4129 To abandon the Rolling Meadows Municipal Drain in its entirety within the limits of the Town
THE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER 4129 A BY-LAW to abandon the Rolling Meadows Municipal Drain in its entirety within the limits of the Corporation of the Town of Tillsonburg. WHEREAS pursuant to the provisions of Section 84 of the Drainage Act, R.S.O. 1990, c. d. 17 a Council may by by-law abandon the drainage works or part of the drainage works, and thereafter the Municipality has no further obligation with respect to the drainage works. AND WHEREAS The Corporation of the Town of Tillsonburg is of the opinion that abandonment of Rolling Meadows Municipal Drain as identified in Schedule A is desirable, pursuant to Section 84 (5) of the Drainage Act, R.S.O. 1990, as amended; AND WHEREAS The Corporation of the Town of Tillsonburg has complied with the notification requirements of Section 84 (1) of the Drainage Act, R.S.O. 1990, as amended and no objections to the proposed abandonment have been received; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF TILLSONBURG ENACTS AS FOLLOWS: 1. THAT the open ditch portion of the Rolling Meadows Municipal Drain be abandoned from the north limit of the abandoned CASO railway to North Street. 2. THAT the first section of closed drain comprised of an 825mm and 900mm diameter concrete pipe, located within the North Street right-of-way from Woodcock Drive to the north limit of the open drain be abandoned. This section is to remain in operation as a municipal storm sewer. All responsibility for the maintenance and repair and the cost of this work to be assumed by the County of Oxford. 3. THAT the second section of closed drain comprised of a 900mm diameter concrete pipe, located on Falcon Road, and on Tanager Drive from Falcon Road to Owl Drive be abandoned. This section is to remain in operation as a municipal storm sewer. All responsibility for the maintenance and repair and the cost of this work will be assumed by the Town of Tillsonburg. 4. This by-law shall come into full force and effect on the day of passing. READ A FIRST AND SECOND TIME THIS 21St DAY of August, 2017.
