Mr. Eric Gilbert, Development Planner, County of Oxford, appeared before Council and
commented with respect to County Report 2012-339.
Opportunity was given for comments and questions.
Will Hay hoe representing Hay hoe Homes spoke in support of the subject application. He
noted the lot change was due to demand.
Hayhoe Homes held a neighbourhood meeting on their own to gain resident feedback.
Jim Leroux, local resident, spoke in opposition to the subject application.
Mr. Leroux wanted answers to questions regarding damage of house foundations due to
vibrations and the possibility of multi-family homes.
Mr Hayhoe addressed the foundation damage by offering to meet with Mr. Leroux and
stated that only singled detached homes will be built on the subject lots.

AMO Breaking News-Policing Update-January 2013

Last week Public Safety Canada held a Summit on the Economics of Policing which
included nearly 300 representatives from across the country. AMO was represented at
the Summit by Past President Gary McNamara, Mayor of the Town of Tecumseh.
Federal Minister Vic Toews spoke of two options to address the rising cost of policing -
do nothing and become forced to cut drastically or be proactive in the pursuit of
meaningful ways to achieve sustainable policing costs. AMO continues to advocate for
the latter.
The Federation of Canadian Municipalities estimates costs for police services in
Canada went up from $6.4 billion in 1999 to $12.3 billion in 2009, with municipalities
paying for 60 per cent of that increase. Here in Ontario, municipalities alone spent more
than $3.5 billion on policing in 2010. This is being tackled in part by the Future of
Policing Advisory Committee and its working groups in which municipalities, through
AMO, are well represented.
AMO continues to raise issues related to the cost of policing in a variety of areas. The
accountability and transparency of arbitrators remains AMO's top priority. AMO
President Russ Powers and Past President Gary McNamara recently met with the
Minister of Community Safety and Correctional Services, the Honourable Madame
Meilleur, and OPP Commissioner Lewis to highlight the mutual need for progress and
our pledge to provide municipal input as necessary to deliver further efficiencies. AMO
remains committed to working with the government on these issues.
Rising emergency service costs continues to capture media attention. Below are two
recent stories of interest:

Professor Christian Leuprecht of Royal Military College and Queen's University on the
rising cost of emergency services. Posted December 2012, the interview provides a
good overall picture of key issues affecting municipalities and emergency service costs.

Street, described as Taylor Lane on Registered Plan 578, and that the Mayor and
Clerk be authorized to execute an Agreement of Purchase and Sale and all
documents to complete the sale with 1767006 Ontario Inc;

PURPOSE
1. The purpose of this report is to seek Council approval to sell 0.53 acres of land to
1767006 Ontario Inc to support the ongoing operation of Hoover Industries in the Town
of Tillson burg.
HISTORY 8t DISCUSSION
2. During a meeting held with Hoover Industries as part of the Economic Development
Office's regular corporate visitation program, a request was made by company
representatives to purchase Taylor Lane as they require additional land for their
operations.
3. Upon review by the Town of Tillsonburg, it was determined that Taylor Lane does not
function as a roadway as it currently is a dirt lane. The only municipal use is to enable
the passage of various municipal utility services. Hence, the decision was made to sell
this property in order to support the ongoing operation of an existing business in the
Town of Tillson burg.
4. The utility services will be protected through an easement across these lands with the
easement accounting for over half the area of the lands being sold.

7. This agreement does not include the Town's standard conditions of sale relating to
minimum coverage and a requirement to start construction within a specified time
period as the Buyer already has an existing business adjacent to the property and they
will be using this property for expanded outdoor storage.
FINANCIAL IMPACT /FUNDING SOURCE
8. Staff have negotiated a price of $12,512 for the 23,000 square foot property based on a
price of $28,000 per acre or $0.64 per square foot. This has been adjusted downwards

in the Town ofTillsonburg having a frontage of 50 feet more or less by a depth of 460 feet more or less, containing approximately
0.52 acres (23,000 square feet) and legally described as Taylor Lane on Registered Plan 578 (the "Property"}.
2. PURCHASE PRICE
The purchase price (the "Purchase Price") shall be Twelve Thousand Five Hundred and Twelve Dollars ($12.512.00 Cdn) calculated
at the rate of Twentv Eight Thousand Dollars ($28.000.00 Cdn) per acre with a fifteen percent (15%) decrease in consideration of the
easement.
3. DEPOSIT

or other termination of this Agreement and to be credited towards the Purchase Price on completion, and the Buyer further agrees
to pay the balance of the Purchase Price, by cash or certified cheque, on closing, subject to the adjustments contemplated herein.
For the purposes of this agreement, "upon acceptance" shall mean the date of passage of a bylaw permitting the Seller to enter into
the Agreement. The parties to this Agreement hereby acknowledge that the deposit shall be placed in the Seller's bank account
upon acceptance and no interest shall be paid on the deposit or credited to the Buyer for any reason.
4. IRREVOCABLE DATE
This offer shall be irrevocable by the Buyer until 6 PM on the __ day of February, 20,!1 after which time, if not accepted by the
Council of the Corporation of the Town ofTillsonburg, this Offer shall be null and void and the deposit returned to the Buyer in full
without interest. Further, the Buyer acknowledges that negotiation of this offer, including all amendments is conditional upon the
approval of the Council of the Corporation of the Town of Tillson burg and that the negotiation, representations and/or execution of
the terms in this offer by the Director of Development and Communications or his/her designate in no way binds the Corporation to
any of the terms contained therein.
5. CONDITIONAL DATE
The transaction of purchase and sale contemplated herein shall be subject to the fulfillment of the following terms and conditions on
or before February 8. 2013, which terms and conditions are for the exclusive benefit ofthe Buyer and may be waived in whole or in
part by the Buyer. If the conditions are not fulfilled or waived then the deposit shall be returned and the Agreement arising from the
offer shall be at an end and all parties released from their obligations.
a. The Seller hereby grants the Buyer and its agents access to the property and its consent to conduct all reasonable
soil and environmental tests and investigations on any of the property and if the results of such tests are
unacceptable to the Buyer in its sole discretion, the Buyer may, by written notice to the Seller, delivered on or
before the Conditional Date, terminate this Agreement. In such event, the deposit shall be returned forthwith to
the Buyer, without interest or deduction and all parties shall be released from their respective obligations

13. CLOSING ARRANGEMENTS
Where each of the Seller and Buyer retain a lawyer to complete the Agreement of Purchase and Sale of the Property, and where the
transaction will be completed by electronic registration pursuant to Part Ill ofthe Land Registration Reform Act, R.S.O. 1990, Chapter
L4 and the Electronic Registration Act, S.O. 1911, Chapter 44, and any amendments thereto, the Seller and Buyer acknowledge and
agree that the exchange of closing funds, non-registrable documents and other items (the "Requisite Deliveries") and the release
thereof to the Seller and Buyer will (a) not occur at the same time as the registration of the transfer/deed (and any other documents
intended to be registered in connection with the completion of this transaction) and (b) be subject to conditions whereby the
lawyer(s) receiving any of the Requisite Deliveries will be required to hold same in trust and not release same except in accordance
with the terms of a document registration agreement between said lawyers. The Seller and Buyer irrevocably instruct the said
lawyers to be bound by the document registration agreement which is recommended from time to time by the Law Society of Upper
Canada. Unless otherwise agreed to by the lawyers, such exchange of Requisite Deliveries will occur in the applicable Land Titles
Office or such other location agreeable to both lawyers.
14. HARMONIZED SALES TAX (HST)
If this transaction is subject to HST, then such tax shall be in addition to the purchase price. The Seller will not collect HST if the
Buyer provides to the Seller a warranty that the Buyer is registered under the Excise Tax Act ("ETA"), together with a copy of the
Buyer's ETA registration, a warranty that the Buyer shall self-assess and remit the HST payable and file the prescribed form and shall
indemnify the Seller in respect of any HST payable. The foregoing warranties shall not merge but shall survive the completion of the
transaction. If the transaction is not subject to HST, Seller agrees to certify on or before closing that the transaction is not subject to
HST.
15. TIME OF THE ESSENCE
Time shall in all respects be of the essence hereof provided that the time for doing or completing of any matter provided for herein
may be extended or abridged by an agreement in writing signed by the Seller and Buyer or by their respective lawyers who are
specifically authorized in that regard.
16. TENDER
Any tender of documents or money hereunder may be made upon Seller or Buyer or their respective lawyers on the day set for
completion. Money may be tendered by a bank draft or cheque certified by a Chartered Bank, Trust Company, Province of Ontario
Savings Office, Credit Union or Caisse Populaire.
17. FAMILY LAW ACT
Seller warrants that spousal consent is not necessary to this transaction under the provision of the Family Law Act, R.S.O. 1990 unless
Seller's spouse has executed the consent hereinafter provided.
18. LEGAL, ACCOUNTING AND ENVIRONMENTAL ADVICE
The parties acknowledge that any information provided by the Seller is not legal, tax or environmental advice and that it has been
recommended that the parties obtain independent professional advice prior to signing this document.
19. CONSUMER REPORTS
The Buyer is hereby notified that a consumer report containing credit and/or personal information may be referred to in connection
with this transaction.

28. ASSIGNMENT
The Parties agree that this Agreement shall not be assigned but the Buyer shall be permitted to direct that title will be drawn in the
name of another corporation which is wholly owned by the Buyer or has identical shareholders, directors and officers as the Buyer
and confirmed by the Purchaser's solicitor prior to closing along with confirmation that the Purchaser's solicitor has no knowledge of
any intention of the Purchaser to sell, transfer, convey or gift the shares of the Purchaser to any other party, entity or person.
SELLER ACKNOWLEDGEMENTS
29. SURVEY
The Seller agrees to provide to the Buyer, at the Buyer's expense, an up-to-date reference plan of the property, prepared by a
qualified Ontario Land Surveyor under seal, showing the size and measurements of the property to describe the land for a
registerable transfer. Further, the Buyer agrees to provide a surveyor's certificate as to the precise acreage of the Property
whereupon the purchase price to be paid shall be adjusted accordingly if the certificate indicates that the acreage is more or less
than described in Paragraph 1 above and such certificate shall be final and building upon the Seller and Buyer.
30. DISCHARGE OF ANY MORTGAGES, LIENS OR ENCUMBRANCES
The Seller agrees to discharge all mortgages, liens or encumbrances, if any, registered against the property at its own expense, on or
before closing, save as aforesaid.
31. EXISTING SERVICES
The Seller agrees, without payment by the Buyer of additional levies, imposts or charges, to supply to the property all existing
municipal services currently in place and serving the property including paved roads, hydro, water, sanitary sewers and storm
drainage ditches. Such municipal services to be available on or before closing. Notwithstanding the forgoing, the Buyer
acknowledges and agrees that it will be responsible for any fees to connect laterals to water, sanitary sewers, and hydro at the standard
charges imposed by Tillsonburg Hydro Inc and the Town of Tillsonburg/County of Oxford Engineering Departments as well as any costs
associated with the installation of laterals to connect to services within the municipal road allowance. The Buyer further acknowledges
that it will be responsible, at its sole cost, for compliance with any onsite or abutting drainage requirements including lot grading or
drainage swales, ditches or conduits that may be required including costs associated with construction or installation of same as a result
of any proposed development on the property and as a condition of approval of such development. The Buyer acknowledges that a Road
Occupancy Permit must be obtained for any works undertaken on Tillsonburg's road allowance(s) and the Buyer shall provide a cash
deposit in an amount satisfactory to the Director of Operations to guarantee the performance ofthe Owner's obligations pursuant to the
Road Occupancy Permit and to indemnify the Town of Tillson burg for any costs incurred as a result of works undertaken on the road
allowance(s) in addition to any security required pursuant to this Agreement.
The obligations of the Seller set out in this paragraph shall not merge on closing.
32. REASONABLE ASSISTANCE BY THE SELLER
The Seller agrees to provide reasonable assistance and co-operation to the Buyer in obtaining necessary approvals for the development
of the property subject to the Buyer's compliance with all relevant building codes, bylaws, land use controls, any other statutory
requirements and payment of the fees provided for in the Town's current fees bylaw. The obligations ofthe Seller set out in this
paragraph shall not merge on closing.

This Schedule is attached to and forms part of the Agreement of Purchase and Sale between
BUYER (''Transferor"), and
SELLER ("Transferee"), The Corporation of the Town of Tillson burg
for the purchase and sale of

WITNESSETH that the parties hereto agree as follows:
1. The Transferor is the owner in fee simple and in possession of the lands described as Taylor Lane, Registered Plan 578 ("the
subject property") herein.
2. The Transferee has transferred the subject property to the Transferor and as such the Transferor is the owner of the subject
property.
3. The Transferee and or their designate have installed, or will install, future utility services on the property.
4. In consideration of the sum of ONE DOLLAR ($1.00) of lawful money of Canada, now paid by the Transferee to the
Transferor, the Transferor hereby grants, transfers and conveys in perpetuity to the Transferee, its successors and assigns,
the rights and easement:
a. To install, maintain, operate, repair, replace, reconstruct and remove the utilities on the subject property
including:
To enter on or to pass and repass at any and all times in, over, along and upon the subject property for
the servants, agents, contractors, and sub-contractors of the Transferee with or without vehicles,
supplies, machinery and equipment for all purposes necessary or convenient to the exercise and
enjoyment of the rights and easement hereby granted subject to payment by the Transferee of
compensation for any damage sustained by the Transferor caused by the exercise of this right of entry
and passageway;
ii. To remove, relocate and reconstruct the Line on the subject property, subject to payment by the
Transferor of any additional compensation for damage caused thereby;
iii. After entry upon the subject lands, to restore the lands to substantially the same condition they were
prior to their entry thereon at the sole expense of the Transferor.
5. The Transferor covenants and agrees not to erect any buildings, structures, or other obstructions of any nature without the
prior written approval of the Transferee. Further, the Transferor covenants and agrees to not erect any buildings,
structures or other obstructions of any nature over any existing services, save and except, the improvement of the actual
surface of the easement with asphalt or other hard surface improvements.
6. The Transferor covenants with the Transferee that it has the right to convey the said rights and easement over the subject
property to the Transferee and that the Transferee shall quietly possess and enjoy the rights and easement, and that it will
execute such further assurances of the rights and easement as may be from time to time required.
7. All covenants herein contained shall be construed to be several as well as joint and wherever the singular and the masculine
are used in this Transfer and Grant of Easement, the same shall be construed as meaning the plural or the feminine or
neuter where the context of the parties hereto so require.

War of 1812
Commemorative Weekend Proposal
for Oxford County, Ontario
Presented by Centreville Pond and Conservation Area Committee,
Centreville, Township of Southwest Oxford
Proposal: To create and host a commemorative two-day schedule of events during one
weekend in August, 2014, remembering the history and honouring the acts of early settlers as
they defended their settlement, Oxford on the Thames, and Canada during three separate
American attacks in 1814 during the War of 1812.
Historical Background: Oxford on the Thames Settlement
In 1812, Oxford on the Thames was a small but growing settlement near the Thames River in
present day Centreville, Beachville and the edges oflngersoll, Oxford County, Ontario.
The settlers had been brought in by Major Thomas Ingersoll, who had moved to the area in 1793.
Some of the settlers were United Empire Loyalists and others were from the United Kingdom.
Many were given land grants from the government, with the stipulation that they build
permanent homes, clear some of the heavily wooded land and plant crops. Other settlers
purchased property.
The settlement became known as Oxford on the Thames. Most of it was situated along the
Detroit Path, an old Indian trail that became the main road, also referred to as Broken Front
Concession (Kam Road today, in what is now Centreville, north Beachville and Ingersoll). To
protect the settlement and Canada, local settlers, predominantly farmers, were obligated by the
government to fulfill militia duties. Prior to 1812, Canadian militiamen would answer the local
call to muster once a year, show up with pitchforks, march a bit, have a drink and go horne. Once
war was declared, militiamen typically served for three-month stints alongside professional
British soldiers and Indian warriors. As soon as they were able, the militiamen hurried back to
their anxious families and waiting farms and business duties.
State of the War in 1814
At the outset of 1814, the Canadian side was still soldiering on, without the daring and cunning
leadership of Major General Isaac Brock and Chief Tecumseh, both killed in battle in 1813.
The Americans had control of Southwestern Ontario, won since their victory at the Battle of the
Thames at Moraviantown, Ontario in 1813. However, America was going broke.
to the ownership of this mill; some claim that it was owned by Westbrook himself. However,
multiple land records indicate that Westbrook never owned property in Oxford on the Thames.
The settlers tried to drive their horses into the woods for safety; the horses still in sight were
taken by the Americans, who also killed or took the livestock. Anything of use to the British was
destroyed.
Arriving at the home of Enoch Burdock, the Rangers were met with gunfire. Burdock wounded
one American. The Rangers fired back and wounded Burdock and then looted his home.
The Michigan Rangers captured members of the settlement's militia: Captain John Carroll,
Captain David Curtis, Captain Ichabod Hall and Sergeant Dowland were in their own home
when they were seized.
Leaving Oxford with their prisoners, the Americans were bound for Fort Detroit. Westbrook was
known to ride an easily recognizable Pinto and so he forced Captain Carroll to ride his horse.
The party had reached Reservoir Hill (present day Byron) when they were ambushed by the
Middlesex Militia. One of the militia was Captain Carroll's best friend, who mistook the rider on
the pinto, and mistakenly shot and killed Carroll.
In the confusion of the ambush, Westbrook's prisoners were able to escape. The settlement's
militia returned to Oxford on the Thames, bringing Carroll's body with them. Westbrook and the
Michigan Rangers went back to Fort Detroit.
November 5, 1814:
Oxford on the Thames came face to face with a new foe in the autumn. Brigadier General
McArthur of the U.S. Army struck terror in the settlers' hearts when he arrived with mounted
troops consisting of 600 volunteers, 50 V. States' rangers and 70 Indians.
But before they rode into Oxford, two men rushed away on horseback. Settler George Nichols,
owner of 100 acres on Lot 15 on the Detroit Path (Kam Road today), was a lieutenant in the
Oxford Militia and a known scout for the British. His neighbour, Jacob Woods, militiaman and
owner of Lot 14, left with Nichols at 3 a.m., riding hard to warn Lieutenant-Colonel Bostwick,
stationed at the Y eigh home in Burford. Mrs. Elizabeth Nichols and her three children hid in a
root cellar dug into the sloped side above the creek.
A neighbour of the name ofBazely informed McArthur ofNichols and Woods' escape. He also
provided the Americans with the names and locations of several militiamen in the area. The
Americans acted on the information, seeking out the militiamen and confiscating their property.
McArthur later reported in a Nov. 18th letter to the U.S. Secretary of War: "We were thus
enabled to arrive at the town of Oxford, one hundred and fifty miles distant from Detroit, before
the inhabitants knew that a force was approaching. They were promised protection to their
persons and property, upon condition that they remained peaceably at their respective homes;
otherwise, they were assured that their property should be destroyed
There were also stories of long lost gold and other valuables, buried under fence posts, in fields
and on Indian Hill by panicked settlers fearing enemy attacks during the War of 1812 and other
upnsmgs.
Intrepid Settlers
Local tradition tells of two young boys from Oxford on the Thames who wanted to join in battle.
They ran off to fight, saw some action, and when their Canadian party was defeated, the boys
begged food as they made their way home.
Another story tells of a settler's wife who was concerned about her husband, serving in the
militia in the Niagara area. She worried that he did not have socks and so after knitting him
some, she walked about 100 km to deliver them to her spouse.
Yet another tale is set in Oxford on the Thames after the Burdick Mill was burned down.
Desperate to have flour to bake bread, a female settler carried a bag of grain as she walked to the
nearest surviving mill at Burlington Heights, 100 km away.
Indian Hill Burial
Bill Injun, a Native warrior who fought in the War of 1812, was reputed to be buried on Indian
Hill (present day Centreville). A headstone marking his grave was claimed to have been in
existence for many years.
Indian Hill is the traditional burying place of Native Peoples. It was apparently a place of annual
pilgrimage for the Neutral Indians, who came each summer to bury their dead and honour their
ancestors. In the 1940s, the farmer who owned the farmland on Indian Hill across from the
Centreville Pond made an agreement with an aggregate company for gravel extraction. The
company began removing earth, digging out a long scoop near the top of Indian Hill. It is said
that a mass grave was revealed; the bones were attributed to Native Peoples buried en masse
after an epidemic outbreak. The aggregate company ceased operations. The excavated area
remains to this day.
Proposed Commemorative Events and Activities
The actual weekend in August, 2014 is to be determined. Mill Line is to be closed to vehicular
traffic except for emergency vehicles. Shuttle vehicles will bring in visitors from parking sites.

write their answers on game sheet, filling in local historical information as they find it.
Martin Tavern: Tent set up on Mill Line. Beverages and food served.
The Village Healer: An herbalist will describe pioneer natural remedies and show how wild
plants would have been prepared to make remedies.

INTERPRETATION AND APPLICATION
1. ( 1) In this Regulation,
"em" means centimetres;
"day" means a 24-hour period;

"motor vehicle" has the same meaning as in subsection 1 (1) of the Highway Traffic Act,
except that it does not include a motor assisted bicycle;
"non-paved surface" means a surface that is not a paved surface;
"paved surface" means a surface with a wearing layer or layers of asphalt, concrete or asphalt
emulsion;
"roadway" has the same meaning as in subsection 1 (1) of the Highway Traffic Act;
"shoulder" means the portion of a highway that provides lateral support to the roadway and
that may accommodate stopped motor vehicles and emergency use;
"surface" means the top of a roadway or shoulder.
(2) For the purposes of this Regulation, every highway or part of a highway under the
jurisdiction of a municipality in Ontario is classified in the Table to this section as a Class 1,
Class 2, Class 3, Class 4, Class 5 or Class 6 highway, based on the speed limit applicable to it
and the average annual daily traffic on it.
(3) For the purposes of subsection (2) and the Table to this section, the average annual
daily traffic on a highway or part of a highway under municipal jurisdiction shall be determined,

as practicable after becoming aware of the fact that the snow accumulation on a
roadway is greater than the depth set out in the Table to this section; and
(b) after the snow accumulation has ended and after becoming aware that the snow
accumulation is greater than the depth set out in the Table to this section, to clear the
snow accumulation in accordance with subsections (2) and (3) or subsections (2) and
(4), as the case may be, within the time set out in the Table.
(2) The snow accumulation must be cleared to a depth less than or equal to the depth set
out in the Table.
(3) The snow accumulation must be cleared from the roadway to within a distance of0.6
metres inside the outer edges of the roadway.
(4) Despite subsection (3), for a Class 4 highway with two lanes or a Class 5 highway
with two lanes, the snow accumulation on the roadway must be cleared to a width of at least 5
metres.
(5) This section,
(a) does not apply to that portion of the roadway designated for parking; and
(b) only applies to a municipality during the season when the municipality performs
winter highway maintenance.
(6) In this section,
"snow accumulation" means the natural accumulation of new fallen snow or wind-blown
snow that covers more than half a lane width of a roadway.

green indication to the time where one or more different traffic directions receive a green
indication;
"power failure" means a reduction in power or a loss in power preventing the traffic control
signal system from operating as intended;
"traffic control signal" has the same meaning as in the Highway Traffic Act;
"traffic control signal system" has the same meaning as in the Highway Traffic Act;
Traffic control signal system sub-systems
14. (1) The minimum standard is to inspect, test and maintain the following traffic
control signal system sub-systems every 12 months:
1. The display sub-system, consisting of traffic signal and pedestrian crossing heads,
physical support structures and support cables.
2. The traffic control sub-system, including the traffic control signal cabinet and internal
devices such as timer, detection devices and associated hardware, but excluding
conflict monitors.
3. The external detection sub-system, consisting of detection sensors for all vehicles,
including emergency and railway vehicles and pedestrian push-buttons.
(2) The minimum standard is to inspect, test and maintain conflict monitors every five to
' seven months and at least twice a year.
(3) In this section,
"conflict monitor" means a device that continually checks for conflicting signal indications
and responds to a conflict by emitting a signal.
Bridge deck spalls
15. (1) If a bridge deck spall exceeds both the surface area and depth set out in the Table
to this section, the minimum standard is to repair the bridge deck spall within the time set out in
the Table after becoming aware ofthe fact.
(2) A bridge deck spall shall be deemed to be repaired if its surface area or depth is less
than or equal to that set out in the Table.
(3) In this section,
"bridge deck spall" means a cavity left by one or more fragments detaching from the paved
surface of the roadway or shoulder of a bridge.

RECOMMENDATIONS
"Resolve that Council receives Operations Services Report OPS13-02 -
Winter Maintenance of Town Streets, Sidewalks and Parking Lots as
information."
PURPOSE
To provide information on Town Winter Maintenance operations for Town Streets,
Sidewalks and Parking Lots.
HISTORY & DISCUSSION
Operations Services -Public Works provides winter maintenance services for clearing
snow and ice off town streets, sidewalks and parking lots which typically occurs from
November to March for the average winter maintenance season.
Minimum Maintenance Standards
The town is legally required to comply with the Minimum Maintenance Standards for
Municipal Highways as per the Municipal Act and O.Reg. 239/02 as amended and the
hours of service or work legislation as per the Highway Traffic Act and O.Reg.SSS/06.
Specifically, the regulation requires municipalities to provide winter maintenance control
for snow accumulation and icy roadways. The response times vary depending on the road
classification which is a function of daily traffic volumes (AADT) and posted speed limit.
There are six classes of highways based on the above criteria of which Tillsonburg has
roads in classes 2 to 6. A class 1 road is defined as a posted speed limit greater than
70kph with traffic volumes 12,000 plus AADT. Our highest class roadway currently is a

Snow Plow and Salt Routes
The snow plowing and salting routes are broken up into 6 areas (see attached map). The
priority of response is to plow or salt roads within the route by the prescribed time frames
in the regulation. Other areas of concern that are considered and given priority service are
the downtown core, school, hospital and emergency services routes. Trucks will stay to
main connectors first having them open for all traffic.
Town has 9 pieces of Road Equipment as follows:
3 - 5 Tons -Front plow and wing, all have salt and brine ability
2 Under slung Plows -Both have a plow under the truck, brine and salting ability
1 - 3 Ton -Angle blade, salt only
1 Grader -No brine or salting ability
2 Loaders -No brine or salting. 1 is used for loading trucks and loading snow, the other
has an angle blade for plowing.
During the early and late shifts coverage is primarily provided to the higher class
roadways and high maintenance areas (e.g. drifting, bridges etc.) for snow and ice
events. During off storm events snow removal in the downtown parking lots, sidewalk
clean-up is usually carried out.
Under slung plows provide salting services for the grader and loader areas during events
and also help with salting of parking lots and lanes when the full fleet is out.
Although great care is taken in clearing snow, sometimes sod damage does occur from
plowing operations. These issues are logged in ACR and repaired in the spring as time
permits.
New advances in anti-icing allow salt brine or salt brine with an organic additive (for
colder temperatures) to be placed ahead of a storm to help prevent a bond forming
between the road and ice which make our roads safer in the winter time. This can be done
during any shift by our new plow and anti icing truck (unit #61) and is primarily carried
out on class two and three roads. Our snow plow route statistics are as follows:

Downtown Parking Lots
All Town parking lots which consists of 17 areas are contracted out annually to have snow
plowed and piled, which Public Works haul away at a later date (see attached map). In
addition, the fire and police parking lots are cleared and have priority over the town lots
since they are of an emergency and essential service basis. Once lots have been plowed
our equipment salts these areas and snow is removed from the heavily used lots first (i.e.
Lots 1A,1B and A7 once the roads and sidewalks are in a safe condition, downtown snow
lift(s) are complete and as time permits. Parks and Recreation forces maintain the
Complex area, cemetery and most other town facilities.
Downtown Snow lifts
The downtown core which is from the South end of Town at Prospect St. to the North end
at Bridge St, West side at Rolph St. to the East side at Harvey Street, has its plowed snow
picked up and taken away either by special request by Director or when the Business Area
streets generally reach a curbside depth of over a half metre. Broadway and the
immediate side streets located in the downtown core are serviced.
This is done by our loader mounted snow blower and trucks, plus we use large
tandem/tri-axial truck rentals to have it completed a night time collection which
depending on the amount lasts about 7 hours and occurs usually over 2 nights depending
on the amount of snow.

PURPOSE
To report on the Ministry of Transportation Ontario (MTO) Highway #3 and Vienna Road
Intersection Improvements.
HISTORY 8r. DISCUSSION
The MTO is planning on improving a variety of intersections in the province over the next
few years including Highway #3 and Vienna Road. Town engineering staff are part of the
EA steering committee and have reviewed the proposed options including the preferred
alternative which is a roundabout rather than traffic signals.
Roundabouts have been implemented successfully in various municipalities throughout
Ontario. Major benefits are reduced serious right angle , left turn and head on motor
vehicle collisions, increased fuel efficiency, less delay to traffic and reduced maintenance
costs.
A Public Information Centre was held at the library on October 25th, 2012 for the Public to
review options and the preferred alternative. Based on the screening process and
comments received the MTO is recommending this projected be "stepped down" to a
Group "C" project-approved (see attached letter and notice which was published in the
local newspaper on Wednesday January16th, 2013).

The Ontario Ministry of Transportation (MTO) has retained McCormick Rankin (MRC) to undertake the
preliminary design and Class Environmental Assessment (Class EA) Study for improvements to the
intersection of Highway 3 and Vienna Road, near the Town of Tillsonburg, Oxford County. The proposed
works include: the construction of a roundabout and associated Illumination.
This project has followed the Class E"A for Provincial Transportation Facilities (2000) for a Group 'B' project.
Based on the information collected during the screening process, it has been determined that the project will
not result in any significant adverse environmental effects. Therefore, the MTO is proposing to step-down this
project from a Group '8' to a Group 'C' project. A Transportation Environmental Study Report will not be
prepared and no future public notices will be provided for this project. Group 'C' projects are considered
approved, subject to compliance with the Class EA and an Environmental Screening Document will be
prepared for internal MTO use.
You have the opportunity to request that MTO reconsider the step-down decision and continue to classify this
project as a Group 'B' project. Should you wish to make this request, please contact one of the
representatives below by February 15, 2013. If no objections are received by this date, the project will be
stepped down to a Group 'C' project.

RECOMMENDATIONS
"Resolve that Council receives report PRS 13-01 -Cemetery Signage for
information and further resolve that Council direct staff to implement
Option 1 and Option 2 as presented in the Report."
PURPOSE
To provide information to Council about options for changes to Cemetery signage and
obtain direction on which option(s) to proceed with. Staff recommend that Option 1 and
Option 2 are both implemented.
HISTORY 8r. DISCUSSION
In 2012 Town Council asked staff to explore other options for signage at the Tillsonburg
Cemetery. Staff reviewed images from other Cemeteries to establish various options and
discussed the pros and cons of the following concepts:
1. Cemetery Entrance Archway -This option was reviewed and while it seemed to
be common on walkway entrances in other cemeteries, the size of the arch required
on a main entrance feels overwhelming as one approaches the cemetery. In
addition the height would have to be significant as large trucks require access for
tree care and other maintenance activities. Staff do not see this as a viable option
at this time, however consideration could be given to providing an archway over
one of the walkway entrances on the property in the future.
2. Cemetery Entrance Stone Wall-Quite a few larger Cemeteries have stone walls
with text incorporated into the wall. The cost for such a wall and sign would be
expensive and might detract from the existing iron posts and fencing currently on
site. Staff do not see this as a viable option at this time.
3. Complete the landscaping at the existing sign -This option appeared to be
cost effective and provide the required information for emergency vehicles and for
visitors from out of town and is outlined below for Council's consideration as Option
1.

Reinstate the existing pre-cast
concrete lettering on the berm.

worn and damaged and will
need to be replaced. Staff also
suggested that the slope of the
berm be tilted to better display
the letters for viewing from
Simcoe Street. In addition the
pre-cast concrete could be
refinished with an industrial
quality paint to retain the
contrast of the letters and protect the concrete. If this option is pursued, staff recommend
planting some low growing perennial plants around the lettering to create a contrast and
beautify the area. The addition of plants could be phased in over a couple of years to
spread out the cost and could be purchased through operating funds. The non-labour cost
to reinstate this area would be about $2,500.00.
Option 4
While reviewing the Cemetery signage staff noted the possible relocation of the metalwork
Cemetery sign for use elsewhere within the Cemetery or as a potential entrance sign to
Tillsonburg or perhaps to the Lake Lisgar Waterpark. This option is not being
recommended at this time, as the cost to relocate the sign including creating new
foundations and appropriate landscaping is estimated at $2,500.00. Relocating the sign
within the Cemetery would be an unnecessary expense, and while no replacement of the
sign would be needed, completing the landscaping at the existing site would still be
required. Staff also felt that deploying the sign at an entrance to Tillsonburg may not be
consistent with the overall Town promotion strategy. Deploying the sign at a Town
entrance or near the Waterpark would require changes to the sign to remove the word
"cemetery" and the associated costs for that and for the placement of the sign would have
to come from a source other than the Cemetery reserves.
Summary
Staff recommend that the partially completed landscaping around the metalwork sign be
finished in the spring of 2013 (Option 1) and that appropriately designed signs including
civic addressing be commissioned for installation on the fencing at the Simcoe Street
entrances (Option 2). The combined cost before labour of these two options is under
$2,000.00 and these funds are recommended to come from the Cemetery reserve.

M. Renaud distributed the Town of Tillson burg Personnel policy to all Board members
for their perusal. M. Renaud once again suggested that this policy be reviewed and that
the BIA Personnel policy be created with this policy as a guideline.
International Shopping Association-Value of being a member was distributed by M.
Renaud -Mark stressed the importance of tracking pedestrians in the downtown, retail
vacancies etc. Cost of membership is $100.00 ICSC. He asked that this be added to the
Budget. It will be a great tool for our BIA.
BIA and Town contribute 25,000 respectively to the Grant.

Rolph Street School-2. A letter has been received from Thames Valley School Board
Re Rolph Street Public School stating that the Board does not
approve designating Rolph Street School as a Historic Site. It was

reported in the Tillsonburg News on October 17, 2012. As
recommendation 4. "That the trustees recognize the historical

W.D. Jarvis has since been in conversation with Bill McKinnon
chairman of ARC and a member of the Thames Valley School
Board. This recommendation was to be presented to the School
Board in December. TACAC awaits the decision on that
recommendation
3. Pioneer Cemetery repairs are ongoing.
4. Request for designation of Pioneer Cemetery as a Historic Site.
It was agreed by those present the approval be accepted m
principle subject to final approval by the T ACAC committee.
5. St. Marys Roman Catholic Church-The congregation is looking
at options for their future. A designation request to Council will
depend on decisions made in the future.

Item 1: Source Water Protection
P. Michiels provided background and insight into the process associated with Source Water Protection at
the County.
The process has been going on for some time at the County.
• Stems from the passing of "The Clean Water Act"
• Goal of the act is to protect municipal drinking water sources; any prescribed significant
threat activities must cease to be recognized as a threat.
• Oxford is split into two source water protection areas -Lake Erie Source Protection Region and
Thames, Sydenham and Region Source Protection.

P. Michiels-No, it does not necessarily, but if the activity is staying the same, then it should not have any
impact.
Final Remarks-Source Water Protection
Source Water Protection Plan is being approved in 2013; County suspects that the plan should be
approved earlier versus other municipalities.
• Limited comments and feedback from public during the process.
• Risk Management Plans if used, gives flexibility in specific situations.
Item 2: Five year review of Provincial Policy Statement (PPS)
P. Michiels discusses the five year review of the PPS.
PPS provides policies and direction for land use planning in Ontario.
• All municipalities need to take into account PPS policies.
• County amended OP in 2009 with the current PPS policies.
• For most part, current OP is consistent with PPS.
New amendments are minor, with a few additional clarifications with some of the policies.
• There will be an increased focus of sustainable transportation.
• Greater interest in transportation corridors.
• Greater emphasis in alternative modes of transportation.
Comments are being made regarding the use of Comprehensive Reviews (CR).
P. Michiels outlines the use and implementation ofCR's:
• Any change in a municipal boundary, requires a CR which acknowledges population growth
projections, reviews infrastructure and servicing, etc.
As part of the comments process, the County asked scoping requirements depending on the scale and the
adjustment of the boundary.
County will use their discretion based on the type of the proposal.
Question presented regarding cross-border servicing?
P. Michiels acknowledges that it depends on the border; PPS does not specifically address
implementation on the cross border issues.
It is up to the County OP that establishes the framework in conjunction with the local municipality.
• Any further extensions for servicing purposes will need approval.
Question: when the town expands, where will development go as there is servicing issues in some of the adjacent
jurisdictions?
P. Michiels acknowledges that it depends on the purpose for expansion (either employment lands or for
residential growth).
• Need to show that all alternatives for growth have been addressed.
• Need to take into account the quality of the lands.
• The problem is that these areas were based on perceived boundaries.
• A full secondary planning exercise will need to be done for expansion into these areas.
• Individuals in these areas assume that development will go in this direction, even though it may
not be supported.
Approvals for the 5 year review should be some time in the near year, depending on the types of
comments that come back.

Plan in place to hire an internal IT manager is in the works.

There are a few options in terms of implementing IT services:
• Bizpal and GIS technology are some of the options.
There will be a "Request for Proposal" for Council at the meeting on Monday (Nov 12) to survey the
community on how to improve IT services and a suitable delivery model.
• Open model and open source is becoming the trend for IT services for municipalities.
6) Recommendations to Council
Stormwater Management
Request that staff address storm water management.
• To request that staff investigate options for more local control of storm water management further
to Report OPS12-15-Industrial SWM Approvals.
• To request that staff develop and implement a formal local process to fast-track approvals.
• To request that staff approach other municipalities and other organizations (e.g. SWEA, SCOR,
Ontario Chamber of Commerce) to obtain support for an alternative MOE fast-track process.
• To request that MOE make a new fast-track process available.

The Planning Department sought approval for a total of 9 applications. All conform to
policies and guidelines, and staff recommends approval.
B. Chanyi asked for clarification on two properties. In response to other Board
inquiries, H. Surette noted that the main concern for LPRCA in relation to the hazard
level is the potential harm to property and persons in the event of a catastrophic storm.
The new Lakeflood Assessment model will assist staff in determining the potential
damage resulting from hazards.

c) LAKEFLOOD FORECASTING TABLES
LPRCA has been working with other CAs to lobby the MNR to prepare a model to better
forecast Lake Erie flood events. The MNR has since completed the project for all the
great lakes at no cost to the CAs. Therefore, staff would like to reallocate the funds
budgeted for the forecast model to implement the Flood Risk Assessment tool. This
tool will help assess potential flooding damage along the Lake Erie shoreline.

EXECUTIVE SUMMARY
A 0.3m (one foot) reserve is a strip of land 0.3m wide, running along the street frontage or
perimeter of a property or perpendicularly across a road right-of-way that is deeded temporarily
to the Town as a condition of a subdivision or Development agreement. This reserve
technically denies access to a property, or adjacent lands because the law requires that all
land must have frontage on a public street to qualify for a building permit. The reserve is used
as a means to control development until such time as various conditions are met or to prohibit
development on lands that are not yet scheduled for development. The lifting of the reserve
can result in the dedication of land as public highways, the conveyance of land back to the
owner or in some cases, both. The purpose of this by-law is to remove this reserve and
dedicate this piece as a public highway. In this case there were development and servicing
fees that were outstanding.
The property owner, through legal counsel, has requested the reserve be removed and the
land dedicated as a public highway in order to obtain access and obtain a building permit for
this parcel. Staff consulted with engineering and building to determine the status of the
reserve. All outstanding development and servicing fees have now been paid, therefore the
Town may "remove" the reserve and give the property owner direct access to the public
highway, namely Northview Drive. The property owner would then qualify to apply for a
building permit.

abutting a public highway as listed in Column 1 as shown on Registered Plan in Column 2 of Schedule
"A" attached hereto;
AND WHEREAS it is necessary to dedicate public highway over the said reserves listed in
Schedule "A";
THEREFORE the Council of the Town ofTillsonburg enacts as follows:
1. That the reserve as listed in Column 1 of Schedule "A" attached hereto shall be dedicated and
established as part of the public highway listed opposite under Column 3.

EXECUTIVE SUMMARY
Council will recall that on January 9, 2012, they passed By-Law 3540 to adopt a schedule of
fees for certain municipal applications, services and permits. This was a major review of
municipal rates and fees as rates had not changed since the previous by-law was passed in
January 2006. Staff have committed to reviewing the rates on an annual basis so the public
would not be subject to larger increases at any one time.
The Tilllsonburg Community Centre provided a nominal increase of 2% across the board. The
increases will ensure the continuance of programs and will continue to be in line with similar
services in surrounding municipalities.
The Museum also recognized nominal increases as these fees have not been reviewed in a
number of years. The increases were for museum rental/tours, 25 to 50 people increased from
$50.00 to $60.00, 51-100 people from $60.00-$75.00 and 101 -150 people from $75.00 to
$100.00.
The Cemetery added the new columbarium fees and added the Provincial Cemetery Regulation
Fee to the list.
Additional fees were added to the by-law to recognize the new business licence by-law and fees
for marriage ceremonies.

2. Should the provisions of any other By-Law of the Town ofTillsonburg or other document
purporting to set the Fees listed in Schedule "A" be in conflict with the provisions of this By-Law,
the provisions of this By-Law shall prevail.
3. That Schedule "A" to this by-law forms part of this by-law as if written herein.
4. This By-Law shall come into full force and effect on the day of its passing.

RESOLVE THAT Council receive CL 13-03, Executive Summary to By-Law 3697, To Adopt a
Civil Marriage Ceremony Policy;
FURTHER RESOLVE THAT By-Law 3697 be brought forward for Council consideration for three
readings.
EXECUTIVE SUMMARY
Council will recall that on October 9, 2012, they passed By-Law 3656, To Provide the Clerk and
Designate with Authority to Solemize Marriages.
Using the information in report CAO 12-20 that was also approved on October 9, 2012, the
attached Civil Marriage Ceremony Policy was created. This policy establishes clear guidelines
for the officiants (Clerk and Deputy Clerk) to use when preparing and conducting civil marriage
ceremonies. Schedule A to the policy is a Civil Marriage Package that will be given to all
applicants when planning their civil ceremonies.

A. Policy Statement
There is a need to provide civil marriage applicants with a clear set of guidelines on the
procedures of a marriage ceremony conducted by the Town of Tillsonburg.
B. Purpose
This policy will establish clear guidelines for officiants when preparing for and conducting
civil marriage ceremonies. Schedule A to this policy will be a Civil Marriage Package
designed to help the applicants prepare for the ceremony.
C. Scope
This policy applies to all civil marriages conducted by Town appointed officiants.
D. General
This policy shall be administered by the Clerk's Department.
This policy shall be referred to as the "Civil Marriage Ceremony Policy".
This policy comes into force and effect on the date adopted.
E. Authority
The authority for the Civil Marriage Ceremony Policy shall be by the approval of the
Council of the Town of Tillsonburg.

Location
1. Wedding Ceremonies are conducted in the Council Chambers, which is located on
the 2nd floor of 200 Broadway, Tillsonburg. Ceremonies are conducted Monday to
Friday between 9:30am and 3:30pm. Ceremonies will not be conducted on days that
Town Council meets (usually the 2nd and 4th Monday of each month).
2. Officiants may conduct ceremonies at a different location, and/or outside of regular
business hours upon request. When the ceremony is held outside of business hours
an alternative location must be provided.
3. The Council Chambers will only be made available for a maximum of one hour per
ceremony.
4. Music will be permitted at certain times throughout the ceremony, and is to be
determined during the pre-ceremony meeting. When selecting the type of music,
consideration should be given to its appropriateness and contribution to the dignity of
the occasion. Music and an audio device must be supplied if you wish to have music
at the ceremony.
5. A maximum of 25 guests (not including the wedding party) can be accommodated in
the Council Chambers should this location be used for a civil marriage ceremony.
6. No candles, confetti, rice, or bubbles are allowed in the Council Chambers or on
municipal property.
7. When using Council Chambers, minimal decorations are permitted (e.g. flowers,
balloons). They may be placed 15 minutes prior to the Ceremony and removed
within 15 minutes of the conclusion of the Ceremony. The use of decorations that are
to be affixed to walls or furniture (i.e. tape, staples, nails, etc.) are not permitted. The
Town of Tillsonburg will provide minimal decorations including a white tablecloth for
the signing of the marriage registry.

5. Changes to date and/or time are permitted at no additional charge, provided the
location and officiants are available and the request is received a minimum of two
business days prior to the originally scheduled date and time. An administration fee
of $50.00 will be applied should the Ceremony be cancelled prior to the scheduled
date. No refund will be issued if the Ceremony is cancelled on the day of the
Ceremony, or the Applicant(s) fail to appear for the Ceremony.
6. When a marriage ceremony is performed outside of the officiant's regular business
hours then the officiant receives $200 of the fee and the Town receives $100.00.
7. A ceremony may be conducted outside of Town limits on the discretion of the Town
Clerk. An extra fee, including mileage may be applied.

Civil Marriage Services Guidelines
1. Civil marriage ceremonies last up to 30 (thirty) minutes, depending on the vows chosen. The service
time booked would be approximately one (1) hour to allow for photo opportunities and use of an
interpreter if required.
2. A request for a civil marriage ceremony must be received a minimum of 14 days prior to the date of
the ceremony. The applicants are required to complete the Civil Marriage Booking Agreement and
pay the appropriate fee at the Town office. As well, applicants must complete a Pre Ceremony
Information Questionnaire and meet with the marriage officiant.
3. Two witnesses are required during the ceremony. Witnesses must be at least 14 years old and
speak English, or have a translator present. If no witnesses are available the Town may supply them
upon request. The cost is $25 per witness if required and this is only available for ceremonies
conducted in Council Chambers.
4. It is the Applicants' responsibility to provide an interpreter if they do not speak English and/or
require language assistance. The interpreter cannot be one of the witnesses. The interpreter shall be
required to sign a form confirming that he/she has interpreted the wedding ceremony.
5. The officiant has the authority to refuse to perform a marriage ceremony if anyone in the wedding
party (being the bride, groom and witnesses) appears to be under the influence of alcohol or drugs.

3:30pm. Ceremonies will not be conducted on days that Town Council meets (usually the 2"d and 41h
Monday of each month).
2. Officiants may conduct ceremonies at a different location, and/or outside of regular business hours
upon request. When the ceremony is held outside of business hours an alternative location must be
provided.
3. The Council Chambers will only be made available for a maximum of one hour per ceremony.
4. Music will be permitted at certain times throughout the ceremony, and is to be determined during
the pre-ceremony meeting. When selecting the type of music, consideration should be given to its
appropriateness and contribution to the dignity of the occasion. Music and an audio device must be
supplied if you wish to have music at the ceremony.
5. A maximum of 25 guests (not including the wedding party) can be accommodated in the Council
Chambers should this location be used for a civil marriage ceremony.
6. No candles, confetti, rice, or bubbles are allowed in the Council Chambers or on municipal property.

Frequently Asked Questions
1. What documents are needed for a civil marriage service?
Before meeting with the marriage officiant you should have completed and paid for your Ontario
marriage licence (valid for three (3) months following its date of issue), which you need to show the
officiant. You should have also completed the Pre-Ceremony Information Questionnaire and Booking
Agreement, which are both included in this package.
2. Who may officiate the wedding?
In the Town of Tillsonburg, the Clerk and Deputy Clerk are appointed officiants and may perform
wedding ceremonies.
3. Where will the wedding be located?
The ceremony takes place in Council Chambers, which is located on the 2"d floor of 200 Broadway. The
wedding officiants may go to other locations upon request. Please inquiry with the Town Clerk.
4. Can we get married on Saturday?
Yes. Weddings take place at the Town office from Monday to Friday during business hours. Officiants
may conduct ceremonies outside of regular hours upon request. When the ceremony is held outside of
business hours a location must be provided.
5. Does the Town offer "same day service" for a ceremony?
The Town does not offer same day ceremonies. Requests must be made and an pre-ceremony meeting
must be conducted a minimum of two weeks prior to the ceremony.
6. Do we have to purchase our Ontario License in Tillson burg to be married in Tillsonburg?
No, an Ontario License may be purchased anywhere in the Province of Ontario to be married anywhere
in the Province.
7. Are witnesses required for a civil marriage ceremony?
Yes, all couples require two witnesses present during the ceremony. Witnesses must be at least 14
years old and speak English, or have a translator present. If no witnesses are available the Town may
supply them upon request. The cost is $25 per witness if required and this is only available for
ceremonies conducted in Council Chambers.
8. May we include readings from the Bible or have a Blessing at our ceremony?
The marriage officiant may not perform any type of religious ceremony in keeping with the spirit of the
Ontario Marriage Act which requires civil ceremonies to be "non-denominational". The couple may
have someone other than the officiant provide a reading or a blessing.

WHEREAS pursuant to Section 8 of the Municipal Act,2001, S.D. 2001, C.25, a
municipality has the capacity, rights, powers and privileges of a natural person
for the purpose of exercising its authority under this or any other Act,

A BY-LAW to authorize the Sale of certain lands to 1767006 Ontario Inc.
WHEREAS pursuant to Section 8 of the Municipal Act,2001, S.O. 2001, C.25, a
municipality has the capacity, rights, powers and privileges of a natural person
for the purpose of exercising its authority under this or any other Act,
AND WHEREAS the Corporation of the Town of Tillsonburg is desirous of selling
certain lands described as Taylor Lane on Registered Plan 578, in the Town of
Tillsonburg, County of Oxford.
AND WHEREAS The Council of the Corporation of the Town of Tillsonburg has
determined that the said lands are surplus to the needs of the Corporation and
should be sold;
AND WHEREAS 1767006 Ontario Inc. has made a written offer to purchase
these lands at the Purchase Price of $12,512.00 plus HST.
BE IT THEREFORE ENCACTED by the Council of The Corporation of the Town
of Tillsonburg as follows:
1. THAT the Council of the Town of Tillson burg do authorize the conveyance of
lands shown on schedule A attached hereto and described as Taylor Lane on
Registered Plan 578, in the Town of Tillson burg, County of Oxford, at the
purchase price of $12,512.00, plus HST and all applicable disbursements and
legal costs;
2. THAT the Mayor and Clerk be hereby authorized to execute on behalf of The
Corporation of the Town of Tillson burg the Agreement of Purchase and Sale
and to take such steps and execute such documents under the seal of the
Corporation as may be necessary to affect such a conveyance.
3. That this by-Law shall come into full force and effect upon the date of
enactment.

A. Policy Statement
There is a need to provide civil marriage applicants with a clear set of guidelines on the
procedures of a marriage ceremony conducted by the Town of Tillsonburg.
B. Purpose
This policy will establish clear guidelines for officiants when preparing for and conducting
civil marriage ceremonies. Schedule A to this policy will be a Civil Marriage Package
designed to help the applicants prepare for the ceremony.
C. Scope
This policy applies to all civil marriages conducted by Town appointed officiants.
D. General
This policy shall be administered by the Clerk's Department.
This policy shall be referred to as the "Civil Marriage Ceremony Policy".
This policy comes into force and effect on the date adopted.
E. Authority
The authority for the Civil Marriage Ceremony Policy shall be by the approval of the
Council of the Town of Tillsonburg.

Location
1. Wedding Ceremonies are conducted in the Council Chambers, which is located on
the 2nd floor of 200 Broadway, Tillsonburg. Ceremonies are conducted Monday to
Friday between 9:30am and 3:30pm. Ceremonies will not be conducted on days that
Town Council meets (usually the 2nd and 4th Monday of each month).
2. Officiants may conduct ceremonies at a different location, and/or outside of regular
business hours upon request. When the ceremony is held outside of business hours
an alternative location must be provided.
3. The Council Chambers will only be made available for a maximum of one hour per
ceremony.
4. Music will be permitted at certain times throughout the ceremony, and is to be
determined during the pre-ceremony meeting. When selecting the type of music,
consideration should be given to its appropriateness and contribution to the dignity of
the occasion. Music and an audio device must be supplied if you wish to have music
at the ceremony.
5. A maximum of 25 guests (not including the wedding party) can be accommodated in
the Council Chambers should this location be used for a civil marriage ceremony.
6. No candles, confetti, rice, or bubbles are allowed in the Council Chambers or on
municipal property.
7. When using Council Chambers, minimal decorations are permitted (e.g. flowers,
balloons). They may be placed 15 minutes prior to the Ceremony and removed
within 15 minutes of the conclusion of the Ceremony. The use of decorations that are
to be affixed to walls or furniture (i.e. tape, staples, nails, etc.) are not permitted. The
Town of Tillsonburg will provide minimal decorations including a white tablecloth for
the signing of the marriage registry.

5. Changes to date and/or time are permitted at no additional charge, provided the
location and officiants are available and the request is received a minimum of two
business days prior to the originally scheduled date and time. An administration fee
of $50.00 will be applied should the Ceremony be cancelled prior to the scheduled
date. No refund will be issued if the Ceremony is cancelled on the day of the
Ceremony, or the Applicant(s) fail to appear for the Ceremony.
6. When a marriage ceremony is performed outside of the officiant's regular business
hours then the officiant receives $200 of the fee and the Town receives $100.00.
7. A ceremony may be conducted outside of Town limits on the discretion of the Town
Clerk. An extra fee, including mileage may be applied.

1. Civil marriage ceremonies last up to 30 (thirty) minutes, depending on the vows chosen. The service
time booked would be approximately one (1) hour to allow for photo opportunities and use of an
interpreter if required.
2. A request for a civil marriage ceremony must be received a minimum of 14 days prior to the date of
the ceremony. The applicants are required to complete the Civil Marriage Booking Agreement and
pay the appropriate fee at the Town office. As well, applicants must complete a Pre Ceremony
Information Questionnaire and meet with the marriage officiant.
3. Two witnesses are required during the ceremony. Witnesses must be at least 14 years old and
speak English, or have a translator present. If no witnesses are available the Town may supply them
upon request. The cost is $25 per witness if required and this is only available for ceremonies
conducted in Council Chambers.
4. It is the Applicants' responsibility to provide an interpreter if they do not speak English and/or
require language assistance. The interpreter cannot be one of the witnesses. The interpreter shall be
required to sign a form confirming that he/she has interpreted the wedding ceremony.
5. The officiant has the authority to refuse to perform a marriage ceremony if anyone in the wedding
party (being the bride, groom and witnesses) appears to be under the influence of alcohol or drugs.
Location
1. Wedding Ceremonies are conducted in the Council Chambers, which is located on the 2"d floor of
200 Broadway, Tillsonburg. Ceremonies are conducted Monday to Friday between 9:30am and
3:30pm. Ceremonies will not be conducted on days that Town Council meets (usually the 2"d and 4th
Monday of each month).
2. Officiants may conduct ceremonies at a different location, and/or outside of regular business hours
upon request. When the ceremony is held outside of business hours an alternative location must be
provided.
3. The Council Chambers will only be made available for a maximum of one hour per ceremony.
4. Music will be permitted at certain times throughout the ceremony, and is to be determined during
the pre-ceremony meeting. When selecting the type of music, consideration should be given to its
appropriateness and contribution to the dignity ofthe occasion. Music and an audio device must be
supplied if you wish to have music at the ceremony.
5. A maximum of 25 guests (not including the wedding party) can be accommodated in the Council
Chambers should this location be used for a civil marriage ceremony.
6. No candles, confetti, rice, or bubbles are allowed in the Council Chambers or on municipal property.

Frequently Asked Questions
1. What documents are needed for a civil marriage service?
Before meeting with the marriage officiant you should have completed and paid for your Ontario
marriage licence (valid for three (3) months following its date of issue), which you need to show the
officiant. You should have also completed the Pre-Ceremony Information Questionnaire and Booking
Agreement, which are both included in this package.
2. Who may officiate the wedding?
In the Town of Tillsonburg, the Clerk and Deputy Clerk are appointed officiants and may perform
wedding ceremonies.
3. Where will the wedding be located?
The ceremony takes place in Council Chambers, which is located on the 2"d floor of 200 Broadway. The
wedding officiants may go to other locations upon request. Please inquiry with the Town Clerk.
4. Can we get married on Saturday?
Yes. Weddings take place at the Town office from Monday to Friday during business hours. Officiants
may conduct ceremonies outside of regular hours upon request. When the ceremony is held outside of
business hours a location must be provided.
5. Does the Town offer "same day service" for a ceremony?
The Town does not offer same day ceremonies. Requests must be made and an pre-ceremony meeting
must be conducted a minimum of two weeks prior to the ceremony.
6. Do we have to purchase our Ontario License in Tillsonburg to be married in Tillsonburg?
No, an Ontario License may be purchased anywhere in the Province of Ontario to be married anywhere
in the Province.
7. Are witnesses required for a civil marriage ceremony?
Yes, all couples require two witnesses present during the ceremony. Witnesses must be at least 14
years old and speak English, or have a translator present. If no witnesses are available the Town may
supply them upon request. The cost is $25 per witness if required and this is only available for
ceremonies conducted in Council Chambers.
8. May we include readings from the Bible or have a Blessing at our ceremony?
The marriage officiant may not perform any type of religious ceremony in keeping with the spirit of the
Ontario Marriage Act which requires civil ceremonies to be "non-denominational". The couple may
have someone other than the officiant provide a reading or a blessing.

BEING A BY-LAW to confirm the proceedings of Council at its meetings held on the 2f!h day of

WHEREAS Section 5 (1) of the Municipal Act, 2001, as amended, provides that the powers of a
municipal corporation shall be exercised by its council;
AND WHEREAS Section 5 (3) of the Municipal Act, 2001, as amended, provides that municipal

and regular meeting held on January 28, 2013, with respect to every report, motion, by-law, or
other action passed and taken by the Council, including the exercise of natural person powers,
are hereby adopted, ratified and confirmed as if all such proceedings were expressly embodied
in this or a separate by-law.
2. The Mayor and Clerk are authorized and directed to do all the things necessary to give effect to
