B. Appointment of Chair for Meeting
D. Morris assumed the Chair on consent from the members present and
called the meeting to Order.
C. Issues of Joint Venture Agreement
1. Actions Required
i) Election of Chair/Vice-Chair
Moved by Max Stewart and Seconded by Bob Smith:
'That Sam Lamb, Councillor, Tillsonburg be nominated for the position
of Chair of the Board of Management for the Otter Valley Utility
Corridor and Recreation Trail Committee.'
Carried.
Moved by Sam Lamb:
'That Cliff Evanitski, Councillor, Municipality of Bayham be nominated
as Chair of the Board of Management for the Otter Valley Utility
Corridor and Recreation Trail Committee.'
This recommendation failed as there was no Seconder to the
recommendation.

Moved by Jack Petrie and Seconded by Bob Smith:
'That Cliff Evanitski, Councillor, Municipality of Bayham be nominated
to the position of Vice-Chair of the Board of Management for the
Otter Valley Utility Corridor and Recreation Trail.'
Carried.
ii} Appointment of Secretary and Treasurer
Board of Management appointed Lynn Buchner, Administrator/Treasurer,
Municipality of Bayham as Treasurer and Brad Bartlett, Deputy Clerk
Town of Tillsonburg as Secretary.
iii} Accounting, Bank Accounts, Budgeting & Auditing, Year End
& Reserve Accounts
Moved by Bob Smith and Seconded by Jack Petrie:
'The Board of Management of the Otter Valley Trail Committee agreed
that an operating Bank Account would be set-up and that each
municipality would contribute $500.00 for current year expenditures;
And Further That for accounting purposes the fiscal year would be the
calendar year.'
Carried.
The Board of Management agreed that there would be no need for a
separate 1998 year end audit.
iv} Meeting Schedule
The Board of Management agreed that the meetings of the Committee
would be set as the 4th Tuesday of each month at 8 a.m. and the
meeting location would be rotated between Tillsonburg and the
Municipality of Bayham.
The Board of Management set the next meeting of the Committee at
8:00 a.m. on November 3, 1998 at the Municipal Offices in
Straffordville due to a schedule conflict with the members from
Tillsonburg.
2. Items For Future Meetings
i} Media and Communications Strategy
The Board of Management decided that the Chair would be the media
contact.

The Board of Management discussed the opportunity to develop a logo
with the public for the purpose of recognition and promotion of signs
for the corridor.
ii) Communications -Otter Trail Association
-Groom & Szorenyi, Barrister
Received. The Board of Management directed staff to contact interested
agencies to discuss the corridor and other activities and concerns
related to its management and invite them to the meeting scheduled for
7:30 p.m. on November 24, 1998. All communication with the Board of
Management from the interested groups would be in writing. The Board
directed staff to invite Bryce Sibbick, Frank Cowan Insurance Company
to the next meeting to address risk management of the property.
iii) Land Issues -Gregson Property & Moore Property
Received.
D. Round Table
Persons in the audience were invited to address the Board of
Management by the Chair.
Allan Spicer, Ratepayers of Bayham stated that he was encouraged by
the efforts of the two member municipalities.
George Allen, Ratepayers of Bayham stated that he was an observer.
Jeff Kleizeverink, Otter Ridge Dirt Riders stated that his group could
assist the Committee with identifying and solving 'hot spots' on the
corridor. He stated that contact with the group could be made through
Chris Shaw, Secretary of the Otter Ridge Dirt Riders.
Ron Chatten, Ratepayers of Bayham stated that landowner issues should
be addressed along with corridor management practices.
The Board of Management directed that the November 3, 1998 meeting be
held to discuss liability issues with the municipal insurers, Frank
Cowan Company Limited.
The Board of Management directed that the November 24, 1998 meeting be
held at 7:30 p.m. to discuss submissions from the interested groups.
The Board of Management directed that a copy of the Master Plan and
the last years minutes be circulated to all members of the Committee.
Max Stewart stated that he looks forward to Association assistance
with management of the corridor.

Jack Petrie stated that landowner issues must be addressed and that a
Fundraising Committee should be struck by the Board of Management with
assistance and ideas from the interested groups.
E. Next Meeting Date
The next meeting of the Board of Management was set for November 3,
1998 at 8 a.m. in Straffordville.

At their regular meeting held October 1, 1998, Council of the Municipality of Bay ham
received the draft minutes of the September 29, 1998 meeting of the Otter Valley
Recreation Trail & Utility Corridor Management Committee. As a result the following
resolution was passed:
"THAT the Draft minutes of the Otter Valley Recreation Trail and Utility
Corridor Management Committee meeting held September 28, 1998 be
received;
AND THAT the Committee be advised that the Council of the Municipality of
Bayham supports the contribution of $500. by each participating municipality,
to an operating bank account specifically for the Committee, for 1998
expenditures."
Disposition: Carried unanimously
Further, I will open an operating account in the Straffordville Branch of the Canadian
Imperial Bank of Commerce by depositing a sum of $500 from the Municipality of
Bayham. I anticipate that the Town's share will be forthcoming and would ask that the
cheque be made payable to Otter Valley Trail.

Re: otter Valley Utility Corridor and
Recreation Trail
I am the Solicitor for Wayne and Sandra Casi er, the owners
of Lot 17, Concession 4, Township of Bayham (South of County
Road 45) amongst other land. The Otter Valley Utility Corridor
and Recreation Trail travels through their property, which leads
to a number of concerns for them as follows:
1. Wayne and Sandra easier have had access across the
former C. P. Rail lands to their adjoining lands for farm
equipment. Will Wayne and Sandra easier continue to have
access across the Otter Valley Utility Corridor and
Recreation Trail to take farm equipment to their adjoining
lands?
2. Wayne and Sandra Casi er, along with all other farmers,
have concerns about their ability to continue their normal
farming practices. As you are aware, at certain times
normal crop practices include the spraying of the crop
with insecticides, which are, of course, harmful to humans.
As the Otter Valley Utility Corridor and Recreation Trail
is a change in use, we would expect that our right to farm
and use normal crop practices to continue, and the Trail

users should satisfy themselves that the conditions are
safe for their own health.
3. As this is clearly a change in use from a railway to
a public trail, we would expect that a zoning change and
perhaps an official plan amendment are necessary. Are
there any plans for these changes?
4. The Trail introduces the public onto our farms with
the possibility of vandalism, etc. We would expect that
the trails should be fenced along both sides to keep the
public on the trail and off the adjoining land owners'
property. Has this issue been addressed?
I would appreciate it if you could forward your response
to me as soon as possible.

Former CP Rail Lands

Background Comments
On Friday, June 19th, Robert Gregson visited the municipal office regarding access to a 25.39
acre parcel located on the east side of the former CP Rail land, south of Alward Street. Both Mr.
Gregson and the previous owner gained access to this lot from the 75.96 acre parcel (Roll 004-
028) west of the former CP Rail land which is subsequently access via a 149.03 acre parcel (Roll
003-109) from the south with frontage on Jackson Line. He advised that no agreement with CP
Rail was in place, however, he paid a $75.00 insurance fee for liability purposes.
Mr. Gregson is now concerned that the plans for the former rail lands to be utilized as a
recreation trail will cut off his only access. Additionally, he is concerned about the security of
his property with the increasing use of the former rail lands.
From viewing the assessment maps attached, it would appear that the following options could be
investigated:
Option No.1
Discussions with the Town ofTillsonburg regarding a legal easement agreement to ensure Mr.
Gregson has legal access to the subject parcel at its existing point of entry from Part Lot 125,
Concession STR (Roll No. 004-028).
Option No. 2
Investigate the feasibility of extending Alward Street in Straffordville. However, Alward Street
has not yet been legally assumed as a public highway by by-law. Further, it would appear that
extending the road would be complicated by the placement of the parcel with Roll No. 004-34-02
on the south side of Alward Street, east of the former rail land.

This matter is presented to Cowicil for further direction.

"THAT Staff Report 98065 be received and that staff be directed to discuss with the Town
of Tillsonburg the options available to Mr. Robert Gregson for access to Part Lot 126,
Concession STR (Roll No. 004-030) and report back to Council accordingly."

I have read the trail books from the The Conservation Authorities of
Ontario that you passed on to me last month.
It looks as if the Trans Canada Trail is nearing the Town of
Tillsonburg and onto the Otter Valley Trail.
I have contacted the Long Point Conservation Authority, Mr. Jim
Oliver, General Manager and he will require payment of $32.00.
Please direct this request through the Board of Management.
