THE CORPORATION OF THE TOWN OF TILLSONBURG
BY-LAW NUMBER �.
A BY-LAW to authorize construction of concrete
CURB AND GUTTER as set out in Schedule "A" as
a local improvement under The local
Improvement Act, R.S.O. 1990, Chapter L.26,
Section 7, Subsection 1(d)..
i WHEREAS the Council has caused to be made, reports of the cost of
construction of the works more particularly set out in Schedule "A"
hereto attached.
AND WHEREAS it has been found by the reports that the cost of the
said construction of:
(a) Concrete curb and gutter is estimated to be $15, 000.00 of
which $4,430.00 is to be paid by the Corporation; with
$10,570.00 assessed by a special rate to properties
abutting on the works.
AND WHEREAS the lifetime of the said works is at least ten years.
AND WHEREAS it is desirable that the said works be undertaken as a
Local Improvement.
AND WHEREAS Notice of application to The Ontario Municipal Board
for approval for the works was published in the Tillsonburg News on
the 16th day of September, 1998 and also sent by prepaid first
class mail on the 14th day of September, 1998 to all parties as
listed on the last revised assessment roll whose properties will be
specially assessed.
AND WHEREAS it is deemed expedient for the said purpose to borrow
for the financing of the owners' position of the said works, a sum
up to but not exceeding $10,570.00 upon the credit of the
Corporation by the issue of debentures.
BE IT THEREFORE ENACTED by the Council of the Corporation of the
Town of Tillsonburg as follows:
1. (a) THAT the works as set out in Schedule "A" and hereto
attached be constructed as a Local Improvement at the
cost of $15,000.00.
(b) THAT Schedule "A" attached hereto is hereby declared to
be a part of this by-law as if written and incorporated
herein.
2. THAT the cost of the construction of the said works shall be
specially assessed by an equal rate per meter frontage against
the owners of real estate abutting directly on the said works.
3. THAT the construction of the said works shall be carried out
and executed in accordance with the plans, profile and
specifications as set forth in the report of the Engineer and
the said works and construction shall be carried on and
executed under the supervision and according to the directions
and orders of the Engineer, C.J. Demeyere, P.Eng.
4. THAT the Mayor and Clerk be and are hereby authorized to call
tenders and cause a contract for construction of the work to
be made and entered into with some person, persons, firm or
corporation subject to the approval of this Council to be
declared by resolution.

5. THAT the Treasurer may agree and arrange with any bank or
person for temporary advances of money to meet the costs of
the work pending the completion of it.
6. THAT special assessments shall be levied in the year following
completion of the work.
7. THAT the special assessments shall be paid in ten annual
instalments.
8. ANY person whose lot is specially assessed may commute for
payment in cash, the special rates imposed thereon by paying
the portion of the cost of construction asses$ed upon such
lot, without interest, forthwith and not more than thirty-one
days after the special assessment roll has been certified by
the Clerk.
9. FOR the purpose of aforesaid, the Corporation may borrow upon
the credit of the Corporation a sum not exceeding $10,570.00
by way of the issue of debentures.
10. THE debenture to be issued for the loan shall be for the
amount required to pay the temporary borrowing pursuant to
paragraph 5 hereof after applying any payments made on behalf
of the owners specially assessed and shall bear interest at
such rate as the Council may determine and the said debenture
interest and principal shall be made payable within ten years
on the instalment plan.
11. (a) THAT there shall be raised, in each year, in which an
instalment becomes due, by a special rate on all the
rateable property in the municipality, a specific sum
sufficient to pay the said instalment when and as if
becomes due, but no greater rate shall be levied in any
year, for such purposes, than is required to pay the
instalment after taking into account receipts from the
special rate, provided in Clause (b) hereof, or from any
other sources in respect of the said work.
(b) FOR the payment of the owners' portion of the cost and
interest thereon, the special assessment set forth in the
special assessment roll is hereby imposed upon the lands
liable therefore as therein set forth, which said special
assessment with a sum sufficient to cover the interest
thereon at the rate aforesaid, shall be payable in ten
equal annual instalments and for that purpose the special
lots entered in the special assessment roll, according to
the assessed frontage thereof, over and above all other
rates and taxes, and the said special rates shall be
collected annually by the collector of taxes for the
Corporation at the same time and in the same manner as
other rates.
12. THIS by-law shall come into full force and effect on the date
of approval by the Ontario Municipal Board.

BY-LAW'
A BY-LAW to amend By -Law 2858
being a by-law to raise by assessment the
amount of money required for all
purposes for the year 1998.
WHEREAS it is necessary to establish instalment dates for rates levied pursuant to
By -Law 2858 passed by the Council of the Town of Tillsonburg on the 27`s day of
July, 1998.
BE IT THEREFORE enacted by the Council of the Town of Tillsonburg as
follows:
That paragraph 5 of By -Law 2858 be amended as follows:
5. There shall be deducted from the rates levied under clauses 2 and 3
above, any interim rates levied pursuant to By -Law 2830 and the amount
remaining unpaid may be paid in two instalments:
first instalment due — October 30'', 1998
second instalment due — November 27`x', 1998
2. This By -Law shall come into full force and effect upon enactment.
