RECOMMENDATION
THAT Council receives Report FIN 20-09 BIA COVID 19 Resolutions, as information;
AND THAT staff is directed to revise the 2020 Levy for the Tillsonburg BIA and reflect
this in the 2020 Tax Rates to be presented to Council in May 2 020;
AND FURTHER THAT Council select Option _____.
BACKGROUND
The Tillsonburg BIA has passed and sent 2 resolutions to Council that require some
direction from Council and further action from staff .
One is a motion to advise the Town of Tillsonburg Finance Department on BIA financial
management decisions.

And resolved that the Board of Management of the Tillsonburg BIA hereby
requests that the Town of Tillsonburg pays the full value of the 1st Quarter 2020
levy payment due to the BIA and further; the Board of Management directs the
town to reduce the 2nd Quarter levy payment by $11,620.83 from the original full-
year budget of $139,450. The BIA requests that the Town of Tillsonburg
reduces the 2nd quarter levy charge on the 2nd quarter tax bill to all BIA
assessed properties by the aggregate value of $11,62 0.83. This reduction
provides immediate relief to affected BIA properties for the month of April 2020.
The BIA Board of Management further requests confirmation of said resolution
contained herein and the subsequent decision by municipal council, forthwith.

Another motion was to request that the Town of Tillsonburg approve the reallocation of
the Façade Improvement Program funding to BIA retention programs including
emergency tenant relief & support.

And resolved that Board of Management of the Tillsonburg BIA; by unanimous vote;
hereby requests that the Town of Tillsonburg approves the reallocation of the Façade
Improvement Program unspent balance to be used for BIA retention programs in clude
emergency tenant relief & support.
Carried.
DISCUSSION
This request is difficult to manage, as it is written, however the Town can work to
achieve the desired results.
The first item of paying the BIA the first quarter levy is already done based on their 2020
levy. The first and second quarter levies were already invoiced in January base d on the
2019 levy. The due date for this is May 21, 2020 so there will be no payment required
in April. The reduction requested will reduce the third and fourth quarter payments
which are normally issued in July and the one month reduction in the BIA levy can be
calculated at that time. Some of this reduction has already been shared with BIA
members through the differential of the levy rate charged between the 2019 and the
2020 rates.
This program has been ongoing for several years in partnership between the Town and
the BIA. For 2020 the BIA requested that this funding level increase from $25,000 from
both parties to $31,000 and Council agreed to this. Council at its discretion may agree
to redirect these funds towards a program for assisting downtown business. This does
not change the taxation requirement of the budget. Council may be in agreement with
the concept of redirecting façade improvement funds to a retention plan however staff
would recommend that Council has final approval on such a plan.
Option A
That Council approves in principal the redirection of funding in the amount of up to
$31,000 from the joint Façade Improvement Plan with the Tillsonburg BIA to a joint
Retention Plan to assist downtown business as a result of the COVID 19 Pandemic
subject to final plan approval by Council. A final report on this plan should be submitted
to Council by the BIA for November 9, 2020.
Option B
That Council approves the redirection of funding in the amount of up to $31,000 from
the joint Façade Improvement Plan with the Tillsonburg BIA to a joint Retention Plan to

assist downtown business as a result of the COVID 19 Pandemic subject. A final report
on this plan should be submitted to Council by the BIA for November 9, 2020.
CONSULTATION
The Mayor and Staff are part of the COVID-19 Business Recovery Task Force working
on several retention programs. The Chief Building Official (CBO) was consulted.
FINANCIAL IMPACT/FUNDING SOURCE
There is no financial impact to the Town on these items however on the second item , up
to $31,000 in matching funds, will not be spent on Façade Improvement this year and
will need to be reviewed as part of future year’s budgets. The CBO has indicated that
there have been no approved applications under the Facade plan in 2020.

THE CORPORATION OF THE TOWN OF TILLSONBURG
BY-LAW 2020-034
BEING A BY-LAW to confirm the proceedings of Council at its meeting held on
the 30th day of March, 2020.
WHEREAS Section 5 (1) of the Municipal Act, 2001, as amended, provides that the
powers of a municipal corporation shall be exercised by its council;
AND WHEREAS Section 5 (3) of the Municipal Act, 2001, as amended, provides that
municipal powers shall be exercised by by-law;
AND WHEREAS it is deemed expedient that the proceedings of the Council of the
Town of Tillsonburg at this meeting be confirmed and adopted by by-law;
BE IT THEREFORE ENACTED by the Council of the Corporation of the Town of
Tillsonburg as follows:
1. All actions of the Council of The Corporation of the Town of Tillsonburg at its
meeting held on March 30, 2020, with respect to every report, motion, by-law, or
other action passed and taken by the Council, including the exercise of natural
person powers, are hereby adopted, ratified and confirmed as if all such
proceedings were expressly embodied in this or a separate by-law.
2. The Mayor and Clerk are authorized and directed to do all the things necessary to
give effect to the action of the Council of The Corporation of the Town of Tillsonburg
referred to in the preceding section.
3. The Mayor and the Clerk are authorized and directed to execute all documents
necessary in that behalf and to affix thereto the seal of The Corporation of the Town
of Tillsonburg.
4. This by-law shall come into full force and effect on the day of passing.
