of their Debt Management Policy. The actual loan documents will be brought to this Council for authorization once they are available. COMMUNITY STRATEGIC PLAN (CSP) IMPACT N/A RCP 16-05 - Trans-Canada Trail Expansion 2/2 92 TRANS CANADA TRAIL AGREEMENT B E T W E E N: The Corporation of the Town of Tillsonburg (the Town) OF THE FIRST PART -and- County of Oxford (the County) OF THE SECOND PART WHEREAS the Town and the County wish to enter into an agreement establishing the roles and responsibilities for the construction and operation of a section of the Trans Canada Trail (TCT), as described in this Agreement. AND WHEREAS the parties agree that the intent of this Agreement is to enter into an agreement to construct and operate a section of the TCT from the existing TCT owned by the Town of Tillsonburg, easterly through the Townships of South-West Oxford and Norwich to Base Line Road, primarily on the abandoned Canada Southern (CASO) rail line owned by the County with some on-road sections, as shown on Schedule “A” attached hereto (hereinafter, the “Oxford/Tillsonburg TCT Segment”). AND WHEREAS the parties agree that the County Public Works Report PW 2015-53 dated September 23, 2015 and the Town of Tillsonburg Report RCP 15-36 dated September 28, 2015 were adopted by the respective Councils directing staff to negotiate this Agreement. AND WHEREAS the parties agree to work together to maximize the in-kind contributions and donations from third parties for this project, with the goal of reducing the Town and County costs for constructing and operating the Oxford/Tillsonburg TCT Segment. NOW THEREFORE this Agreement witnesses that in consideration of the mutual covenants and agreements herein and other good and valuable consideration, of which the parties hereby confirm the sufficiency, the parties hereto agree as follows: Background 1. Definitions 1.1. Capital Cost All costs to develop and construct the Oxford/Tillsonburg TCT Segment, including, but not limited to, design, gates and fencing, signage, grading and surface construction, parking areas, clearing and brushing, and ramps or other amenities that may be required pursuant to the Accessibility for Ontarians with Disabilities Act (AODA) shall be considered capital costs. Design and construction of culverts and bridges shall not be considered capital costs and will be the sole responsibility of the County. 93 1.2. Operational Costs All costs to oversee, patrol and maintain the as built Oxford/Tillsonburg TCT Segment, including, but not limited to, maintenance and repair of the trail surface, fences and gates, signage, and parking areas, and clearing, brushing, and garbage removal shall be considered operational costs. Maintenance and repair of culverts and bridges shall not be considered operational costs and shall be the sole responsibility of the County. 1.3. Trail Usage The Oxford/Tillsonburg TCT Segment is to be a “Multi-use Recreational Trail” and the uses shall include walking, hiking, running, cycling, horseback riding, snow shoeing and cross country skiing. Use by snowmobiles will be subject to County approval and agreement with the local snowmobile club regarding maintenance and insurance. This activity will not be subject to any operational or patrol oversight by the Town. Otherwise, no motorized vehicles will be allowed on the Oxford/Tillsonburg TCT Segment except for maintenance and emergency operations. General Terms 2. The Capital Cost estimated for this project is $870,000.00. Any increase in this budget shall be approved by Resolution of both respective Municipal Councils. Capital Cost sharing under this Agreement will cease once the parties agree that the Oxford/Tillsonburg TCT Segment is constructed. 3. The cost sharing for the Capital Costs of the Oxford/Tillsonburg TCT Segment is: Grant for Trans Canada Trail $310,000 Grant for Pan Am / Parapan Am Games Legacy Fund $250,000 County Contribution (85% of remaining costs) $263,500 Town Contribution (15% of remaining costs) $46,500 4. The cost sharing for the Operational Costs of the Oxford/Tillsonburg TCT Segment shall be allocated with fifty (50) percent paid by the County and fifty (50) percent paid by the Town. 5. Donations in-kind by third-parties, covering either capital or operational costs, shall be allocated between the Town and County as per the above cost sharing ratios, (85% County / 15% Town for Capital Costs and 50% / 50% for Operational Costs). 6. In-kind work by either the County or Town agreed to by the parties, related to either construction or operation of the Oxford/Tillsonburg TCT Segment, shall be part of the respective municipal contribution. 7. Lands for Construction of the Oxford/Tillsonburg TCT Segment Where the Oxford/Tillsonburg TCT Segment pursuant to this Agreement is not located on a municipal highway, it shall be constructed on the abandoned CASO rail line. This land is owned by the County of Oxford. 94 8. Term of the Agreement The Term of the Agreement shall be ten (10) years commencing on January 1, 2016 and ending on December 31, 2025. After December 31, 2025 and subject to the parties renegotiating the Agreement, the Agreement will automatically extend for one year at a time unless either of the parties gives six (6) months termination notice in accordance with Section 6 below. 9. Termination of the Agreement The Agreement cannot be terminated for five (5) years or until the completion of construction as agreed to by the parties. After five (5) years, either party may terminate the Agreement by giving written notice at least six (6) months prior to the end of the calendar year terminating the Agreement on January 1st of the following calendar year. 10. The Town covenants and agrees: 10.1. To work with the County to produce a work plan to construct the Oxford/Tillsonburg TCT Segment, which work plan shall be based on the construction of the proposed trail route as shown on Schedule “A”, unless this trail route is amended in accordance with section 12.1 below. 10.2. To pay their share of the Capital Costs to the County. 10.3. To patrol the Oxford/Tillsonburg TCT Segment as part of their overall Town Trail Program and perform the routine and yearly maintenance. 10.4. To provide the County with the estimated annual Operational Costs of this work by September 1st each year, for the following year (hereinafter the “Annual Estimate”). 10.5. To provide the County with an annual invoice (including appropriate supporting documents) for fifty (50) percent of the actual Operational Costs by December 15. Any actual Operational Costs in excess of fifty (50) percent of the Annual Estimate shall be requested, with rationale, in writing by the Town to the County, and payment shall be subject to County approval. 11. The County covenants and agrees: 11.1. To work with the Town to: (1) produce a work plan to construct the Oxford/Tillsonburg TCT Segment, which work plan shall be based on the construction of the proposed trail route as shown on Schedule “A”, unless this trail route is amended in accordance with section 12.1 below; and (2) to finance the initial construction costs attributed to the Town. 11.2. To enter into an agreement with the Trans Canada Trail Foundation for the grant funding of this project. 11.3. To undertake bridge and culvert operations and maintenance as part of the County program. 11.4. To pay fifty (50) percent of the actual Operational Costs undertaken by the Town for the Oxford/Tillsonburg TCT Segment within 30 days of receipt of the invoice and appropriate supporting documentation, provided that the actual Operational Costs are not more than the Annual Estimate. Payment of Operational Costs in excess of fifty (50) percent of the Annual Estimate shall be considered by the County in accordance with section 10.5 above. 12. The County and the Town covenant and agree: 95 12.1. The proposed trail route as shown on Schedule “A” can only be amended by resolutions of both the Town and County Councils. 12.2. To indemnify and hold harmless each other, and their respective officers, directors, agents, employees and Councillors from and against any and all claims, damages, losses, expenses or other proceedings by whomsoever made, directly or indirectly arising out of this Agreement. 12.3. To obtain and keep in force, at its own expense, during the term of this Agreement, general liability insurance on an occurrence basis for third party bodily injury, personal injury and property damage to an inclusive limit of not less than $5 million per occurrence, written by an insurer licensed to conduct business in the Province of Ontario, and including the following: a) Naming the other party as additional insured with respect to liabilities arising in connection with this Agreement; b) Cross liability and severability of interest clauses; c) Contractual liability, both oral and written; and d) Thirty (30) days notice of cancellation, termination or material change. Severability 13. In the case where one or more of the covenants, terms and provisions contained in this Agreement shall be held invalid, illegal or unenforceable in any regard, the validity of the remaining covenants, terms and provisions contained herein shall in no way be affected, prejudiced or disturbed and the remaining covenants, terms and provisions shall remain in full force and effect. EXECUTIVE SUMMARY Conditional on approval by the Town of Tillsonburg, the County of Oxford proposes entering into a partnership with the Town to develop a Trans Canada Trail on County-owned former railway rights-of-way connecting Tillsonburg to Norfolk County. This report provides background on the proposed partnership and recommends approval from Council to proceed with implementing the Trans Candaa Trail project and to develop a partnership agreement for Council approval. BACKGROUND The Oxford County Trails Master Plan identifies several high-priority links connecting to Tillsonburg using former rail corridors, one of which is the link to Norfolk County (Map 3.13). The section of Trans Canada Trail (TCT) within Tillsonburg is not connected to the larger TCT network to the east. Completing this gap through Oxford County by 2017 is also a high-priority goal of the National TCT organization. It is anticipated that establishing this link will attract tourist dollars 97 RCP 15-36 - Trans Canada Trail Expansion Project.docx 2/4 and trail users to Tillsonburg and provide ratepayers with healthy, active recreational opportunities. In 2013, the Tillsonburg Council of the day authorized staff to continue discussions about developing regional rail trail linkages to Tillsonburg (Report PRS 13-12). This past December, the current Council authorized the Town’s participation in joint funding applications submitted by the County of Oxford to establish a Trans-Canada Trail link between Tillsonburg and Norfolk County (Report RCP 14-42). The County of Oxford also applied for Canada 150 Infrastructure funding. To date, funding applications to Trans-Canada Trail and to the Pan Am Games Legacy fund have been successful, and funding of up to $510,000 towards the Tillsonburg-Norfolk section has been approved. No decisions on the applications to the Canada 150 Infrastructure funding program have been received at this time. $200,000 of the approved $510,000 is from the Pan Am Games Legacy Fund and must be spent by March 31, 2016. The Township of South West Oxford (SWOX) and the Township of Norwich have declined to participate in funding any portion of the Trans Canada Trail. However, SWOX has applied for Canada 150 Infrastructure funding to establish the Tillsonburg to Brownsville link. The Eastern-most portion of the proposed TCT link to Norfolk is road based, and would join with a short road-based section in Norfolk County connecting to the TCT rail-trail just South of Delhi. 98 RCP 15-36 - Trans Canada Trail Expansion Project.docx 3/4 The budget as estimated by County staff for the trail development projects (via a combination of cash and in-kind contributions) is summarized as follows: Trail Budget Grant Funding Municipal Contribution Trans-Canada Trail (Tillsonburg to Baseline Road – 15.3 km) $870,000 $510,000 (Confirmed) $360,000 (15% Tillsonburg/85% County) Therefore, the Town’s portion of the budget for the capital components would total $54,000 (15% share of $360,000). Should additional partners be secured and/or grant applications be successful, any amount would reduce each partner’s cost. The decision before Tillsonburg Council at this time is whether or not to partner with the County to implement the TCT connection to Norfolk. The elements of the partnership (conditional on approval by Tillsonburg’s Council) on which County Council will be voting about on Sept. 23, 2015 (Report PW 2015-53 Trans Canada Trail) are: 1. The County of Oxford will own the rail trail property, consent to the trail use, and be responsible for the capital costs and maintenance of culvert and bridge infrastructure to the level of a utility corridor; 2. Tillsonburg and the County will jointly fund the capital costs of implementing the trail link on a 85/15 (County/Town) basis, offset by whatever funding can be secured from grants. To date, secured funds total $510,000. 3. The County of Oxford will finance the Tillsonburg contribution required for the initial construction with the loan to be repaid by Tillsonburg over a specified term. 4. Tillsonburg and the County will jointly fund the maintenance costs for the trail links on a 50/50 basis, with Tillsonburg staff carrying out the routine maintenance and monitoring tasks. Based on similar rail trails in the Trans Canada system, the estimated cost for maintenance on the proposed trail is approximately $10,000 annually. The partnership arrangement under discussion would see the County remitting their 50% share of the maintenance costs to the Town of Tillsonburg on an annual basis, and the Town carrying out the routine maintenance and inspections on behalf of the partnership. In addition, Town of Tillsonburg staff would work closely with County staff to manage and implement the trail development project over the next two years. CONSULTATION/COMMUNICATION There has been extensive consultation with the County of Oxford, Trans-Canada Trail, the Oxford County Trails Council, the Township of Norwich and the Township of South-West Oxford. FINANCIAL IMPACT The Town’s portion of the estimated $870,000 capital cost of the proposed project is $54,000, or 15% of the $360,000 not yet funded by grants. Further investigation is required to determine how much, if any, of the Tillsonburg share could be in-kind rather than cash. 99 RCP 15-36 - Trans Canada Trail Expansion Project.docx 4/4 The annual impact on the Town to finance this cost would be approximately $5,400 plus interest for a 10 year term. This loan would be issued by the County of Oxford. A different term and/or interest rate could be utilized which would change the annual impact. The Town’s 50% portion of the estimated $10,000 annual maintenance costs for the 17.8km of trail identified in this project would be $5,000. COMMUNITY STRATEGIC PLAN (CSP) IMPACT Goal 4.2 of the CSP looks to the Department to continue implementation of the Community Parks Recreation & Cultural Strategic Master Plan (SMP). Recommendations 6.4 & 6.5 of the SMP speak to the continued expansion of the trail network to facilitate connectivity and active transportation modes. 100 THE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER 3988 A BY-LAW to dedicate certain reserves owned by the Corporation of the Town of Tillsonburg as parts of public highways in the Town of Tillsonburg. WHEREAS The Municipal Act, S.O. 2001 c. 25, Sections 26 and 31, authorizes municipalities to pass by-laws for establishing highways for public highway purposes; and WHEREAS the Corporation of the Town of Tillsonburg is the owner of certain reserves abutting public highways as listed in Column 1 as shown on Registered Plan in Column 2 of Schedule “A” attached hereto; AND WHEREAS it is necessary to dedicate a public highway over the said reserves listed in Schedule “A”; THEREFORE the Council of the Town of Tillsonburg enacts as follows: 1. WHEREAS, in accordance with Section 15 of the Planning Act, R.S.O. 1990, as amended, the Council of an upper-tier municipality, on such conditions as may be agreed upon with the Council of a lower-tier municipality, may: (a) Assume any authority, responsibility, duty or function of a planning nature that the lower-tier municipality has under this or any other Act; or, (b) Provide advice and assistance to the Local Area Municipality in respect of planning matters generally. AND WHEREAS, the Corporation of the Town of Tillsonburg deems it desirable to enter into an agreement providing for Planning Advisory and Administrative Services from the County of Oxford Community & Strategic Planning Office; NOW THEREFORE, the Council of the Corporation of the Town of Tillsonburg enacts as follows: 1. That the Mayor and Clerk be authorized and are hereby instructed to execute on behalf of the Corporation of the Town of Tillsonburg an Agreement with the County of Oxford for the provision of planning advisory and administrative services. 2. That the Agreement as outlined in Schedule “A”, attached hereto, forms part of this By-law. 3. That all previous agreements and any amendments thereto that have been entered into between the Corporation of the Town of Tillsonburg and the County of Oxford relating to the provision of planning advisory and administrative services are hereby repealed. 4. Purpose: The purpose of this Agreement is to set out the general terms regarding Planning Advisory and Administrative Services to the Corporation of the Town of Tillsonburg pursuant to Section 15 of the Planning Act, R.S.O. 1990, as amended. B. Terms and Definitions: a) “County Clerk” shall mean the person duly appointed to hold the position of the Clerk of the County of Oxford, or his/her duly appointed delegate. b) “County Council” means the Council of the County of Oxford. c) “County Planning Office” means the Community and Strategic Planning Office of the County of Oxford, or other similarly constituted office or department of the County having the mandate and responsibility for reviewing matters related to land use planning under the Planning Act, R.S.O. 1990, as amended. d) “Director of Planning” means the person duly appointed to hold the position of the Director of Planning of the County Planning Office, or a person appointed by the Director as his/her delegate. e) “Local Area Council” means the Council of the Town of Tillsonburg. f) “Local Area Municipality” means The Corporation of the Town of Tillsonburg. g) “Municipal Clerk” means the person, duly appointed to hold the position of the Clerk of the Local Area Municipality, or his/her duly appointed delegate. h) “County of Oxford” or “County” means the County of Oxford. C. Development Review Services: The County Planning Office will provide professional planning advisory and administrative services to the Local Area Municipality as follows: 1. Provide information and advice to the general public, developers, agents, etc., municipal staff and other departments, boards and/or committees of the Local Area Municipality regarding land use planning matters within the Local Area Municipality. This may include attendance at meetings of said departments, boards and/or committees as may be necessary from time to time. 2. Maintain office hours in the Local Area Municipality to meet the needs of the municipality as is deemed by the Director of Planning, in consultation with the Local Area Municipality, to be appropriate and within the resources and capabilities of the County Planning Office. Where it is agreed that on-site service is appropriate, the Local Area Municipality shall be responsible for providing adequate work space for County Planning staff, to the satisfaction of the Director of Planning. 3. Serve as liaison between the Local Area Municipality and the County of Oxford’s Geographic Information Systems (GIS) Department with respect to matters pertaining to the collection and use of GIS and related data. 4. Assist and advise applicants and/or their agents regarding the completion and submission of applications for amendments to the Local Area Municipality’s Zoning By-law (including applications for Minor Variance) and applications for Site Plan Approval. 131 5. Undertake administrative activities and provide professional planning advisory services associated with development applications as follows: i) Zoning By-laws / Amendments a) Undertake pre-consultation with respect to applications as may be requested by an applicant/agent and/or the Local Area Municipality. b) Receive applications filed directly with the County Planning Office or with the Local Area Municipality and review same for completeness. The completeness of an application will be determined by the County Planning Office in accordance with the applicable policies of the Oxford County Official Plan and/or as prescribed in the Planning Act, R.S.O. 1990, as amended. The County Planning Office will issue the required notice(s) regarding the completeness of an application in accordance with the applicable provisions and regulations of the Planning Act and will, as necessary, contact the applicant to obtain such additional information as may be required to deem an application to be complete. The determination of the completeness of an application, or the information necessary for an application to be considered complete, will be at the discretion of the County Planning Office. c) Circulate applications to prescribed persons and public bodies and prepare and circulate public notices in accordance with the applicable provisions and regulations of the Planning Act, R.S.O. 1990, as amended, or in accordance with the relevant modified or alternative notification policies contained in the County Official Plan and where such modified or alternative provisions have been adopted by the Local Area Municipality. d) Prepare reports for presentation to the Local Area Council based on a detailed review of the application and related information. Such reports will provide the details of the application; the comments received from agency circulation and public consultation; an overview of the relevant Provincial and Official Plan policies and other planning considerations; and the County Planning Office’s professional planning opinion(s) and recommendation(s) with respect to the application. Reports will be provided to the Municipal Clerk prior to the Local Area Council meeting in a format suitable for publishing in the Local Area Council’s agenda. e) Prepare Zoning By-law amendments, including all text and schedules, for consideration by the Local Area Council, as required. f) Attend Local Area Council meetings for the purpose of presenting the planning report and professional planning opinion(s) and recommendation(s) of the County Planning Office with respect to the application. The County Planning Office will respond to all relevant questions of the Local Area Council, the public and any other interested stakeholders during the Local Area Council’s public meeting(s) at which the application is considered. g) The responsibilities of the Local Area Municipality regarding Zoning By-laws / Amendments are as follows: 1. The Local Area Municipality shall provide to the County Planning Office a mailing list of all neighbouring properties to be notified of a complete application and any public meetings related to a development application, as prescribed by the Planning Act, R.S.O. 1990, as amended and/or the alternative notification policies contained in the County Official Plan where such alternative policies have been adopted by the Local Area Municipality. 132 2. The Local Area Municipality shall provide to the County Planning Office, in a timely manner and as prescribed by the Planning Act, R.S. O. 1990, as amended, all documents related to the decision(s) of the Local Area Council in respect of a development application. ii) Minor Variance Applications a) Prepare reports for presentation to the Local Area Committee of Adjustment providing the details of the application, the comments received from agency and public circulation, the County Planning Office’s professional planning opinion(s) and recommendation(s) with respect to the application. Reports will be provided to the Municipal Clerk prior to the Local Area Committee of Adjustment meeting in a format suitable for publishing in the Local Area Municipality’s agenda. b) Attend Local Area Committee of Adjustment meetings for the purpose of presenting the planning report and related information and the professional planning opinion(s) and recommendation(s) of the County Planning Office. The County Planning Office will respond to all relevant questions of the Local Area Committee of Adjustment, the public and any other interested stakeholders during the Local Area Committee’s public meeting(s) at which the application is considered. iii) Site Plan Applications / Amendments a) Provide comments to the Local Area Municipality regarding applications for site plan approval or applications to amend an existing site plan approval and/or prepare reports for presentation to the Local Area Council, where requested. Where a report is prepared, said report will provide the details of the application; comments received from agency circulation; an overview of the relevant planning considerations; and the County Planning Office’s recommendation(s) with respect to the application. Reports will be provided to the Municipal Clerk prior to the Local Area Council meeting in a format suitable for publishing in the Local Area Council’s agenda. iv) Appeals a) Where a decision of the Local Area Council regarding a Zoning By-law / Amendment, Minor Variance or Site Plan Approval / Amendment application is appealed to the Ontario Municipal Board (OMB) or other body having jurisdiction to hear an appeal, the County Planning Office may, at the discretion of the Director of Planning, provide professional planning evidence at any hearing(s) convened with respect to the appeal. 6. Prepare planning reports for Local Area Council consideration with respect to applications for Official Plan amendment or Draft Plan of Subdivision or Condominium where the lands subject to such applications are located within the Local Area Municipality. Planning reports for the purposes of this Section will be prepared and presented to Local Area Council as per subsection 5 i) d). 7. Prepare planning reports for Local Area Council consideration with respect to applications for Consent where the lands subject to such applications are located within the Local Area Municipality and where the Local Area Municipality has requested such reports be prepared. Planning reports for the purposes of this Section will be prepared and presented to Local Area Council as per subsection 5 i) d). 8. Regularly consolidate the Local Area Municipality’s Zoning By-law, to reflect recent amendments and distribute said consolidations. 9. Prepare an annual year-end report of the development and other planning activities within the Local Area Municipality for the previous year. 133 D. Land Use Planning Related Studies and Projects: 1. The County Planning Office will provide professional planning advice, project management services and/or otherwise assist the Local Area Municipality in identifying and completing land use planning related studies and projects that are within the resources and capabilities of the County Planning Office. 2. The determination of what constitutes a land use planning related study or project and the ability and/or capacity of the County Planning Office to assist with such study or project, taking into consideration the Office’s resources and capabilities, will be at the discretion of the Director of Planning. 3. The costs associated with any land use planning related study or project undertaken by the County Planning Office will be shared between the Local Area Municipality and the County in a manner determined by the respective Councils to be appropriate for the scope of the study or project. E. Minor Variances Directly Related to Consent Applications: 1. The Local Area Council hereby transfers the administration and approval authority powers of the Local Area Council (as a “lower-tier municipality”) under Sections 44 and 45 of the Planning Act, R.S.O. 1990, as amended, to the County of Oxford for those applications for Minor Variance from the Local Area Municipality’s Zoning By-law that are directly related to any application for Consent submitted to the County under Section 53 of the Planning Act, R.S.O. 1990, as amended, subject to the following conditions: a) that the application is for Minor Variance from the provisions of the Local Area Municipality’s Zoning By-law that are deemed to be required as the direct result of the approval of an application filed with the County of Oxford for Consent pursuant to Section 53 of the Planning Act, R.S.O. 1990, as amended; b) the determination as to whether a Minor Variance is the direct result of the approval of an application for Consent will be at the discretion of the Director of Planning; c) the County of Oxford may delegate the approval authority for Minor Variances as described in a), above, to a duly appointed committee of the County of Oxford as constituted under Section 51.2 of the Planning Act, R.S.O. 1990, as amended. F. Fees: 1. The fee for professional and administrative staff services outlined in this agreement will be covered by the annual levy paid by the Local Area Municipality to the County of Oxford, or as determined otherwise by resolution of the respective Councils. 2. All disbursements incidental to the provision of the Local Area Municipality’s planning services by the County of Oxford, as outlined in this agreement, will be recorded separately and charged directly, at cost, to the Local Area Municipality. All such disbursements shall be invoiced and paid quarterly. 3. All fees collected by the County of Oxford on behalf of the Local Area Municipality (i.e. zoning by-law amendment application fees) will be remitted to the Local Area Municipality by the County of Oxford in a timely manner, as they are collected. G. Duration of Agreement: 1. This Agreement shall remain in force and effect until terminated by either party. 134 2. This Agreement may be terminated by either party upon thirty (30) days written notice to the County Clerk or the Municipal Clerk. H. Review: 1. The terms and conditions of this agreement shall be reviewed by the parties every five (5) years. The terms and conditions of this agreement are hereby accepted. WHEREAS The Town of Tillsonburg deems it necessary and expedient to enter into an Agreement with the County of Oxford for the purpose of establishing the roles and responsibilities for the construction and operation of a section of the Trans-Canada Trail (TCT); THEREFORE the Council of the Town of Tillsonburg enacts as follows: 1. THAT the Agreement attached hereto as Schedule “A” and forming part of this by- law between The Corporation of the Town of Tillsonburg and the County of Oxford is hereby approved; 2.
