He noted that he had not had an opportunity to discuss this amendment with the Planner,
and asked that this amendment be incorporated into the proposed by-law.
The amended by-law will be brought forward January 28th for discussion and
consideration.
In the interim, confirmation is required that the BIA did not have any comment, through
resolution or debate at their meeting. Comment was made that there is potentially vacant
space in the downtown core.

approve the application by Lyle Buchner to rezone the subject lands from 'Highway
Commercial (C2)' to 'Special Highway Commercial (C2-32)' to allow for a pet store;
AND RESOLVED FURTHER THAT the property owner obtain Site Plan Approval from the
Town of Tillsonburg concerning the provision of a paved access to the loading space and
for an additional 6 spaces to be provided along the southerly side of the building.

4. Pesticide Public By -Law
Presented By: CAO, in the absence of the Director of Corporate Services

Discussion was held and the following comments were noted, to be forwarded to the
Director of Corporate Services.
The CAO advised that the Director has been contacted by a Ministry staff person who is
+, willing to offer her services by coming to Tillsonburg and speaking on what the Province
is planning to do with respect to pesticides. The Province will take action prior to 2009.
The CAO recommended to Council that they receive the information the Ministry is able to
provide.
It was noted that, given the subject by-law, as drafted, is not going to be implemented
until January 2009, we do have time.
The Mayor added that the intent from the Ministry staff person is not to make a decision
for the Town, but rather to educate us in ways to make us successful in what we do.
Councillor Stephenson requested the by-law be given first and second reading this date,
then listening to what the Ministry person has to say.
Councillor Lamb noted that Council members have not reviewed the by-law together, and
he would like that to be done before the by-law receives first and second reading, at a
later date.
Mayor Molnar noted that the intent was for first and second reading this date, however
variance from that is based on the author's absence.
Councillor Beres questioned if we could make a list of questions available for the Ministry
person to respond to. He suggested there be opportunity for individuals to forward their
questions.
Deputy Mayor Renaud commented that he would like to see at least first reading of the
by-law.

THAT the Council for the Town of Tillsonburg confirms it is in both a legal and legislated
position to enact a by-law to control the cosmetic use of pesticides on nonagricultural
property within the municipality, and further;
THAT Council request the deputation of a representative of the London branch of the
Ministry of Environment - Pesticides Specialist, to speak at a future meeting of Council as
a delegation, and further;
THAT the comments received on the date of January 14, 2008 be forwarded to the
Director of Corporate Services for preparation of a supplemental report including an
amended by-law subsequent to the above referenced meeting with the representative of
the Ministry of the Environment.
