Irene Hurley introduced Margret Fishback-Powers, author of "Footprints in the Sand," who is celebrating
the 50th anniversary of her poem.
Along with her husband Paul, Mrs. Fishback-Powers extended greetings to the community and read her
famous poem to Council.
Mayor Beres presented Mrs. Fish back-Powers with a 50th anniversary celebration plaque for the Margret
Fishback Museum in Tillsonburg.

Presented By: Robert Marsden, Chair, Heritage, Beautification and Cemetery Committee
Mr. Marsden was in attendance to speak in opposition of the proposed storage shed adjacent to
Lake Lisgar.
The Heritage, Beautification and Cemetery Committee oppose the proposed storage shed adjacent
to Lake Lisgar, specifically as noted in Report PRS 14-20 by the Director of Parks and Recreation
Services, to avoid precedent setting concerns.
Staff received Mr. Marsden's comments and noted that the project was being revisited and a report
will be brought back for Council consideration.
2. Cultural Advisory Committee
Application for funding 'Gathering of Harvard's and Hero's', 75th Anniversary of the North American

AMO Provincial Election Update: Ontario NDP Responds to AMO's Municipal Priorities
The Ontario New Democratic Party has responded to AMO President Russ Powers regarding municipal priorities and the NDP's
platform. A similar letter has been sent to Liberal and Progressive Conservative Party Leaders and members will be updated
when these are received and clarification provided.
NDP Municipal Commitments:
The NDP has committed to action on many Of the priorities that AMO sought clarification on. The party has provided a detailed
response to each of the items raised by AMO. Major commitments included in the response are summarized below. To read the
full document, please go to AMO's Provincial Election 2014 web page and select the AMO NDP Response.
Provincial-• Wdl support and maintain the Memorandum of Understanding (MOU) process and work with
Municipal municipalities to consider fairer representation for their Interests.
Relationship
Municipal Finance • Upload: maintain the agreed upload schedule of social seNices and court security costs and
additional $2 million per year funding to municipalities to protect tenants and enforce building
maintenance rules
• OMPF: the NDP will work with municipalities to ensure the right level of funding is provided
• OPP Billing: The NDP would consult widely with municipalities and examine all funding
options to come up with an effective solution to help municipalities with policing costs
• POA-the NDP supported Bill 34 and will take steps to Implement changes to assist
municipalities In collecting unpaid fines
• Joint and several Liability -the NDP supports changes to the joint and several liability
framework that can place an undue burden on municipalities
• Development Charges-the NDP Is committed to a review of the Development Charges Act
working with stakeholders and would start by removing the discounts related to recreation,
libraries, old age homes, child care, health departments, and ambulance stations
Municipal • Transit and Transportation -the NDP will reinstate the Ontario Bus Replacement Program;
Infrastructure maintain a dedicated $29 billion fund over 10 years for transit and transportation Investment
across the province and prioritize high impact transit projects with an additional $250 million
Investment annually. Will also make Investments in bike lanes, expand cycling infrastructure
networks and support complete street design with an additional $5 million annually.
• Small, Rural and Northern Municipal Infrastructure Fund -the NDP will proceed with this
funding for ~rltical road, bridge, water, and wastewater projects and projects Identified as
priorities In municipal asset management plans
Municipal Labour • Interest Arbitration -they recognize emerging difficulties for municipalities and are open to
Matters working with stakeholders to consider options to reform the arbitration system
Municipal • The NDP is open to considering new, streamlined processes for municipal reporting

Mattets • Ombudsman -the NDP will consult and work with municipalities if they make any changes
involving municipalities in the Ontario Ombudsman's oversight

Dear Mayor Beres,
AMO delivers the federal Gas Tax Fund to 443 Ontario municipalities. A small portion of
the Fund is set aside to fulfil our role as Fund Administrator and cover our costs.
Through our efficient and innovate delivery model, our costs are less than expected. As
a result, we are distributing the unused administrative funds back to municipalities to
invest in infrastructure.
Town ofTillsonburg will receive $12,147.13 in surplus administrative funds in 2014.
Your municipality can expect a cheque by the end of June. Payments are being made
on a per capita basis using populations from the 2006 Census and funds are subject to
the terms and conditions of the federal Gas Tax Fund . These funds are in addition to
your regular federal Gas Tax Fund payment, the first of which is scheduled to be
distributed in July.
AMO delivers more than half a billion dollars per year of federal Gas Tax Funds at a
cost of less than 0.5% of program allocation. We try to ensure that as much of the Fund
as possible goes toward building and revitalizing local infrastructure. Ontario
municipalities are the only ones to receive additional Gas Tax funds in 2014. AMO is a
national leader in the delivery of the Fund and we're proud of it.
We encourage you to share the benefits of the federal Gas Tax Fund in your community
with residents, businesses, Members of Parliament and the media. For more

AMO Provincial Election Update -Latest on the Key Municipal Priorities
The major parties have each provided information as it relates to your key municipal priorities.
The Municipal Priorities Chart is now complete based on the platforms, correspondence, and
meeting notes with senior staff. Take a few minutes and review this information on AMO's
Provincial Election 2014 web page so that you are informed about how municipal priorities will
or will not be considered.
All parties have affirmed each would honour the Memorandum of Understanding (MOU)
between the Ontario Government and AMO. The MOU requires pre-consultation with AMO on
proposed provincial legislation and programs that impact municipal governments.
AMO will be monitoring the Leaders' Debate tonight and will update members on any new
announcements or commitments relating to municipal governments and their roles and
responsibilities over the course of the rest of the campaign.

BY-LAW 3832, TO ESTABLISH REDUCED VOTING HOURS
THAT Council receives Report CL 14-20, Polling Hours at Retirement Homes and Hospitals;
AND THAT By-law 3832, to establish reduced voting hours for the 2014 Municipal Election, be brought
forward for Council consideration.
EXECUTIVE SUMMARY
To establish reduced voting hours at various locations within Tillsonburg to allow the elderly and
individuals in institutions that are unable to attend the regular voting location on election day the
opportunity to vote.
BACKGROUND
The Municipal Elections Act, 1996, Section 45 requires municipalities to provide a voting place on voting
day at institutions and retirement homes. Section 46(3) allows municipalities to pass a by-law stating the
voting place is for the use of the residents of the institution or the retirement home and shall set out the
reduced voting hours at each location.
The locations and voting hours set out in the by-law have been followed for the past two municipal
elections and have proven to be effective in allowing citizens at all locations ample time to cast their
vote. Staff have confirmed with each location regarding available space and times.

Voting places in institutions, retirement homes
45. .(1} On voting day, a voting place shall be provided on the premises of the
following:
1. An institution for the reception, treatment or vocational training of members or
former members of the Canadian Forces.
2. An institution in which, on nomination day, 20 or more beds are occupied by
persons who are disabled, chronically ill or infirm.
3. A retirement home in which, on nomination day, 50 or more beds are occupied.

Attendance on resident
00 The deputy returning officer for a voting place described in subsection (7) may
attend on an elector who is a resident of the institution or retirement home, to allow him
or her to vote. 1996, c. 32, Sched., s. 45 (8).
Attendance on electors with disabilities
.(2) To allow an elector with a disability to vote, a deputy returning officer shall
attend on the elector anywhere within the area designated as the voting place. 2001, c. 32,
s. 30 (3).
Other persons
.(lQ} The other persons described in subsection 47 (1) are entitled to accompany a
deputy returning officer when he or she attends on an elector under subsection (8) or (9).

BEING A BY-LAW to establish reduced voting hours for the 2014 Municipal Election.
WHEREAS Section 46.(2) of the Municipal Elections Act, S.O. 1996 provides that a municipal
council may pass a by-law providing that specified voting places shall be open on voting day at
a specified time before 10:00 a.m;
AND WHEREAS Section 46.(3) of the Act provides that a municipal council may pass a by-law
with respect to reduced voting hours in voting places in retirement homes or those institutions
as defined in Section 45.(7) of the Act, where the voting place is only for the residents;
THEREFORE on Monday, October 27, 2014 the following locations will have reduced voting hours:

EXECUTIVE SUMMARY
The purpose of this report is to provide information regarding the proposed changes to municipal rates
and fees By-law.
Council will recall that on April 28, 2014, they passed By-law 3798 to Regulate Signs and Other
Advertising Devices of a Commercial Nature in the Town of Tillsonburg. This By-law was the result of
Report DCS 14-09 Sign By-law (February 27, 2014), Report DCS 14-14 Sign By-law (April 14, 2014) and
Report DCS 14-25 Sign By-law (April 28, 2014), which recommended the implementation of new
regulations and fees on the use of temporary mobile signs of a commercial nature within the Town of
Tillsonburg.
The additions to the rates & fees pertaining to By-Law 3798 are set out below.
Parks & Recreation Services had a few additions to their rates and fees as indicated below:
COMMUNITY CENTRE
If a program is cancelled less than 24hours due to insufficient registrations, a 30% discount will apply on
a future registration.
Multi Advertising opportunities-promotional rates, A 2nd advertisement receives 10% off of both ads, a
3rd ad receives 20% off all 3 and a 4th ad receives 30% off the total for all4.
MUSEUM
Active volunteers receive free admission to the museum. This applies only to the volunteer not their
family and/or guests.
By-law 3833 reflects the additional rates and fees as indicated above.
FINANCIAL IMPACT/FUNDING SOURCE
The increase in revenues for the permanent signs will be approximately $400.00 per year and the
variance fees where there were no fees prior to the by-law will be approximately $1,000.00 per year.
There was no fee for sign removal in the past therefore there is no data available to provide a revenue
estimate.
The Community Centre discount fees are added for incentives and are intended to create increased
revenue and participation; however there are no benchmarks to determine impact at this point.

WHEREAS it is necessary and expedient to establish a Schedule of Fees for certain Municipal
applications, services and permits;
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF
TILLSONBURG ENACTS AS FOLLOWS:
1. THAT Schedule "A" to this By-Law is adopted as the Schedule of Fees for certain Municipal
applications, services and permits listed therein.
2. Should the provisions of any other By-Law of the Town of Tillson burg or other documents
purporting to set the Fees listed in Schedule "A" be in conflict with the provisions of this By-
Law, the provisions of this By-Law shall prevail.
3. That Schedule "A" to this By-Law forms part of this By-Law as if written herein.
4. This By-Law shall come into full force and effect on the day of its passing.

EXECUTIVE SUMMARY
Electrical service at the airport is provided through Hydro One Networks Inc who has
previously installed three transformers and related electrical infrastructure. These
transformers are used to supply electricity to the Airport Terminal building and both the
commercial and private hangars. These transformers provide a number of connections for
tenants and all of the connections have been allocated. Hence, a new transformer is
required to support the growth and expansion of the airport through new hangar
construction.
As Council is aware, the construction of new hangars drives revenue at the airport through
both land lease and fuel fees and the new transformer will enable up to eight additional
hangars to be constructed. Increased revenue supports the Corporation's goal of
decreasing the net levy requirement for Airport operations.

EXECUTIVE SUMMARY
Staff provided report DCS 14-29 Airport Transformer to Council on May 26, 2014 regarding
the installation of a new transformer to support the addition of up to 8 new hangars at the
Airport. At that meeting, Council requested information as to whether or not the work
could be completed by Tillsonburg Hydro Inc. Staff have reviewed the work with
Tillsonburg Hydro Inc and have determined that Harry's Electric Inc is able to complete the
work at a lower cost.

BACKGROUND
At the Council meeting of May 26, 2014, Staff reported that there was an issue with the
Town's phones that had been identified by IT: the phones are not compatible with the
Town's new switches. The Town's current phones are at least 10 years old. County IT
explored options and recommended that new phones be purchased. Competitive quotes
were obtained and the supplier that was chosen is Unity Telecom, the Town's current
phone service provider. The cost for 50 phones is $14,655.52 plus net HST. Staff is
recommending that $15,000 be transferred from the IT operating surplus resulting from
Microsoft licensing costs to a new IT phone capital project. Not doing this new capital
project in 2014 is not an option since installing new switches is the first key step in
implementing new IT infrastructure in the upcoming months.

Development Charges Public Meeting on May 26, 2014.
CONSULTATION/COMMUNICATION
At the Development Charges Public Meeting, May 26, 2014, Council asked for a follow up
report from Hemson Consulting on questions asked at that meeting. Hemson Consulting
has prepared the attached memorandum for Council consideration.
In addition, under section 12(3) of the Development Charges Act, there is a requirement
that if a proposed by-law is changed following a public meeting, that Council shall
determine whether a further meeting is necessary. The Town's proposed by-law is
minimally changing for wording pertaining to the definition of temporary dwelling unit. It
is Hemson Consulting and Staff's recommendation that a further public meeting is not
required.
With respect to the County's wording of Redevelopment and Development Charges, see
Appendix C attached, the County Director of Corporate Services has confirmed that if the
County's wording were in place when the 157 Tillson Ave property acquired a building
permit, this property would be exempt from Development Charges considering the original
building was constructed prior to September 1, 1999.

Response to Issues Raised at Development Charges Public Meeting
This memorandum summarizes my responses to issues raised at a public meeting held
on May 26, 2014 at Tillsonburg Council Chambers. The public meeting was held
pursuant to section 12 of the Development Charges Act (DCA) and followed the
release of the Town's Development Charges Background Study, May 2014 (the DC
Study) and draft development charge by-law (the By-Law).
A. POPULATION FORECASTS FOR THE TOWN OF TILLSONBURG
The DCA requires the Town to estimate "the anticipated amount, type and location
of development" for which development charges may be imposed. The development
forecast must cover both residential and non-residential development and be specific
enough with regards to quantum, type, location and timing of development to allow
the Town to prepare a reasonable development-related capital program. A ten-year
development forecast, from 2014 to 2023, has been used for all the development
charge eligible services in the Town, except for the Roads and Related and
Stormwater services which are based on a horizon extending from 2014 to 2031.
The forecasts of population, households and employment are based on the
Tillsonburg forecasts in the Oxford County Population, Households and Employment
Forecasts and Employment Lands Study dated March 5, 2014. These forecasts were

B. ON THE NEED FOR A PARKING CHARGE
The Town currently own and operates 1,771 parking spaces. The DC Study assumes
that it is Council's intent to provide the equivalent of about 50 additional spaces to
meet the demand for parking arising from the additional 999 persons and 820 jobs
forecast for the Town over the next 10 years.
It is noted that the Town would need to provide about 117 parking spaces in order to
maintain historical average levels of service by the end of the 10 year period.
Council may impose any Parking charge it wishes up to the maximum charge set out
in the DC Study ($233 per single or semi~detached unit), or no charge at all.
However, should a lower~than~maximum charge be imposed and Council approve
capital expenditures for new parking in the next 5 years, these expenditures would
have to be funded from non~development charge sources (almost certainly property
taxes).
C. REDEVELOPMENT AND DEVELOPMENT CHARGES
Municipalities are required by the DCA to develop rules to determine when a
development charge is payable on land that is being redeveloped. It is current
practice among municipalities to provide a development charge credit to
development if it involves the redevelopment of existing buildings.
Section 11 of the Town's draft DC By~Law provides a credit equivalent to the
development charges that would have been paid on a previous residential building:
• where a building permit for redevelopment has been issued within 5 years of
demolition of the previous building; and
• where the redevelopment involves the replacement or conversion of an
existing building from one use to another

11 . If a development involves the demolition of and replacemen~ of all or part of a building or
structure, or the conversion from one principal use to another:_
{1} a credit shall be allowed, provided that the land was improved by
occupied structures, or structures capable of being occupied
without structural improvement, within the five years prior to the
issuance of the building permit, and the building permit has been
issued for the development within five years from the date the
demolition permit has been issued; and
{2} subject to section 12 a credit shall be allowed equivalent to:
(a) the number of residential dwelling units
demolished/converted multiplied by the applicable
residential development charge in place at the time the
development charge is payable, and/or
(b) the gross floor area of the non-residential building
demolished/converted multiplied by the non-residential
development charge in place at the time the development
charge is payable.
12. A credit can, in no case, exceed the amount of the development charge
that would otherwise be payable. No credit is available if the use for which
the demolished/converted buildings or structures was last lawfully occupied
is exempt under this by-law, unless such demolished/converted buildings or.
structures were constructed prior to September l 5r, 1999 and are not farm
buildings, as defined herein.

A by-law to establish development charges for
the Corporation of the Town of Tillsonburg
WHEREAS subsection 2(1) of the Development Charges Act, 1997 c. 27 (hereinafter called "the
Act") provides that the council of a municipality may pass By-laws for the imposition of
development charges against land for increased capital costs required because of the need for
services arising from development in the area to which the by-law applies;
AND WHEREAS the Council of The Corporation of the Town of Tillsonburg ("Town of
Tillsonburg") has given Notice in accordance with Section 12 of the Development
Charges Act, 7997, of its intention to pass a by-law under Section 2 of the said Act;
AND WHEREAS the Council of the Town of Tillsonburg has heard all persons who applied to be
heard no matter whether in objection to, or in support of, the development charge proposal at a
public meeting held on May 26, 2014;
AND WHEREAS the Council of the Town of Tillsonburg had before it a report entitled
Development Charges Background Study dated May 2014 prepared by HEMSON Consulting Ltd.,
wherein it is indicated that the development of any land within the Town of Tillsonburg will
increase the need for services as defined herein;
AND WHEREAS the Council of the Town of Tillson burg on May 26, 2014 approved the applicable
Development Charges Background Study, dated May 2014, in which certain recommendations
were made relating to the establishment of a development charge policy for the Town of
Tillson burg pursuant to the Development Charges Act, 1997.
NOW THEREFORE THE COUNCIL OF THE TOWN OF TILLSONBURG ENACTS AS
FOLLOWS:
DEFINITIONS
1. In this by-law,
1) "Act: means the Development Charges Act, 1997, c.27;
2) "Apartment dwelling" means any dwelling unit within a building
containing more than four dwelling units where the units are connected
by an interior corridor;
3) "Affordable housing" means dwelling units and incidental facilities
primarily for person(s) of low and moderate income that meet the
8) "Council" means the Council of the Corporation of the Town of
Tillson burg;
9) "Development means any activity or proposed activity in respect of land
that requires one or more of the actions referred to in section 7 of this
by-law and including the redevelopment of land or the redevelopment,
expansion, extension or alteration of a use, bu9iolding or structure
except interior alterations to an existing building or structure which do
not change or intensify the use of land;
1 0) "Development charge" means a charge imposed pursuant to this By-law;
11) "Dwelling unit" means a room or suite of rooms used, or designed or
intended for use by, one person or persons living together, in which
culinary and sanitary facilities are provided for the exclusive use of such
person or persons;
12) "Grade" means the average level of finished ground adjoining a building
or structure at all exterior walls;
13) "Local board" means a public utility commission, public library board,
local board of health, or any other board, commission, committee or
body or local authority established or exercising any power or authority
under any general or special Act with respect to any of the affairs or
purposes of the municipality or any part or parts thereof;
14) "Local services" means those services or facilities which are under the
jurisdiction of the municipality and are related to a plan of subdivision or
within the area to which the plan relates, required as a condition of
approval under s.51 of the Planning Act, or as a condition of approval
under s.53 of the Planning Act]
15) "Multiple dwelling" means all dwellings other than single detached
dwellings, semi-detached dwellings, and apartment dwellings;
16) "Municipality" means The Corporation of the Town of Tillson burg;
17) "Non-residential uses" means a building or structure used for other than
a residential use;
18) "Official plan" means the Official Plan of the County of Oxford and any
amendments thereto;
19) "Owner" means the owner of land or a person who has made application
for an approval for the development of land upon which a development
charge is imposed;
CALCULATION OF DEVELOPMENT CHARGES
2.
1) Subject to the provisions of this By-law, development charges against
land in the municipality shall be imposed, calculated and collected in
accordance with the base rates set out in Schedule "B", which relate to
the services set out in Schedule "A".
2) The development charge with respect to the use of any land, buildings or
structures shall be calculated, in the case of residential development or
redevelopment, or a residential portion of a mixed-use development or
redevelopment, based upon the number and type of dwelling units.
3) Council hereby determines that the development or redevelopment of
land, buildings or structures for residential uses will require the provision,
enlargement or expansion of the services referenced in Schedule "A".
PHASE IN OF DEVELOPMENT CHARGES
3. The development charges imposed pursuant to this by-law are being phased in
according to the schedule set out in Schedule B.
APPLICABLE LANDS
4.
1) Subject to Section 4, this by-law applies to all lands in the municipality,
whether or not the land or use is exempt from taxation under Section 3
of the Assessment Act, R.S.O. 1990, c.A.31
2) This by-law shall not apply to land that is owned by and used for the
purposes of:
a) a board of education;
b) any municipality or local board thereof;
c) a place of worship exempt from taxation under s.3 of the
Assessment Act;
d) a public hospital under the Public Hospitals Act;
e) a non-residential farm building;
f) temporary buildings or structures as defined herein;
g) affordable housing as defined herein.
2) This by-law shall not apply to non-residential uses as defined herein.
3) This by-law shall not apply to lands designated as "Central Business
District" and Entrepreneurial District" in the County of Oxford Official
Plan, Schedule T-1, attached here as Schedule "C".
v. a consent under Section 53 of the Planning Act, R.S.O.
1990, c.P. 13;
vi. the approval of a description under Section 50 of the
Condominium Act, R.S.O. 1980, c.84; or
vii. the issuing of a permit under the Building Code Act, in
relation to a building or structure.
2) Subsection (1) shall not apply in respect to
a) local services installed or paid for by the owner within a plan of
subdivision or within the area to which the plan relates, as a
condition of approval under Section 51 of the Planning Act, R.S.O.
1990, c.P. 13;
b) local services installed or paid for by the owner as a condition of
approval under Section 53 of the Planning Act, R.S.O. 1990, c.P.
13.
LOCAL SERVICE INSTALLATION
7. Nothing in this by-law prevents Council from requiring, as a condition of an
agreement under section 51 or 53 of the Planning Act, that the owner, at his or
her own expense, shall install or pay for such local services, within the Plan of
Subdivision or within the area to which the plan relates, as Council may
require.
MULTIPLE CHARGES
8.
1) Where two or more of the actions described in subsection 5(1) are
required before land to which a development charge applies can be
developed, only one development charge shall be calculated and
collected in accordance with the provisions of this by-law.
2) Notwithstanding subsection (1 ), if two or more of the actions described in
subsection 5(1) occur at different times, and if the subsequent action has
the effect of increasing the need for municipal services as set out in
Schedule "A", an additional development charge on the additional
residential units shall be calculated and collected in accordance with the
provisions of this by-law.
SERVICES IN LIEU
9.
1) Council may authorize an owner, through an agreement under Section
38 of the Act, to substitute such part of the development charge
applicable to the owner's development as may be specified in the
agreement, by the provision at the sole expense of the owner, of
services in lieu. Such agreement shall further specify that where the
owner provides services in lieu in accordance with the agreement,
and defined by various references in the Development Charges Act, on
the date that the first building permit is issued in related to a building or
structure on land to which a development charge applies.
2) Where development charges apply to land in related to which a building
permit is required, the building permit shall not be issued until the
development charge has been paid in full.
RESERVE FUNDS
14.
1) Monies received from payment of development charges under this bylaw
shall be maintained in two separate reserve funds as follows: non-
discounted services of fire services, police services and roadways; and
discounted services of general government, library, recreation and public
works.
2) Monies received for the payment of development charges shall be used
only in accordance with the provisions of Section 35 of the Act.
3) Council directs the Municipal Treasurer to divide the reserve funds
created hereunder into separate sub accounts in accordance with the
service sub-categories set out in Schedule "A" to which the development
charge payments shall be credited in accordance with the amounts
shown, plus interest earned thereon.
4) Where any development charge, or part thereof, remains unpaid after
the due date, the amount unpaid shall be added to the tax roll and shall
be collected as taxes.
5) Where any unpaid development charges are collected as taxes under
subsection (4), the monies so collected shall be credited to the
development charge reserve funds referred to in subsection (1 ).
6) The Treasurer of the Municipality hall, in each year commencing in 2015
for the 2014 year, furnish to Council a statement in respect of the
reserve funds established hereunder for the prior year, containing the
information set out in Section 12 of O.Reg. 82/98.
BY -LAW AMENDMENT OR APPEAL
15.
1) Where this by-law or any development charge prescribed thereunder is
amended or repealed either by order of the Ontario Municipal Board or
by resolution of the Municipal Council, the Municipal Treasurer shall
calculate forthwith the amount of any overpayment to be refunded as a
result of said amendment or repeal.
DATE BY -LAW EFFECTIVE
22. This by-law shall come into force and effect on June 23, 2014.
SHORT TITLE
23. This by-law may be cited as the "Town of Tillsonburg Development Charges
By-law, 2014".

LOCAL SERVICE INSTALLATION
7. Nothing in this by-law prevents Council from requiring, as a condition of an
agreement under section 51 or 53 of the Planning Act, that the owner, at his or
her own expense, shall install or pay for such local services, within the Plan of
Subdivision or within the area to which the plan relates, as Council may
require.
MULTIPLE CHARGES
8.
1) Where two or more of the actions described in subsection 5(1) are
required before land to which a development charge applies can be
developed, only one development charge shall be calculated and
collected in accordance with the provisions of this by-law.
2) Notwithstanding subsection (1 ), if two or more of the actions described in
subsection 5(1) occur at different times, and if the subsequent action has
the effect of increasing the need for municipal services as set out in
Schedule "A", an additional development charge on the additional
residential units shall be calculated and collected in accordance with the
provisions of this by-law.
SERVICES IN LIEU
9.
1) Council may authorize an owner, through an agreement under Section
38 of the Act, to substitute such part of the development charge
applicable to the owner's development as may be specified in the
agreement, by the provision at the sole expense of the owner, of
services in lieu. Such agreement shall further specify that where the
owner provides services in lieu in accordance with the agreement,
and defined by various references in the Development Charges Act, on
the date that the first building permit is issued in related to a building or
structure on land to which a development charge applies.
2) Where development charges apply to land in related to which a building
permit is required, the building permit shall not be issued until the
development charge has been paid in full.
RESERVE FUNDS
14.
1) Monies received from payment of development charges under this bylaw
shall be maintained in two separate reserve funds as follows: non-
discounted services of fire services, police services and roadways; and
discounted services of general government, library, recreation and public
works.
2) Monies received for the payment of development charges shall be used
only in accordance with the provisions of Section 35 of the Act.
3) Council directs the Municipal Treasurer to divide the reserve funds
created hereunder into separate sub accounts in accordance with the
service sub-categories set out in Schedule "A" to which the development
charge payments shall be credited in accordance with the amounts
shown, plus interest earned thereon.
4) Where any development charge, or part thereof, remains unpaid after
the due date, the amount unpaid shall be added to the tax roll and shall
be collected as taxes.
5) Where any unpaid development charges are collected as taxes under
subsection (4), the monies so collected shall be credited to the
development charge reserve funds referred to in subsection (1 ).
6) The Treasurer of the Municipality hall, in each year commencing in 2015
for the 2014 year, furnish to Council a statement in respect of the
reserve funds established hereunder for the prior year, containing the
information set out in Section 12 of O.Reg. 82/98.
BY -LAW AMENDMENT OR APPEAL
15.
1) Where this by-law or any development charge prescribed thereunder is
amended or repealed either by order of the Ontario Municipal Board or
by resolution of the Municipal Council, the Municipal Treasurer shall
calculate forthwith the amount of any overpayment to be refunded as a
result of said amendment or repeal.
DATE BY-LAW EFFECTIVE
22. This by-law shall come into force and effect on June 23, 2014.
SHORT TITLE
23. This by-law may be cited as the "Town of Tillsonburg Development Charges

AND THAT Tender T2014-004 be awarded to Birnam Excavation Ltd. of Watford,
Ontario at a cost of $594,089.31 (HST Included).
AND THAT the placement of surface asphalt on Thistle Court be delayed until 2015 to
align with the placement of surface asphalt on Ridge Boulevard.
EXECUTIVE SUMMARY
Tenders were called for the reconstruction of the Ridge Boulevard Area with eleven (11)
plan takers and a total of seven (7) bids received on May 22nd, 2014 with the lowest bid
from Birnam Excavation Ltd. of Warwick Township, Ontario of $534,995.82 (Net HST
Included).
COMMENTS
The project includes the reconstruction of Ridge Boulevard from Goldenrod Drive to
Woodhaven Boulevard including the installation of new storm sewers, curb and gutter,
asphalt roadway and boulevards as well as County of Oxford funded water main
replacement.
The project was added to the 2014 budget at the April 14th 2014 Council meeting at a cost
of $602,520 which includes County water main funding of $230,552, and Town funding of
$371,968. Top lift asphalt is planned for 2015.

EXECUTIVE SUMMARY
An RFQ was issued for production of the Recreation Guide. The RFQ was advertised
using approved procurement procedures and closed on May 30th, 2014. Seven bids
were received. Staff recommend production of the guide be awarded to Sun Media
from Tillsonburg as per their quoted pricing.
BACKGROUND INFORMATION
The Parks and Recreation Services Department produces a Recreation Guide a
minimum of twice per year. Choosing a multi-year Term of Service for the
procurement process allows the Department to establish budget costs for
production for several years.
PRS staff recommends moving to three Guides per year as part of improving
marketing of program information to the community and increasing customer
service. Currently 9,000 Recreation Guides are delivered to the community through
our local newspaper. Advertising revenue will increase with the additional edition
per year. The recent departmental restructuring established a staff role with the
responsibility of producing the Guide 3x per year and increasing advertising sales.
Guides will be published in March, August & December.
The results of the RFQ process are summarized in the table below with additional
information in the attached file. Prices listed do not include HST.

A by-law to establish development charges for
the Corporation of the Town of Tillsonburg
WHEREAS subsection 2(1) of the Development Charges Act, 1997 c. 27 (hereinafter called "the
Act") provides that the council of a municipality may pass By-laws for the imposition of
development charges against land for increased capital costs required because of the need for
services arising from development in the area to which the by-law applies; .
AND WHEREAS the Council of The Corporation of the Town of Tillsonburg ("Town of
Tillsonburg") has given Notice in accordance with Section 12 of the Development
Charges Act, 7997, of its intention to pass a by-law under Section 2 of the said Act;
AND WHEREAS the Council of the Town of Tillsonburg has heard all persons who applied to be
heard no matter whether in objection to, or in support of, the development charge proposal at a
public meeting held on May 26, 2014;
AND WHEREAS the Council of the Town of Tillsonburg had before it a report entitled
Development Charges Background Study dated May 2014 prepared by HEMSON Consulting Ltd.,
wherein it is indicated that the development of any land within the Town of Tillsonburg will
increase the need for services as defined herein;
AND WHEREAS the Council of the Town of Tillsonburg on May 26, 2014 approved the applicable
Development Charges Background Study, dated May 2014, in which certain recommendations
were made relating to the establishment of a development charge policy for the Town of
Tillson burg pursuant to the Development Charges Act, 1997.
NOW THEREFORE THE COUNCIL OF THE TOWN OF TILLSONBURG ENACTS AS
FOLLOWS:
DEFINITIONS
1. In this by-law,
1) "Act: means the Development Charges Act, 1997, c.27;
2) "Apartment dwelling" means any dwelling unit within a building
containing more than four dwelling units where the units are connected
by an interior corridor;
3) "Affordable housing" means dwelling units and incidental facilities
primarily for person(s) of low and moderate income that meet the
8) "Council" means the Council of the Corporation of the Town of
Tillson burg;
9) "Development means any activity or proposed activity in respect of land
that requires one or more of the actions referred to in section 7 of this
by-law and including the redevelopment of land or the redevelopment,
expansion, extension or alteration of a use, bu9iolding or structure
except interior alterations to .an existing building or structure which do
not change or intensify the use of land;
1 0) "Development charge" means a charge imposed pursuant to this By-law;
11) "Dwelling unit" means a room or suite of rooms used, or designed or
intended for use by, one person or persons living together, in which
culinary and sanitary facilities are provided for the exclusive use of such
person or persons;
12) "Grade" means the average level of finished ground adjoining a building
or structure at all exterior walls;
13) "Local board" means a public utility commission, public library board,
local board of health, or any other board, commission, committee or
body or local authority established or exercising any power or authority
under any general or special Act with respect to any of the affairs or
purposes of the municipality or any part or parts thereof;
14) "Local services" means those services or facilities which are under the
jurisdiction of the municipality and are related to a plan of subdivision or
within the area to which the plan relates, required as a condition of
approval under s.51 of the Planning Act, or as a condition of approval
under s.53 of the Planning Act]
15) "Multiple dwelling" means all dwellings other than single detached
dwellings, semi-detached dwellings, and apartment dwellings;
16) "Municipality" means The Corporation of the Town of Tillson burg;
17) "Non-residential uses" means a building or structure used for other than
a residential use;
18) "Official plan" means the Official Plan of the County of Oxford and any
amendments thereto;
19) "Owner" means the owner of land or a person who has made application
for an approval for the development of land upon which a development
charge is imposed;
CALCULATION OF DEVELOPMENT CHARGES
2.
1) Subject to the provisions of this By-law, development charges against
land in the municipality shall be imposed, calculated and collected in
accordance with the base rates set out in Schedule "B", which relate to
the services set out in Schedule "A".
2) The development charge with respect to the use of any land, buildings or
structures shall be calculated, in the case of residential development or
redevelopment, or a residential portion of a mixed-use development or
redevelopment, based upon the number and type of dwelling units.
3) Council hereby determines that the development or redevelopment of
land, buildings or structures for residential uses will require the provision,
enlargement or expansion of the services referenced in Schedule "A".
PHASE IN OF DEVELOPMENT CHARGES
3. The development charges imposed pursuant to this by-law are being phased in
according to the schedule set out in Schedule B.
APPLICABLE LANDS
4.
1) Subject to Section 4, this by-law applies to all lands in the municipality,
whether or not the land or use is exempt from taxation under Section 3
of the Assessment Act, R.S.O. 1990, c.A.31
2) This by-law shall not apply to land that is owned by and used for the
purposes of:
a) a board of education;
b) any municipality or local board thereof;
c) a place of worship exempt from taxation under s.3 of the
Assessment Act;
d) a public hospital under the Public Hospitals Act;
e) a non-residential farm building;
f) temporary buildings or structures as defined herein;
g) affordable housing as defined herein.
2) This by-law shall not apply to non-residential uses as defined herein.
3) This by-law shall not apply to lands designated as "Community
Improvement Areas" in the County of Oxford Official Plan, Schedule T-
1, attached here as Schedule "C".
v. a consent under Section 53 of the Planning Act, R.S.O.
1990, c.P. 13;
vi. the approval of a description under Section 50 of the
Condominium Act, R.S.O. 1980, c.84; or
vii. the issuing of a permit under the Building Code Act, in
relation to a building or structure.
2) Subsection (1) shall not apply in respect to
a) local services installed or paid for by the owner within a plan of
subdivision or within the area to which the plan relates, as a
condition of approval under Section 51 of the Planning Act, R.S.O.
1990, c.P. 13;
b) local services installed or paid for by the owner as a condition of
approval under Section 53 of the Planning Act, R.S.O. 1990, c.P.

BEING A BY-LAW to adopt a Schedule of Fees for certain Municipal applications, services and
permits and to repeal By-law 3687.
WHEREAS it is necessary and expedient to establish a Schedule of Fees for certain Municipal
applications, services and permits;
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF
TILLSONBURG ENACTS AS FOLLOWS:
1. THAT Schedule "A" to this By-Law is adopted as the Schedule of Fees for certain Municipal
applications, services and permits listed therein.
2. Should the provisions of any other By-Law of the Town of Tillson burg or other documents
purporting to set the Fees listed in Schedule "A" be in conflict with the provisions of this By-
Law, the provisions of this By-Law shall prevail.
3. That Schedule "A" to this By-Law forms part of this By-Law as if written herein.
4. This By-Law shall come into full force and effect on the day of its passing.
5. That By-Law 3687 passed on the 28th day of January, 2013, shall be hereby repealed.

AMO Provincial Election Update -Latest on the Key Municipal Priorities
The major parties have each provided information as it relates to your key municipal priorities.
The Municipal Priorities Chart is now complete based on the platforms, correspondence, and
meeting notes with senior staff. Take a few minutes and review this information on AMO's
Provincial Election 2014 web page so that you are informed about how municipal priorities will
or will not be considered.
All parties have affirmed each would honour the Memorandum of Understanding (MOU)
between the Ontario Government and AMO. The MOU requires pre-consultation with AMO on
proposed provincial legislation and programs that impact municipal governments.
AMO will be monitoring the Leaders' Debate tonight and will update members on any new
announcements or commitments relating to municipal governments and their roles and
responsibilities over the course of the rest of the campaign.

AMO Provincial Election Update: Ontario NDP Responds to AMO's Municipal Priorities
The Ontario New Democratic Party has responded to AMO President Russ Powers regarding municipal priorities and the NDP's
platform. A similar letter has been sent to Liberal and Progressive Conservative Party Leaders and members will be updated
when these are received and clarification provided.
NDP Municipal Commitments:
The NDP has committed to action on many of the priorities that AMO sought clarification on. The party has provided a detailed

• OPP Billing: The NDP would consult widely with municipalities and examine all funding
options to come up with an effective solution to help municipalities with policing costs
• POA -the NDP supported Bill 34 and will take steps to implement changes to assist
municipalities in collecting unpaid fines
• Joint and Several Liability-the NDP supports changes to the joint and several liability
framework that can place an undue burden on municipalities
• Development Charges -the NDP is committed to a review of the Development Charges Act
working with stakeholders and would start by removing the discounts related to recreation,
libraries, old age homes, child care, health departments, and ambulance stations
Municipal • Transit and Transportation-the NDP will reinstate the Ontario Bus Replacement Program;
Infrastructure maintain a dedicated $29 billion fund over 10 years for transit and transportation investment
across the province and prioritize high impact transit projects with an additional $250 million
investment annually. Will also make investments in bike lanes, expand cycling infrastructure
networks and support complete street design with an additional $5 million annually .
• Small, Rural and Northern Municipal Infrastructure Fund -the NDP will proceed with this
funding for critical road, bridge, water, and wastewater projects and projects identified as
priorities in municipal asset management plans
Municipal Labour • Interest Arbitration -they recognize emerging difficulties for municipalities and are open to

• Ontario Works (OW) and Ontario Disability Support Program (ODSP)-the NDP would
implement an increase of $190 to ODSP and work to have OW and ODSP reflect the actual
cost of living
• Child and Elderly Care-the NDP is committed to dental benefits for children of low income
households, creating new childcare spaces and implementing a tax credit for families caring for
ill or elderly relatives
• Minimum Wage-the NDP will increase the minimum wage to $12 per hour phased over two
years and use targeted tax credits to help small businesses manage the impact
• Homeless ness-the NDP will increase the Community Homelessness Prevention Initiative by
$42 million annually to $294 million over seven years
• Building Standards Enforcement-the NDP will protect tenants by providing additional
funding to municipalities to enforce building and maintenance standards
• Waste-the NDP supports extended producer responsibility and is committed to working to
ensure that Bill 91, the Waste Reduction Act works for producers, service providers,
municipalities, and all Ontarians

AMO members may have questions about the status and implementation of the New Building Canada
Fund (NBCF) that was launched by the federal government on March 28,2014.
While the federal government launched the program on March 28th, it has not attained agreements with
any of the provinces or territories for the Provincial/Territorial Infrastructure Component (PTIC), which
includes funds for the Small Communities Fund (SCF). The agreements with Infrastructure Canada are
to set out the approval and payment processes and rules and will need to include matching funding
commitments. ·
In Ontario, AMO understands that this work was started between officials at Infrastructure Canada and
the Ministry of Infrastructure; however, the provincial election has delayed concluding a Canada-
Ontario arrangement Municipal governments need to understand the steps to apply and the parameters
for an application for the PTIC and Small Communities Fund. AMO will want to see this as a clear
priority for post provincial election.
At present, the only federal funds that can receive applications is i) the National Infrastructure
Component for national or regionally significant projects and ii) the Public-Private Partnership Fund
applications as these are directed and decided solely by the federal government Below is a reminder of
the New Building Canada Plan as it relates to Ontario.
AMO, as administrator of the Canada Gas Tax Fund (GTF), is working with municipalities to finalize
their GTF agreements with AMO so that these funds can flow in July. Many municipalities have
adopted the necessary by-law and have executed the agreement. Please ensure that you have given it
priority as it will be only one of a few sources of immediate infrastructure funding.
Overview of the New Building Canada Plan in Ontario over the next ten vears:
• $3.9 billion for municipalities under the federal Gas Tax Fund.
• $2.7 billion for the New Building Canada Fund Provincial and Territorial Infrastructure
Component (PTIC) which is available to other groups besides municipal governments however
$270 million is specifically dedicated as the Small Communities Fund (SCF) for municipal
governments with fewer than 100,000 population.

• National Infrastructure Component (NIF) of $4 billion (no allocation by province or territory) for
national or regionally significant projects; however, all projects over $100 million must be put
through the federal P3 screen and, if indicated as a P3 project, federal funding is contingent on
proceeding as a P3.

some other background information. AMO will inform members of any new information relevant to
these funding components and when applications to the PTIC and SCF are open.
