PURPOSE:
The purpose of this application is to seek the following variances► to Tillsonburg zoning By -Law 1994, as
amended to recognize an existing location of a pump house for a pool in the interior side yard:
Relief from Section 6.3.6 2.1, to reduce the setback from the top of the bank from the required 7.5 metres (24.6
feet) to 2.4 metres (8 feet),
Relief from Section 5.2.5, Permitted in Interior Side Yard; to reduce the interior side yard from the required 1.2

This property is the subject of a consent for severance application (number B-95199) to add a portion of the
neighbouring property so that the pump house will no longer be over the property line.
The Committee of Adjustment may authorize a variance to the Tillsonburg Zoning By -Law 1994 with respect to
land, buildings and structures or the uses thereof provided that in their opinion it is desirable and appropriate
development for that land, building or structure and that it does not adversely effect the Tillsonburg Zoning By
—Law or Oxford County Official Plan.
Before making its decision, the Committee of Adjustment will hold a Public Hearing to consider submission in
favour or in opposition to the applied for minor variance from interested persons.

BACKGROUND

Adjacent Uses: single -detached dwellings (west, east & south), Stoney Creek ravine
(north)
Proposal: The applicant wishes to recognize an existing brick pool shed which
encroaches into the required interior side yard and required setback from
the top of the ravine bank.
Additional The pool shed currently encroaches onto the neighbour's property to the
Information: east. The shed may have been built on the neighbour's property as the
existing fence does not follow the property line. To address this
encroachment, the neighbouring property owner to the east has
submitted an application for severance to permit a small boundary
adjustment between the two properties.
Although the application for severance Will ensure the pool shed is wholly
contained on the applicant's property, the shed will still not meet the
minimum side yard and setback requirements. This minor variance
application is intended to recognize these deficiencies.
The size of the boundary adjustment could be increased to ensure the
minimum side yard is maintained, however, both property owners have
indicated that they want the proposed property line to follow the existing
fence.
Requested Relief: 1) Relief from section 5.2.5, Accessory Uses - Permitted in Interior Side
or Rear Yard, to reduce the interior side yard from the required 1.2 m
(3.9 ft.) to 0.3 m (1 ft.)
2) Relief from section 6.3.6.2.1, Setback from Top of Bank, to reduce
the required setback from the top of the ravine bank from required
7.5 m (24.6 ft.) to 2.4 m (8 ft.).

COMMENTS
Intent and Purpose In compliance
of Official Plan:
Intent and Purpose The purpose of the interior side yard provision for accessory structures in
of Zoning By -Law: a residential zone is to provide area between the structure and the
property line for maintenance and drainage, and to provide separation for
privacy. Although the proposed 0.3 m (1 ft.) side yard will not provide a
great deal of room for maintenance or drainage, the distance between the
existing fence and the pool shed will not change. Our Department is not
aware of any drainage or maintenance issues which have arisen as a
result of the shed's location.
The Town Zoning By-law states that no construction or buildings shall be
located within 7.5 m (24.6 ft.) of the top of the bank as defined by the
Long Point Region Conservation Authority (LPRCA). This application has
been circulated to the LPRCA for comment. To ensure the requirements
of the LPRCA are met, we would recommend that the approval of this
application be conditional upon the receipt of comments from the LPRCA.
Extent of Variance: The variances are minor
Desirable This neighbourhood is characterized by other single -detached dwellings
Development/Use and the recognition of an accessory pool shed would not be out of
character for this area.
Recommendation: That the Tillsonburg Committee of Adjustment move application
A-19/99 for 7 Hampton Court, subject to the following conditions:
(1) That the applicant obtain a building permit for the pool shed
within a year of the date of the Committee's decision or the
Committee's decision will lapse.
(2) That the Secretary -Treasurer receive a letter from the Long
Point Region Conservation Authority indicating that it has no
objection to the application.

APPLlcAT1oN REVIEW:
(a) Proposal and Background
An application for Official Plan Amendment has been submitted to complete the
redesignation of a block of land bounded by North Street, Tillson Avenue, the Canadian National
Railway,. and the Canadian Pacific Railway from 'Industrial' to 'Low Density Residential' and
'Highway Service Commercial'.
The entire block was originally designated for industrial purposes when the County of
Oxford Official Plan was approved in 1996. However, at its meeting of July 14th, 1999, Oxford
County Council approved Official Plan Amendment No. 29 for an application submitted by Edwin
and Ewart McLaughlin to redesignate two parcels of land within the block from 'Industrial' to 'Low
Density Residential'. Amendment No. 29 was approved to permit the development of a residential
draft plan of subdivision.
As stated previously, the approval of this application will permit the western portion of this
block to be redesignated to 'Low Density Residential' and the northeastern corner to be
redesignated to 'Highway Service Commercial'.
At the time of consideration of the application submitted by Edwin and Ewart McLaughlin,
our Department recommended that the entire block be redesignated for low density residential
purposes. However, both Tillsonburg Town Council and Oxford County Council approved the
redesignation of only those lands which were subject to the draft plan of subdivision. However,
Tillsonburg Town Council agreed that a second application for Official Plan Amendment would be
submitted for the remaining lands within the block.
This application affects three parcels. The westerly parcel is owned by Nancy Macrae and
is to be redesignated for low density residential purposes. It should be noted that the draft plan of
subdivision on the McLaughlin property allows for the extension of the street into the parcel of land
owned by Ms. Macrae.
The two parcels of land in the northeast comer of this block are to be redesignated to a
highway service commercial designation. One of these parcels contains Danbrook Automotive,
a public garage, while the property on the southwest corner of North Street and Tillson Avenue
currently contains a single detached dwelling. The owner of Danbrook Automotive also owns the
single detached dwelling and he has requested that the corner property be redesignated to a
highway service commercial designation.
Plate 1, Existing Zoning, indicates the location of the subject property as well as the existing
zoning in the immediate vicinity. Lands directly south of the subject property contain the Canada
Southern Railway while lands further to the south across the railway contain the TDS Warehouse
property. Lands to the north and east contain low density residential development while lands to
the west contain low lying lands surrounding the creek and Canadian Pacific Railway.

Plate 2, Existing Official Plan, indicates the existing Official Plan designations in the
immediate vicinity. Lands to the east and north are designated for low density residential purposes
while lands surrounding the creek to the east are designated Open Space. Lands further to the
south across the railway tracks are designated for industrial purposes.
(b) Official Plan
The subject properties are designated 'Industrial' on the Land Use Plan for the Town of
Tillsonburg in the County of Oxford Official Plan. The industrial designation permits the full range
of industrial type activity including light, medium, and heavy intensity uses. As stated previously,
this application proposes to redesignate the westerly portion to 'Low Density Residential' while the
easterly properties are to be redesignated 'Highway Service Commercial'. The Official Plan states
that prior to considering proposals to redesignate industrial land for non -industrial purposes, Town
Council and County Council shall require that the following criteria have been met:
"• any proposal to redesignate industrial lands is located adjacent to compatible land
uses and does not have the effect of redesignatiog isolated parcels surrounded by
industrially designated lands,
• there is an adequate supply of unconstrained industrial land with a variety of lot sizes
to meet the needs of industry over the planning period;
• there is an adequate supply of immediately serviceable industrial land,
• there is sulticient land available in proximity to major transportation facilities including
railway facilities, major highways and arterial roads in the Town;
• them are industrial locations which provide visibility and public exposure to the major
road system in the Town for industries and businesses desiring such locations;
• the re -use or redevelopment of existing industrial buildings or sites for non -business
uses will be significantly more compatible with adjacent land uses."
The Official Plan discourages the redesignation of a pocket of industrial land if it is to
continue to be surrounded by other industrial uses. In this instance, the entire block bounded by
the two railways, North Street, and Tillson Avenue was previously designated for industrial
purposes. With the recent approval of Amendment No. 29, the middle of this block is now
designated for residential purposes. It is the opinion of this Department that the redesignation of
the parcels under this application will ensure that pockets of industrial land are removed from this
block.
All of the lands to the north of the Canada Southern Railway in the northeast comer of the
Town of Tillsonburg, with the exception of this block, are designated for residential purposes. It is
the opinion of this Department that the Canada Southern Railway forms an appropriate southern
boundary to create a new area for residential growth and development. Lands to the south of the
railway contain an existing industrial operation which presumably will continue to be used for
industrial purposes for a number of years.
An industrial land supply inventory was not completed as part of this planning analysis,
however, we have not been advised by Town staff that the elimination of 2.1 ha (5.1 ac) of
industrially designated land will negatively impact the inventory of industrial land available within
the Town of Tillsonburg.

In general terms, industrial operations within the Town of Tillsonburg are locating within the
southern part of the community. The northern area of the Town in proximity to the subject
properties is generally being used for residential purposes.
(c) Zoning By -Law
The subject property is zoned 'General Industrial (M2)'. No application for lone change has
been submitted with this application. Should this amendment be approved, our Department would
recommend that the zoning on these properties be changed during the review of the Town's
Comprehensive Zoning By -Law.
(d) Agency Comments
The Town Director of Corporate Services has indicated that the Town of Tillsonburg
supports the application.
CN Rail has indicated that it has reviewed the application and requests that the following
policies be included in the Official Plan Amendment:
"1. Any proposed development will be required to undertake noise and vibration studies
to the satisfaction of the Town, the Ministry of the Environment in consultation with
the appropriate railway, and shall undertake appropriate measures to mitigate any
adverse effects from noise that were identified.
2. Development adjacent to railways shall ensure that appropriate safety measures
such as setbacks, berms, and security fencing are provided, to the satisfaction of the
Town in consultation with the appropriate railway."
The Tillsonburg Public Utilities Commission has indicated that it has no objection to the
application. However, the owner or his agent shall consult with the PUC early in the design stages
to ascertain the availability or requirements as well as financial conditions of both hydro and water
servicing for the development. The PUC states that if relocation of electrical and/or water plant is
required due to construction, the owner shall bear all costs associated with the said relocation. The
PUC also requests that the applicant grant such easements as may be required for utilities to the
appropriate authority.
The remaining responding agencies consisting of Oxford County Board of Health, the
Ministry of Municipal Affairs and Housing, the County Director of Public Works, Union Gas, Long,
Point Region Conservation Authority, the Chief of Police, Bell Canada, and the Town Economic
Development Officer the had no objections to or comments with this application.
(e) Planning Review
This application proposes to complete the redesignation of lands contained within the block
surrounded by Tillson Avenue, North Street, the Canadian Pacific Railway, and the Canada
Southern Railway. Two parcels within this block were previously redesignated for low density
residential purposes to permit the development of a residential plan of subdivision. This application

will redesignate the remaining parcels to a low density residential designation and a highway
service commercial designation.
The westerly parcel is to be redesignated for low density residential purposes and will permit
the extension of the proposed street within the adjacent draft approved plan of subdivision. The
highway service commercial designation will recognize the existing public garage and permit the
possible expansion of this use or a new highway commercial use on the property containing the
single detached dwelling on the southwest comer of North Street and Tillson Avenue.
It is the opinion of this Department that this application would address the Official Plan
criteria which Town Council and County Council are to ensure are addressed prior to the
redesignation of industrial land. The application will eliminate pockets of industrial land and will
provide a larger area of more compatible types of development. No concerns were raised during
the agency circulation and it is the opinion of this Department that the application should be
supported.
It is recommended that Council of the Town of Tillsonburg recommend to Oxford County Council
that it approve the application for Official Plan Amendment submitted by the Town of Tillsonburg
for lands owned by Nancy Macrae and John Danbrook, whereby lands located in Part Lots 67 and
68, Judge's Plan registered as Plan 500, in the Town of Tillsonburg are redesignated from
'Industrial' to 'Low Density Residential' and 'Highway Service Commercial'.

APPL[CATION REviEw:
(a) Proposal
Applications for Official Plan Amendment and Zone Change have been submitted to the
Town of Tillsonburg and the County of Oxford to redesignate lands from `Low Density Residential'
to `Restricted Service Commercial' to recognize the existing uses in a commercial building which
include business and professional offices and a television studio. The applicant's solicitor has
indicated that several of the offices are currently vacant. The other offices are occupied by smaller
businesses and professionals.
The application for zone change proposes to rezone the property from `Restricted Industrial
(l1i11)' to a special 'Highway Commercial (C2-Special)' to recognize the existing uses. This building
has been situated on this corner for a number of years and has had a variety of previous uses
including Jackson's Bakery, the Tillsonburg News and a Roger Cable television studio.
The applicant's solicitor has indicated that the building has a gross floor area of 817.5 m2
(8,800 ft.2), with 657.7 m2 (7,080 ft.2) of the building used for offices and 159.8 m2 (1,720 ft.2)
occupied by Rogers Cable.
Plate 1, Existing zoning, indicates the location of the subject property as well as the existing
zoning in the immediate vicinity. Lands to the north contain the Free Methodist Church as well as
Annandale School. Lands to the west and south contain low density residential development.
Plate 2, Agplicant'g Sketch, is a site plan submitted with the application showing the building
location and parking.
(b) Official Plan
The subject property is currently designated for low density residential purposes on the
Residential Density Plan for the Town of Tillsonburg in the County of oxford Official Plan. Although
the Official Plan states that "Neighbourhood Serving Uses" such as schools and churches may be
permitted within residential areas and that limited non-residential uses such as health care offices
and clinics, funeral homes, small scale nursing and rest homes, retirement homes, and recreational
uses may also be permitted in residential areas, the uses proposed by the applicant are not
Permitted within a residential designation.
Therefore, the applicant has requested that the subject property be redesignated to a
Restricted Service Commercial designation. The Official plan states that uses within the Restricted
Service Commercial designation will caterto an auto -oriented trade or will serve adjacent residential
neighbourhoods. The Official Plan includes a list of uses which are to be included within the
Restricted Service Commercial designation. These uses include convenience commercial uses,
Personal business services, laboratory, medical or dental clinics, video rental establishments,
service and repair establishments, restaurants, commercial recreational establishments, studios,
small scale AAces, automobile service stations, gas bars, car wash facilities, retail sales of
automobile supplies, and financial institutions.

The Official Plan does contain policies which address the addition of a new Restricted
Service Commercial designation. The Official Plan states that these additions will be evaluated
based on the following criteria;

COMPATIBILI7Y - The compa6br7ity of the proposed uses) or development with surrounding
land uses.
IMPACT - The likely effect of the proposed develo
land uses in the vicinity, prnent on the ability to implement planned
• MUNICIPAL SER VICES - The availabr7ity of utilities and sewer and water facilities to service
the site.
• LOCATION AND ACCESS - The location and access requirements of Sections 8.3.3 21 and
t3 3.3 2.2.
POLICY INTENT - Consistency with the policies of Section 8.3.3_ 2 relating to the description
of Service Commercial.
• TRAFFIC - The potential effect of traffic from the ro
public road proposed Service Commercial area on the
system and on surrounding land uses_
• ENVIRONMENT - The effect on environmental features and the effect of environmental
constraints on the proposed development as outlined in Section 32."
Based on our review of these criteria, it is the opinion of this Department that the addition
of a Restricted Service Commercial designation in this area would be appropriate. The existing
design and layout of the building does not lend itself to low density residential development and the
Property is surrounded by institutional development on both the north and east side_ In addifion, this
property has been used for commercial purposes for a number of years and our Department is not
aware of any negative impacts from this commercial operation.
Our Department is not aware of any servicing or traffic constraints which would restrict the
use of this property for commercial purposes. Therefore, it is the opinion of this Department that
the proposed amendment to add a Restricted Service Commercial designation on this property
would be appropriate.
(c) Zoning By -Law
The subject property is zoned `Restricted Industrial (Ml y. The applicant has requested that
the property be rezoned to a special `Highway Commercial (C2-Specialy. The Town of Tillsonburg
Zoning By -Law has not yet been updated to include a new zone for the Restricted Service
Commercial designation which was introduced to the County of QXford Official Plan in 1996.
Therefore, the special zoning that has been requested by the applicant will permit the uses which
are intended to be included within the Restricted Service Commercial designation.
rllsonburg Town Council has reviewed other applications for properties located within the
Restricted Service Commercial designation. Under these applications, the Council approved a list
of permitted uses for the properties.
As stated previously, the Restricted Service Commercial designation permits small scale
offices. As Council is aware, the downtown core is intended to accommodate the majority of office

uses with the exception of small scale offices permitted within the Restricted Service Commercial
designation. In this case, offices occupy approximately 657 sq m (7,080 sq ft) of the entire building.
The Official Plan states that only small scale offices are permitted outside the downtown
core, and only within the Restricted Service Commercial designation. Therefore, our Department
would recommend that offices be limited to 185.8 rn2 (2,000 ft.2 of the entire building. In previous
applications within the Restricted Service Commercial designation, Town Council has limited office
space in these special zonings to 185.8 m2 (2,000 ft.Z) to ensure the office space remains small
scale. The remainder of the building could then be used for uses permitted within the Restricted
Service Commercial designation.
The existing parking provided on site is also deficient in terms of the number of parking
spaces required for offices. 37 parking spaces are required if 657 m2 (7,080 ft.2) of the building is
used for offices. An additional 5 spaces would be required for Rogers Cable. The subject property
ro
only has 15 on -site parking spaces. This deficiency in parking would have to be addressed through
the special zoning requested for the property.
(d) Agency Comments
The Till nbur ubli Lifilities COM ission has indicated it has no objection to the
application as long as there are no charges for hydro and water services.
The remaining responding agencies consisting of Ministry of Municipal Affairs and Housing,

1920's with a number of additions over the years and has been used for a variety of commercial
purposes over the past years.
It is clear that this property has not been used for industrial purposes since the Tillsonburg
News sold the property in 1978 and it is the opinion of this Department that the redesignation of the
Property to a Restricted Service Commercial designation conforms to the criteria contained in the
Official Plan used to evaluate such redesignations.
The Zoning By -Law Amendment requested for this property will implement the policies of
the Restricted Service Commercial designation which is intended to be added to this property_ As
stated previously, the uses requested by the applicant would be permitted within the Restricted
Service Commercial designation, with the exception of a larger office_
The Official Plan states that office uses are to be directed to the downtown core with the
exception of small scale offices in only the Restricted Service Commercial designation. In previous

APPLICATION REVIEW:
(a) proposal
An application for consent has been submitted to create a building lot for an apartment
building. The subject property currently contains a 5-storcy, 39-unit apartment building with an
accessory parking lot. The existing building is located on the lot to be retained while the lot to be
severed is to be used as the building lot. The site plan approved this property by Town Council
proposes a second 6-storey, 46 unit apartment building which would be constructed immediately
south of the existing building on the lot to be severed.
Plate 1, Existing Zoning, indicates the location of the subject property, as well as the
existing zoning in the immediate vicinity. Lands to the east of the subject property contain an
auto parts store, while lands further to the east across King Street contain the Tillsonburg transfer
station and Beaver Lumber. Lands to the south contain high density residential development,
including the Queen's Court condominium, while lands to the west contain low density
residential development. Lands to the north contain the Tillsonburg Fire Station and Police
Station.

Plate 2, Applicant's Sketch, is a sketch submitted with the application showing the site
plan for the subject property. As previously stated, the southern apartment building has not yet
been constructed. It should also be noted that no parking has been created on the lot to be
severed.
(b) Background
This property has been subject to a number of previous applications under the Planning
Act. At its meeting of November 5th, 1992, the Oxford County Land Division Committee
granted Application #B-87/92 to permit a lot addition to the subject property from the abutting
property to the east. Although the application was granted, the applicants never finalized the
application and it subsequently lapsed.
Application #B-87/92 was granted subject to a number of conditions, one of which
included the re -zoning of the proposed lot addition. A zoning by-law amendment was approved
by the Council of the Town of Tillsonburg at its meeting of February 9th, 1993 re -zoning the
subject property to a `Residential Fourth Density (R4) Zone. In October, 1993, Town Council
again re -zoned the subject property to a `special Residential Fourth Density (R4-4) Zone to
permit the development of the apartment buildings.
The property is also subject to a site plan (SPC 7-24) which was approved by Town
Council at its meeting of April 10, 1993.
At its meeting of June 3rd, 1999, the Oxford County Land Division Committee approved
application #B-33/99 to permit a lot addition from the abutting property to the east. This
application was identical to Application #B-87/92 which was approved in 1992 but was not
finalized by the applicants. The lot addition will be added to the lot to be retained. At the time
of writing of this report, the Secretary -Treasurer of the Land Division Committee has not yet
stamped the deed for this lot addition under Application #B-33/99.
(c) Official Plan
The subject property is located within the `High Density Residential' designation on the
Residential Density Plan for the Town of Tillsonburg in the County Official Plan. The Official
Plan states that high density residential areas will be developed for large scale, multiple unit
forms of residential development.
The County Official Plan states that Town Council shall be satisfied that the site design
policies for multiple unit residential development are satisfied when considering a specific
proposal for high density residential development. In this case, the subject property has an
approved site plan for two apartment buildings and accessory parking. However, a division of

this property will necessitate a modification to this site plan. A modification is necessary as the
current site plan is designed on the basis of both apartment buildings being contained on one
property.
The division of this property into two parcels may necessitate separate parking, access
and servicing requirements and will require modifications to the existing site plan. Although it is
possible that both apartment buildings could function as one 'group development', easements
would be required to permit access between properties for common parking, landscape, and open
space areas.
(d) Zoning By-law
The subject property is zoned `special Residential Fourth Density (R4-4)' in the Town of
Tillsonburg Zoning By-law No. 1994. The R44 Zone allows an apartment dwelling house, as
well as group housing, as defined in the 'Tillsonburg Zoning By-law.
The severance of this property will create at least two deficiencies in the setback
requirements of the R44 zone. If this application is approved and the lot addition under
application #B-33/99 is finalized, the lot frontage of the severed lot will be on Bridge Street and
the lot frontage of the retained lot will be on King Street. The rear yard requirement for the
severed lot is 10.5 m (34.4 ft.) and according to the approved site plan, the rear yard will be 0 m
(0 ft.). The rear yard requirement for the retained lot is 10.5 m (34.4 ft.) and the existing rear
yard is 8 m (26.2 ft.). Based on the approved site plan, the exterior side yard requirement of the
severed lot is 8.2 m (26.9 ft.), and the proposed apartment will have an exterior side yard of 8 m
(26.2 ft.).
In addition, the area of the lot to be severed may also be deficient depending on the
number of bedrooms in each apartment unit because the lot area requirements increase as the
number of bedrooms increase.
The deficiencies on the lot to be severed may be corrected if the site plan for the proposed
apartment changes. Therefore, our Department would recommend that the approval of this
application be conditional upon the completion of a new site plan, and the Town of Tillsonburg
indicating that the lots will conform to the provisions of the R44 zone. The applicant will
require approval from the Tillsonburg Committee of Adjustment to recognize the deficiency in
the rear yard requirement on the lot to be retained, and possibly for the deficiencies on the lot to
be severed.

(e) Agency Comments
This application has been reviewed by a number of public agencies.
The'rulsonburp PUC has indicated that the owner or his agent shall consult with the PUC
early in the design stages to ascertain the availability and requirements of both hydro and water
servicing for the new development. If re -location of the electrical and/or water plant is required
due to construction, the PUC states that the owner shall bear all costs associated with the said re-
location.
The PUC does state that there is an existing water service crossing the lot to be severed to
the apartment building on the north side of the property. The property owner will have to obtain
an easement and grant to the PUC, at no cost to Commission.
The remaining responding agencies, consisting of the Long Point Region onservation
Authorily, the Tillsonburg Fire Chief and the Oxford CounLy Director of Public Works had no
objections to or comments with this application.
(fl Planning Review
The applicant is proposing to sever the southern half of a high density residential
property. The lot to be retained currently contains an apartment building with an accessory
parking lot, while the lot to be severed is to be used for the construction of another apartment
building. 1'liere is an approved site plan for the entire property which shows two apartment
buildings including the existing building on the north side of the property and the proposed
building on the lot to be severed.
There are two alternatives which can be considered in the approval of this application.
The first alternative would be to have the applicant submit a revised site plan showing both the
existing apartment building and associated parking, as well as the proposed building and parking
for the lot to be severed. This site plan would then be approved conditional upon the granting of
the application for consent. The second alternative is to first grant the application for consent,
subject to an application for site plan amendment.
It is the opinion of this Department that based on the fact that the property is already
zoned and designated for high density residential purposes, that the application for consent can
be granted, subject to the submission of a revised site plan for the subject property. The
applicant can then determine if the lot to be severed and the lot to be retained are to function as
one parcel under two ownerships or whether they will function independently of each other. If
the properties are to function as one property, the applicant will require easements and
development agreements between the owners for the sharing of common facilities, including
parking, landscaping, garbage removal, etc.

Tenders were opened on November 12th,1999 at the municipal offices.
Two bids were received and and the results were as follows:

Unit 2 = $20f597.50
Unit 3 = $10,004.50
Total = $55,789.80
2) Prouse Electric/DY Mechanical of Tillsonburg Unit 1 = $41,569.98

Unit 3 = $13,142.81
Total = $99,286.42
The above prices include all taxes. Based on the above bids Thompson
Electric is $43,496.62 lower than Prouse/DY Mechanical.
The budget for this project is $54,800 and with the GST rebate will bring this

To present tenders submitted for snow clearing services at the Tillsonburg Municipal Airport for
the 1999/2000 winter season.
BACKGROUND
For the 1998/1999 winter season, Horvath Holdings provided snow clearing services for the
Airport at the following rates per hour:
• Truck $45.00
• Tractor $65.00
• Snow blower $65.00
Sanding and salting, hand shoveling and snow removal services were not provided. The total
expenditures for the 1998 fiscal year totaled $1,996.
COMMENTS
The service required is to plow the snow into windrows and then have a blower blow off the
windrows.
An ad was placed in the Tillsonburg News to advertise for tenders to provide snow removal
services at the Airport for the 1999/2000 winter season. The tender deadline was set for noon,
Thursday, November 18''. Only one tender submission was received. The submission was
opened at 7:20 p.m., Thursday, November 18, 1999 at the Airport Advisory Meeting. The
proposal received was from Horvath Holdings with no increase over the prior year's rates.
To date the Airport has incurred $5,128.75 for snow removal of which $8,000 was budgeted.
RECOMMENDATION
For Council to consider endorsing the following resolution passed by the Airport Advisory
Committee:

1. The attached requested has been received from the Station Arts Centre. As indicated, the
organization is requesting a one-year loan of $3000.00 to complete the roof restoration of the
Station in conjunction with the overall fagade work on the building.. This facility is owned by the
municipality and occupied by the organization.
2. The Facade Improvement Loan Program provides for interest at 2.5% annually.

I am writing on behalf of the Station Arts Centre for consideration of an interest free loan
from the Economic Development fund. Kim Miggens of TACAC has advised us that buildings in
a C 1 zone are eligible and that we may qualify for funds in order to complete the restoration of
the Great Western Railway Station.
We are requesting an interest free loan of $3000. and would expect to pay back this sum
in the fall of 2000, after our next auction. As with any restoration of an old building, we have had
extra repairs and expenses that were not expected and it may be necessary to use a more
expensive shingle than we had budgeted for in order to restore the building to heritage standards.
We are very happy to have had the opportunity to restore such a lovely building to its
former state and hope that it will continue to add to the character of Tillsonburg. Thank you for

`that the County endorse a collective pricing arrangement with Bell Canada to allow for installation of
phone lines in Municipal Operations Control Centres located within the County;
And further that the County approach Bell Canada with this request on behalf of the Municipalities';
And further that the County of Peterborough circulate this resolution to other municipalities in Ontario and
the Association of Municipalities of Ontario (AMO) asking for their support for our motion;
And Further that discussions be held with Bell Canada that if a special rate is offered for the installation of
phone lines in Municipal Operation Control Centres that those savings be retroactive to the municipalities
that have already installed them;
And Further that a copy of this resolution be forwarded to the CRTC advising them of the urgency of this
matter."
It is very important for municipalities to have their Emergency Plans in place_ Part of this process includes having
phone lines installed in the Municipal Operations Control Centres. Those phones lines are installed in case of a
disaster, and it seems very unfair that while they may never be used, that municipalities are being charged an
extremely high fez for these phones. Although we all hope that we nevez have to use them a municipality must be
prepared_ A good example of this was the ice storm of 1998 and how quickly a disaster can occur and how prepared
municipalities must be. We urge you to give this consideration to this important matter and we would be pleased to
meet with you to discuss this important matter.

becomes quite busy. Last year Tag Day was rescheduled for July, and it turned out to be
the most successful one we have organized to date.

RESOLUTION RC DOCTORS
Council of the Village of Fenelon malls requests (lint, due to the shortage of General/Family
Practitioners in Ontario, the provincial government allow foreign doctors to practice in Ontario.
Council of the Village of Fenelon Falls also requests that the provincial government opens up new
first -year medical school positions fnr the year 2000 and increase the number of graduate positions in
family practice.
Fenelon Falls intends to apply to the Ministry of Health for an under serviced area designation for
GeneraWamily Practitioners. Fenelon balls will be in all emergency situation in the near future
due to the upcoming retirements of most of our current doctors who arc already working very long
hours to try to accommodate their patients. Doctors at the Medical Centre in Fenelon Falls have been
trying to recruit new doctors for the past eight years, with no success.
The Council of the Village of Fenelon Falls requests that AMO circulate this resolution to the
Municipalities of Ontario and that the municipalities in turn send their resolutions of support to the local
provincial reprnsentatives regarding the urgent matter of the shortage of doctors in Ontario.

I'm pleased to inform you that the Waste Diversion Organization (WDO) has been established to
support your Blue Box and other waste diversion programs.
As I announced today, a one-year voluntary agreement has been reached between the Province,
industry, municipalities, the Liquor Control Board of Ontario and the Recycling Council of Ontario.
Industry members and the LCBO have committed up to $14.5 million to develop, implement and
fund waste diversion programs through the WDO. A key objective of the organization is to deliver,
for my consideration, a sustainable funding plan for the Blue Box program and other waste diversion
initiatives.
Under the agreement, municipalities will receive $4 million to offset the 1999 costs of recycling
liquor and wine bottles collected in the Blue Box (the program will be similar to last year's and a
glass recycling survey will be forwarded shortly) and another $4 million in 2000. In addition, the
WDO has earmarked $2 million for an organic waste diversion program, $1 million to set up
municipal special household waste depots (household hazardous wastes), $2 million to find ways to
help you improve the effectiveness and efficiency of Blue Box and other waste diversion programs,
and $1 million in free advertising space in daily newspapers to help you inform the public about
waste management activities.
The WDO will consist of 12 industry, provincial, municipal and NGO voting members.
Municipalities will have four members and four votes; additional members are detailed in the
attached material.

I am committed to ensuring that the WDO continues its work well beyond this one-year initiative.
The WDO's review of long-term issues will include the development of options for a sustainable
funding formula to cover up to 50 per cent of net operating costs for municipal Blue Box programs,
as well as to continue the programs described above.
I want to take this opportunity to congratulate you and your municipal colleagues on your waste
diversion successes. Thanks to your efforts, Ontario municipalities diverted 1.25 million tonnes of
waste in 1998; that's a 45 per cent increase over 1994's figure of 860,000 tonnes.
I believe that this WDO initiative will take Ontario's waste diversion efforts to a new level as we
enter a new millennium. I'm confident that with your continued efforts and the WDO's support we
will achieve our 50 per cent waste reduction target.

Waste diversion program partnership announced
Environment Minister Tony Clement announced today the formation of the Waste Diversion
Organization (WDO) - a partnership of government, municipalities and industry to help fund
municipal Blue Box and other waste diversion programs.
"We've established this organization to come up with a long-term plan to sustain our waste
diversion programs, including the Blue Box," Clement told a Waste Reduction Week industry
breakfast sponsored by the Recycling Council of Ontario. "We will achieve our target: to cut in
half the amount of waste sent for disposal.
The Waste Diversion Organization is based on a one-year, voluntary Memorandum of
Understanding. WDO members have committed $14.5 million to develop, implement and fund
municipal waste diversion programs.
Under the agreement, the Waste Diversion Organization will establish programs to:
• fund Blue Box costs related to wine and liquor glass containers ($8 million);
• increase diversion of organic wastes (as much as $2 million);
• establish additional depots for municipal special household wastes, which are sometimes
referred to as household hazardous wastes (as much as $1 million);
0 improve the efficiency and effectiveness of Blue Box programs (as much as $2 million);
• inform the public about waste management activities ($1 million) with municipalities
receiving free advertising space in daily newspapers.
"We asked for, and received, voluntary participation from a wide range of partners," Clement
added. "Industry's resources and expertise, along with those of municipalities, will help improve
existing programs and find more effective ways to reduce and divert waste."
RCO Executive Director John Hanson welcomed the creation of the Waste Diversion
Organization. "I'm delighted to see the organization come to fruition," Hanson said. "Our
members are committed to working with our industry and government partners to make a
success of this initiative."

• food and consumer products, represented by Corporations Supporting Recycling;
• municipalities, represented by the Association of Municipalities of Ontario;
• daily newspapers, represented by the Canadian Newspaper Association;

WASTE DIVERSION ORGANIZATION AND BLUE BOX FUNDING
The Waste Diversion Organization - established with a commitment of $14.5 million from its
members - brings together industry and government partners to develop, fund and implement
municipal waste diversion activities.
The key objective of the new organization is the development of a long-term, sustainable
funding plan for the Blue Box and other waste diversion activities.
Waste Diversion Organization programs
Under the Memorandum of Understanding, the Waste Diversion Organization will:
• provide $8 million to fund Blue Box glass costs - The WDO will provide $4 million to
municipalities to help cover the 1999 costs of recycling wine and liquor glass
containers. A further $4 million will be provided to help pay for the recycling of these
containers in 2000. (This continues the $4 million given to municipalities in March
1999 by the Liquor Control Board of Ontario).
• earmark $2 million toward the diversion of organic wastes - The majority of funding will
assist municipalities with the establishment of organic waste diversion systems,
including centralized composting and organic digestion facilities. There will also be
educational programs encouraging organic waste diversion.
• earmark $1 million for the establishment of an additional five to 10 municipal depots for
special household wastes, sometimes referred to as household hazardous wastes - This
program will cover 50 per cent of capital and operating costs, excluding costs
associated with processing of these wastes.

• devote as much as $2 million toward a program to improve the effectiveness and
efficiency of Blue Box programs - This program will include, but is not limited to:
► examination of the number and location of material recovery facilities (MRFs) in
Ontario
► planning for future capital improvements to MRFs, particularly shared -cost
projects with demonstration value
► investigating innovative collection methods
► increasing waste diversion from apartment recycling programs through retrofits,
promotion and other measures
► development of markets for secondary materials
• implement a program to provide municipalities with $ 1 million worth of free advertising
space in daily newspapers - This space will be used to inform the public about waste
management activities.
The Waste Diversion Organization's review of longer -term issues will include the development
of options for a sustainable funding formula to provide up to 50 per cent of the net operating
costs for municipal Blue Box programs, as well as to continue the programs described above.
The agreement also calls for the organization to design, and develop options for funding, a
special household waste management program enabling consumers to return these wastes to
municipal depots.
Composition of the Waste Diversion Organization
The members of the Waste Diversion Organization are drawn from:
• the food and consumer product sectors, with four members, including the Chair
(this sector will contribute as much as $4 million to the WDO through its
association, Corporations Supporting Recycling)
• the Association of Municipalities of Ontario, with four members;
• the Canadian Newspaper Association, with one member (CNA is providing the
$1-million advertising program);
• the Canadian Paint and Coatings Association and the Canadian Manufacturers of
Chemical Specialties Association, which jointly will appoint one member (the
two groups are providing a total of $500,000);
• the Liquor Control Board of Ontario, with one member (the LCBO is contributing
$9 million);
• the Recycling Council of Ontario (RCO), with one member; and
• the Ministry of the Environment, with one non -voting member.
The ministry's role in the organization is primarily advisory. The other 12 members have one
vote in WDO decisions, with the exception of the Chair, who has two votes.

The 3Rs in Ontario
Ontario's goal is to reduce the amount of waste sent for disposal by 50 per cent, compared
with 1987. By 1997, Ontarians had reduced their wastes by 35 per cent.
Between 1994 and 1998:
• municipalities increased their waste diversion by 45 per cent - from 860,000
tonnes to more than 1.25 million tonnes;
• the backyard and central composting of organic materials has increased by 57
per cent - from 300,000 tonnes to 470,000 tonnes (central composting led the
way, growing by 95 per cent);
• materials collected through Blue Box programs, which account for a little more
than 50 per cent of the waste diverted from disposal, have increased by 43 per
cent - from 450,000 tonnes to 650,000 tonnes.
While Blue Box programs and other 3Rs activities are producing significant results, several
challenges remain, including:
• ensuring the long-term financial sustainability of Blue Box programs and other
waste diversion initiatives;
• increasing the diversion of organic materials that are not being composted
through backyard and centralized composting; and
• improving upon the 6,000 tonnes of household hazardous wastes that are being
diverted by existing municipal depot programs.

LEGISLATION ON AMBULANCE EXTENSION IS INTRODUCED
issue: Legislation has been introduced in response to municipal concerns related to the time necessary
to deal with transition issues and to make proper decisions regarding service delivery.
Background: On March 23, 1999, the Province agreed to extend the land ambulance transfer date to
January 1, 2001, and has incorporated this in Bill 14, More Tax Cuts for Jobs, Growth and Prosperity Act.
Once proclaimed, the Act requires designated municipalities to notify the Ministry of Health and Long -Term
Care and local operators at least 120 days before the date when the newly selected operator will begin to
provide the service.
If an existing operator does not receive notice by September 3, 2000 (120 days before the municipal
assumption deadline), "... the operator may continue to provide land ambulance services in the municipality
on and after January 1, 2001, subject to this Act and the regulations and such terms and conditions as may
be agreed to by the municipality and the operator."
In addition, gill 14 allows the government to make regulations and develop financing formulas regarding the
50/50 funding which was also announced on March 23'.
The Minister's regulatory power is also enhanced through Bill 11, Red Tape Reduction Act, 1999. At the
moment, the Minister only has the authority to make operational regulations applicable to designated
municipalities that deliver the service in-house. This power will be extended to municipalities that contract
out ambulance services. The regulation making authority will also allow the Minister to provide a framework
for inter -municipal arbitrations and interest and late payments.
Bill 11 also changes the current scheme for the licensing of ambulance operators to a periodic quality based
certification system. The Minister of Health and Long Term Care will be appointing a certification authority
that will be responsible for ensuring that operators meet criteria required for certification. The issuance and
revocation of the certificate will depend solely on the operator's ability to meet these criteria. As soon as Bill
11 is proclaimed, the Ministry will be working with AMO and other affected stakeholders regarding criteria,
and process.
The Sill also grants the Minister the power to establish an advisory council which will advise the Minister on
matters relating to ambulance services. It is unclear what relation this has to the current advisory structure
(i.e. AMO/Ministry of Health and Long Term Care Steering Committee).
Finally, Bill 11 prohibits co -payments and fees being charged to individuals that do not utilize ambulances
that may have been dispatched to a scene.

Assembly website - http:(/www.ont(a.on.ca/Documents/documentsindex.htm.
Action: It would appear that if designated municipalities have not notified the province or current operators
by September 3, 2000 as to who is delivering the service, arrangements will have to be made with current
providers. AMO staff will be working with municipal land ambulance officials to review the impacts these two
pieces of legislation on municipalities. AMO will also continue to work through the Joint Land Ambulance
Steering Committee to raise and resolve important ambulance transition issues.

$300 Million in Provincial Savings Have Impacts for Municipalities
Issue: Today's announced expenditure reductions translate into new municipal costs and some savings.
Facts:
Savings will come from ministries' operating budgets and a wide array of programs. Municipal
governments and stakeholders, including Local Housing Authorities have been faxed the announcement's
Ba0grounderthat provides summary information and the net savings for 2000 - 2001. The changes will
impact municipalities positively and negatively. Based on the published numbers, municipalities inherit
$49.9 million of new costs and are to see $33 million in savings. Until we determine the cost of changes
for which there are no municipal numbers, a complete picture of the impact is impossible. Following is
some of the information that AMO will be determining:
• Does the $3 million savings related to welfare fraud and other social assistance changes (second
residences, expansion of liens policy on principal residences) benefit municipalities in the 80120
cost share?
• Are there new administrative costs to achieve the fraud target to be cost -shared and if so, what is
the municipal cost?
What effect do other changes to social assistance, such as the cap on the provincial contribution to
municipal non -health discretionary benefits and the STEP variable exemption have on the client
and municipal budgets?
• What is the cost impact of the increase in police recruit fees for Ontario Police College (net $1.5 m)
and the recent notification to Chiefs of Police of an increase in fees for non -recruits which moves
from per diem charge of $30.00 to partial recovery of actual costs?
• How have the municipal savings for social housing been calculated, e.g., the $3.1 million related to
reduced operating costs for local housing authorities and non-profit providers?
• What makes up the $fi million new cost to municipalities for the MMAH's cost recovery of non-profit
housing program administration?
• What is the individual municipal impact of the $25 million new cost that requires municipalities to no
longer include parent contributions toward their 20% share of child care fee subsidies?

1. An Offer of Purchase and Sale has been received from Mr. David Prince for the purchase of one
(1) acres of land on Clearview as shown on the attached plan. The standard conditions are part of
the Offer with the exception that time frame to build in has been extended from 6 months to 12
months because same will not start until after the winter. Sale price is the usual $26,500 per acre.
The use of the land will be for manufacture of specialty wood products.

9. FUTURE USE: Vendor and Purchaser agree that there is no representation or warranty of any kind that the future intended use of the property by Purchaser is
or will be lawful except as may be specifically provided for in this Agreement.
10. TITLE: Provided that the title to the property is good and free from all registered restrictions, chorges, liens, and encumbrances except as otherwise specifically provided in
this Agreement and save and except for (a) any registered restrictions or covenants that run with the land providing that such ore complied with; (b) any registered
municipal agreements and registered agreements with publicly regulated utilities providing such have been complied with, or security has been posted to ensure compliance
and completion, as evidenced by a letter from the relevant municipality or regulated utility; (c) any minor easements for the supply of domestic utility or telephone
services to the property or adjacent properties; and (d) any easements for drainage, storm or sanitary sewers, public utility lines, telephone lines, cable television lines
or other services which do not materially affect the present use of the property. If within the specified times referred to in paragraph 8 any valid objection to title or to any
outstanding work order or deficiency notice, or to the fact the said present use may not lawfully be continued, or that the principal building may not be insured
against risk of fire is made in writing to Vendor and which Vendor is unable or unwilling to remove, remedy or satisfy and which Purchaser will not waive, this
Agreement notwithstanding any intermediate acts or negotiations in respect of such objections, shall be at an end and all monies paid shall be returned without interest
or deduction and Vendor, Listing Broker and Co-operating Broker shall not be liable for any costs or damages. Save as to any valid objection so mode by such

INSPECTION: Purchaser acknowledges having had the opportunity to inspect the property and understands that upon acceptance of this Offer

INSURANCE: All buildings on the property and all other things being purchased shall be and remain until completion at the risk of Vendor. Pending completion,
Vendor shall hold all insurance policies, if any, and the proceeds thereof in trust for the parties as their interests may appear and in the event of substantial damage,
Purchaser may either terminate this Agreement and have all monies paid returned without interest or deduction or else take the proceeds of any insurance and
complete the purchase. No insurance shall be transferred on completion. If Vendor is taking back a Charge/Mortgage, or Purchaser is assuming a Charge/Mortgage,
Purchaser shall supply Vendor with reasonable evidence of adequate insurance to protect Vendor's or other mortgagee's interest on completion.
14.
PLANNING ACT: This Agreement shall be effective to create an interest in the property only if Vendor complies with the subdivision control provisions of the
Planning Act by completion and Vendor covenants to proceed diligently at his expense to obtain any necessary consent by completion.
15.
DOCUMENT PREPARATION: The Transfer/Deed shall, save for the Land Transfer Tax Affidavit, be prepared in registrable form at the expense of Vendor, and
any Charge/Mortgage to be given back by the Purchaser to Vendor at the expense of the Purchaser. If requested by Purchaser, Vendor covenants that the
Transfer/Deed to be delivered on completion shall contain the statements contemplated by Section 50 (22) of the Planning Act, R.S.O. 1990.
16.
RESIDENCY: Purchaser shall be credited towards the Purchase Price with the amount, if any, necessary for Purchaser to pay to the Minister of Notional Revenue to
satisfy Purchaser's liability in respect of tax payable by Vendor under the non -residency provisions of the Income Tax Act by reason of this sale. Purchaser shall not
claim such credit if Vendor delivers on completion the prescribed certificate or a statutory declaration that Vendor is not then a non-resident of Canada.

ADJUSTMENTS: Any rents, mortgage interest, realty taxes including focal improvement rates and unmetered public or private utility charges and unmetered cost
of fuel, as applicable, shall be apportioned and allowed to the day of completion, the day of completion itself to be apportioned to Purchaser.
18.
TIME LIMITS: Time shall in all respects be of the essence hereof provided that the time for doing or completing of any matter provided for herein may be extended
or abridged by an agreement in writing signed by Vendor and Purchaser or by their respective lawyers who may be specifically authorized in that regard.
19.
TENDER: Any tender of documents or money hereunder may be made upon Vendor or Purchaser or their respective lawyers on the day set for completion. Money
may be tendered by bank draft or cheque certified by a Chartered Bank, Trust Company, Province of Ontario Savings Office, Credit Union or Caisse Populaire.
20.
FAMILY LAW ACT: Vendor warrants that spousal consent is not necessary to this transaction under the provisions of the Family Low Act, R.S.O. 1990 unless Vendor's
spouse has executed the consent hereinafter provided.
21.
UFFI: Vendor represents and warrants to Purchaser that during the time Vendor has owned the property, Vendor has not caused any building on the property to be
insulated with insulation containing ureaformoldehyde, and that to the best of Vendor's knowledge no building on the property contains or has ever contained
insulation that contains ureaformoldehyde. This warranty shall survive and not merge on the completion of this transaction, and if the building is part of a multiple
unit building, this warranty hall onl apply I that part of the b ilding which is the subject of this Iransaclton.
22.

Jn reference to the letter received November 12 regarding the Notice of Public meeting concerning the
development charges, I have the full of the background study available and would like to make comment on the
original three pages as I received them and the report. I don't seem to be able to understand what the end results
of this report mean or will mean in the form of ias

I believe the most important item that may be covered is under Item 12, .Chapter 7 that recommends the titnina

eraut issuance for all remainizg services. This could kill development within the Municipality, as there are
very few (if any) builders who could afford to pay additional development charges with the signing of the
subdivision agreement. As the growth of the Municipality continues, some form of co-operation and
understanding should be given to the individual contractor acid builders. To borrow the additionat. money for
the services and.pay for therm when signing the subdivision agreement when the houses may not be sold for.l,
2 , 3, or possibly 10 years, ifyou add in an interest amount to the cost, it -would seriously jeopardize any possible
development for small builders such as myself.

I express my concern for any increase rate. Possibly, I am reading this incorrectly at this time, but, it would
indicate that we would be looking at a large increase for the development charges. Could you please attempt
to clear the charge increase and time involved? This could affect all conditional sales for all builders who have
pre -sold for spring construction.
in reference to your present charges of 1.25% of cost for each house, I question to what account this money is
deposited. If it goes to a General Account, is this legal? Should the funds not be used for development services?
I would appreciate an answer to where the payment goes and if the 1.25% will be rescinded when the
development charges are brought in.

Years Eve celebration at Heritage Square beginning approx. 9 pin .New Years Eve.
