RE: Broadway Rehabilitation
1. At the regular meeting of Public Services held July 8th,
1998, Members were circulated a copy of the proposed
agreement with the Minister of Transportation for the
rehabilitation of North Broadway, as attached, and to be
reviewed at Council on July 10th, 1998.
Members were advised that Councillor B. Smith and the
Director met on June 22nd, 1998, to review the proposed
agreement with Ministry Officials in London and that the
agreement before Council reflects the changes requested by
the Town of Tillsonburg.
STAFF RECOMMENDATION:
Therefore, it is recommended that Council enter into this
agreement with the Ministry of Transportation to expidite the
commencement of this project.
2. Members also reviewed the proposed construction limits of
Broadway and passed the following motion.
Moved by Deputy Mayor I. Horton, seconded by Councillor
S. Lamb that the following work required between Concession
Street and Venison Street, ie: sanitary and storm sewers,
repairs to curb and gutters, sidewalks and intersection
widening at Concession Street, be deferred until 1999 due to
the following reasons.
1. No Connecting Link funding available in 1998.
2. No. P.U.C. funding for watermains in 1998.
3. All of the work as mentioned above would be completed
under one contract in the same year.

THIS AGREEMENT is made this day of July, 1998
between: THE CORPORATION OF THE TOWN OF TILLSONBURG
(`TILLSONBURG')
and: HER MAJESTY THE QUEEN IN RIGHT OF THE PROVINCE
OF ONTARIO, REPRESENTED BY THE MINISTER OF
TRANSPORTATION FOR THE PROVINCE OF ONTARIO
(the "MTO")
WHEREAS:
A. Attached Schedule "A" illustrates:
• The section of Highway 19 (Broadway Street) from Concession Street northerly to North
(� Street in Tillsonburg that is currently under the jurisdiction of the MTO.
B. MTO and Tillsonburg are desirous of improving Highway 19 between Concession Street and
North Street.
C. It is deemed expedient to enter into this Agreement to deal with:
• The widening of Highway 19 from a two lane rural section to a three lane urban section
between Lisgar Avenue and Moose Street.
• The milling and resurfacing of Highway 19 utilizing two lifts of asphalt between
Concession Street and 100m north of North Street, a length of 1.8 km.
• The replacement of the entire existing storm sewer system.
• The replacement of all existing curb and gutter between Concession Street and Moose
Street due to conflicts with the removal or replacement of the storm sewer, grade
revisions and the deterioration of the curb and gutter. The existing curb and gutter will not
be replaced between Moose Street and North Street.
• The replacement of any existing sidewalk that is affected by the removal or replacement
of the storm sewer, the removal of curb and gutter and any grade revisions.
D. Tillsonburg is agreeable to the fact that the Minister intends to designate the portion of Highway
19 between Concession Street and the north limit of Tillsonburg, a length of d2.6 km as a
connecting link following construction.
NOW THEREFORE in consideration for the terms of this Agreement and the sum of a nominal one dollar
of lawful money of Canada paid by each of the parties of this Agreement to the other, the receipt whereof
is hereby acknowledged, Tillsonburg and the MTO agree as follows:
1. Illustration of Work
1.1 Reference is made to the attached Schedule "B" which illustrates the work described in
paragraph 3 below, in accordance with the detailed contract drawings and documents
approved by the Regional Director of MTO (the "Regional Director").
2. Tillsonburg Responsibilities
2.1 Tiilsonburg will, at the cost and expense of the Parties as set out in paragraph 5 below:
A. Obtain the necessary environmental approvals as proponent under the
Environmental Assessment Act, undertake utility relocations as
necessary, and complete the engineering design;
B. Tillsonburg will be responsible to replace any existing sidewalk that is not
affected by construction (ie. storm sewer replacement and grade
revisions), at their expense. Tillsonburg will be responsible for the
installation of any new sidewalk, at their expense.

C. Effect and administer the work including all required tendering and
contract administration, described in paragraph 3 below and shown in the
drawing referred to in paragraph 1 above, and in accordance with MTO
standard specifications, design and construction criteria.
3. Contract Work
3.1 The work (the "Work") to be effected and administered by Tillsonburg, under and
including paragraph 2 matters above, is further described as follows:
A. Widening of Highway 19 to a three lane urban section between Lisgar
Avenue and Moose Street, a length of 0.8 km;
B. Replacement of the entire existing storm sewer system between
Concession Street and North Street;
�• C. Grade revisions to Highway 19 to effectively drain the curb and gutter,
D. Replacement of all existing curb and gutter between Concession Street and
Moose Street that is affected by the removal and replacement of the storm sewer,
grade revisions and the deterioration of the curb and gutter. The existing curb
and gutter will not be replaced between Moose Street and North Street.
E. Replacement of any existing sidewalk that is affected by the removal or replacement of
the storm sewer, the removal of curb and gutter and any grade revisions.
F. Resurfacing of Highway 19 between Concession Street and North Street.
3.2 The MTO and Tillsonburg agree to share the responsibility for the following undertakings to
ensure the successful completion of the Work;
A. Tillsonburg shall submit design drawings and documents, and details of construction and
traffic staging for the Work in accordance with all MTO policies, standards (Manual of
Uniform Traffic Control Devices, M.U.T. D.C.) and procedures to the MTO at least one (1)
week prior to the call for tenders for review and approval.
B. MTO shall provide design and construction liaison for the Work, and provide guidance
and assistance with respect to MTO standards, specifications, and mateEials testing.
Tillsonburg through its contract administrator shall be responsible for all materials testing,
quality assurance for mix designs, granulars, asphalt and concrete items. MTO will liaise
with the consultant and provide a guidance and audit function. Testing will be conducted
at a laboratory facility holding the appropriate certifications as required by MTO.
3.3 Tillsonburg, in the course of designing, tendering and administering the Work shall;
A. Engage the services of a contractor that is capable and familiar with highway construction
projects and MTO standards and specifications and the contractor shall furnish a 100%
Performance Bond and a 100% Labour and Materials Payment Bond;
B. Submit to MTO, prior to award of the contract, the details of all tenders including bid
prices, schedules, traffic staging proposals, and Tillsonburg's award recommendations,
for MTO approval;
C. Award the contract only after receiving the MTO's written approval of the award
recommendations;
D. Give the MTO at least one (1) week written notice prior to commencement of construction
of the Work;
E. Inform MTO of any changes to the design affecting the scope of the Work for its approval
by MTO prior to undertaking construction;
F. Ensure that MTO is satisfied with Tillsonburg's choice of the contract administrator. The
contract administrator will be responsible for the preparation of an approved plan/strategy
for: supervision and inspection in accordance with MTO guidelines, and the Inspection
Task Manual, staging for traffic control; monitoring of environmental concerns; a quality
control plan for the contract administrator's services under this Agreement, and a quality
assurance plan for the construction of the Works described in Section 3.1, all which
require approval from MTO;

G. Supervise and direct all work to the extent necessary to ensure the fulfilment of the
construction of the Work and the completion of the Work in accordance with the contract
drawings, documents, and plans approved by MTO, and in accordance with MTO
specifications and standards;
H. Decide all questions related to the Work and construction of the Work in compliance with
the terms and conditions of the Agreement and if required liaise with the MTO on
issues/concems related directly to work on Highway 19 in particular those related to
traffic, detours, staging and signing. MTO shall have ultimate and final control regarding
all traffic and staging issues related to Highway 19;
I. Maintain in form and detail satisfactory to the MTO, records pertaining to the inspection of
materials and workmanship, and as requested make the records available for MTO
review and inspection and access to be made available to the site by MTO staff at all
times;
J. Be responsible for construction quality assurance in accordance with MTO standards and
specifications;
K. Tillsonburg will be responsible for all public notices and any information centres.
3.4 When in the opinion of Tillsonburg the Work in this Agreement has been satisfactorily completed,
Tillsonburg shall notify the MTO which shall cause the Work to be inspected, and if MTO finds the
Work has been satisfactorily completed in accordance with the contract drawings and documents,
the MTO will give Tillsonburg written notice that MTO approves the Work and certifies the contract
complete, and thereafter the MTO will be responsible for the maintenance and repair thereof
within the limits of the Highway 19 right-of-way until such time as this portion of Highway 19 is
transferred to Tillsonburg pursuant to Section 29 of the Public Transportation and Highway
Improvement Act.
3.5 Upon application to the MTO, the District Engineer, District 31, London/Stratford shall issue a
Ministry Encroachment Permit for works to be installed by Tillsonburg as part of the Work (at no
fee).
4. Commencement of Work
4.1 Tillsonburg shall arrange for the commencement of the Work in an expeditious manner.
4.2 Tillsonburg shall bring the Work to completion in an expeditious manner.
5. Financial Contributions, Conditions for Payment and G.S.T.
5.1 Tillsonburg is subject to payment of the Goods and Services Tax for the Work. MTO shall pay a
3% net G.S.T. amount in addition to amounts otherwise payable hereunder to Tillsonburg with
respect to G.S.T. amounts not recoverable by Tillsonburg for MTO's share of the Work.
5.2 As conditions of payment, it is agreed that:
{i) The contractor shall submit application for payment on the Work performed to Tillsonburg
and MTO and provide copies of the payment certificates and invoices for verification
either monthly or as agreed upon at the pre -work meeting.
(ii) The contract administrator shall provide written notice to the contractor that:
(a) the payment request has been approved by Tillsonburg, or
(b) the payment request has not been approved by Tillsonburg
(iii) Upon approval, the contract administrator shall submit to Tillsonburg the approved
payment requests together with the relevant accompanying reports and certificates for
payment in whole.
(iv) Tillsonburg, following payment to the contractor shall submit to MTO all payment requests
with detail satisfactory to MTO for reimbursement, on a monthly basis, up to the limit
specified in subparagraph 5.2(v).

(v) Unless otherwise specified herein, the financial obligation of MTO under this Agreement is
the sum of the approved preliminary design, detailed design, storm sewer inspection
costs and the tendered prices for the Work outlined under Section 3.1 but in any event
shall not exceed $1,700,000.00. At his discretion, the Regional Director, or such person
who may customarily be delegated authority for such approval, may consider
reimbursement for the cost of extra worts encountered by the contractor during the course
of the Work which exceeds the tendered price for the Work outlined in Section 3.1 or in
excess of the upset limit of $1,700,000.00.
5.3 The financial obligation of Tillsonburg under this Agreement shall not be eligible for any
form of subsidy from MTO.
5.4 MTO may upon reasonable notice audit the records of Tillsonburg with respect to sums invoiced
under sub -paragraph 5.2
6. Indemnity
6.1 Tillsonburg shall indemnify and save harmless MTO, its employees and agents, from and against
any claim, action, cause of action or liability for loss, damage, accident or injury in any manner
arising due to, out of, from or in connection with the Work undertaken and performed by
Tillsonburg or its agents under this Agreement, except for work negligently performed by MTO.
7. Insurance
7.1 Tillsonburg, at its cost, shall have in place via either Tillsonburg or the prime contractor a
comprehensive general liability insurance policy protecting and indemnifying Tillsonburg and MTO
from and against all claims for damage or injury to persons, including loss of life to persons,
occurring on lands affected by the Work mentioned in this Agreement until the MTO gives
Tillsonburg notice that the Work is completed, and
A. The insurance shall be in the amount of not less than Five Million ($5,000,000.00) Dollars,
in respect of bodily injury or death of any one-person in any one occurrence;
B. The insurance shall be maintained with a company or companies licensed to do business
in the Province of Ontario and approved by the MTO;
C. The policy shall name the MTO, Tillsonburg, and the prime contractor constructing the
Work as named insured under the policy;
D. Tillsonburg shall furnish the MTO with certificates of the insurance prior to the award of
the contract;
E. The policy shall not be subject to cancellation or amendment without reasonable notice to
MTO; and
F. The policy shall contain a cross liability clause endorsement.
8 Lien
8.1 If a lien is fled with MTO with respect to the Works within the meaning of the provisions of the
Construction Lien Act, R.S.O. 1990, c.C.30, as amended, Tillsonburg, at its sole cost, shall have
the lien discharged or vacated prior to any final payment by MTO to Tillsonburg of an amount
owing to Tillsonburg under this Agreement equal to the amount of the lien.
9 Conflicts
9.1 Where there is a conflict between this Agreement and an MTO permit issued to Tillsonburg, the
Agreement governs.
10 Warranty
10.1 Tillsonburg warrants that it has taken all necessary steps, done all acts, passed all by-laws, and
obtained all approvals required to give it the authority to enter into this Agreement.

RE: Broadway Rehabilitation
Public Information Meeting
The Town of Tillsonburg, in conjunction with the Ministry of
Transportation of Ontario is anticipating the rehabilitation of
North Broadway from the north side of Concession Street to North
Street.
This work is subject to the final approval of the Ministry of
Transportation. Broadway is a Provincial Highway under
jurisdiction of the Ministry of Transportation.
The proposed work involved is:
1. Replacement of sanitary sewers, storm sewers, watermains, and
where applicable repairs/replacement of existing curb and
gutters and replacement of sidewalks.
2. Widening of Broadway between Lisgar Avenue and Moose Street
to a three lane cross section, comparable to south of Lisgar
on Broadway, including new sidewalks.
3. Milling of existing asphalt and resurfacing from Concession
Street to north of North Street.
Work to commence upon approval.
Tuesday, July 14th, 1998 between 2:00 P.M. - 6:00 P.M., Public
Services will hold an open house at 20 Spruce Street,
Tillsonburg, to review all questions the effected property owners
may have.
If you are unable to attend or wish not to but have questions,
please contact Public Services between 8:00 A.M. and 4:00 P.M.,
Monday through Friday at 842-5951.
Additional information regarding the schedule of work, contractor
and contact numbers will be circulated after Council accepts a
contractor.

Adjacent Uses: Residential to east, south, and west with valley lands to the north
Proposal: The applicants wish to recognize non -conforming yards and coverage of
an existing residential dwelling
Requested Relief: Relief from: 1. Section 6.2.1.1.5 - Front Yard - reduce from
required 7.5 m (24.6 ft) to 7.4 m (24.2 ft)
2. Section 5.2.5 - Interior Side Yard - reduce from

Intent and Purpose

Intent and Purpose
The purpose of the front yard and interior side yard requirements for
of Zoning By -Law:
dwellings and rear yard encroachments for deck provisions in a residential
zone is to provide adequate area for maintenance and drainage,
separation between buildings on adjacent properties for privacy, and to
provide open space and amenity areas. The purpose for a lot coverage
provision in a residential zone is to prevent overbuilding on a property.
The residential dwelling on the subject property was constructed in 1988.
Due to errors made in the location of the building on the property, the
dwelling intrudes into the required front yard and interior side yard by 0.1
m (0.3 ft). In addition, the combined lot coverage of the existing dwelling
and attached garage and utility shed is 1.4% above the maximum. The

more substantial variance deals with the rear yard encroachment of the
existing deck. As indicated on Plate 2, only a portion of the deck, being
the northwest comer, would be in non-compliance with the Town Zoning
By -Law. In addition, the deck and rear lot line abut valley land zoned
Open Space.
Extent of Variance: The variances are minor
Desirable Use or The variances will legalize a non -conforming situation for an existing
Development: single-family dwelling and attached deck.
Recommendation: That the Tilisonburg Committee of Adjustment approve application
A-09198 for 34 Loraine Avenue, subject to the following condition:
4) The existing deck not be enclosed by a roof and/or walls_

Take notice that an application has been made to the Committee of
Adjustment of the Corporation of the Town of Tillsonburg for
variance from certain provisions of Town of Tillsonburg Zoning
By-law 1994 and amendments thereto by:

The purpose of the application is to seek the following
variances:
1. Section 6.2.1.1.5 - Front Yard - reduce from recruired 7.5 m
(24.6 ft) to 7.4 m (24.2 ft);
2. Section 5.2.5 - Interior Side Yard - reduce from the required
1.2 m (3.9 ft) to 1.1 m (3.5 ft);
3. Section 6.2.1.1.4 - Lot Coverage - to increase the required
lot coverage from 30% to 31.4%; and
4. Section 5.25.3.2. - Deck - Rear Yard Encroachment - to reduce
from the required 4.4 m (14.5 ft) to 2.6 m (8.5 ft).
The Committee has previously approved a minor variance to allow a
reduced rear yard to 8.1 m (26.5 ft) on April 20, 1998 under File
A-3/88. The subiect lands are located in a residential (R1) zone.
The applied for minor variance would recognize the construction
of a single -storey detached dwelling with an enlarged deck.
The Committee of Adjustment may authorize minor variances from
the provisions of by-law 1994 in respect to land, buildings or
structures or the use thereof as in its opinion is desirable for
the appropriate development or use of the land, building or
structure provided the general intent and purpose of the by-law
and Official Plan are maintained.
The Committee, before making its decision, will hold a public
hearing to hear all persons who desire to make submissions in
support of or in opposition to the application as follows:

A By -Law to amend Zoning By -Law Number 1994, as amended.
WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg
deems it advisable to amend By -Law Number 1994, as amended.
THEREFORE, the Municipal Council of the Corporation of the Town of
Tillsonburg, enacts as follows:
1. That Schedule "A" to By -Law Number 1994 as amended, is hereby amended by
changing to C1-6 the zone symbol of the lands so designated C1-6 on Schedule "A"
attached hereto.
2. That Section 11.3 to By -Law Number 1994, as amended is hereby amended by
adding the following subsection* at the end thereof.
"11.3.6 LOCATION: BROADWAY AND BRIDGE STREET, C1-6
11.3.6.1 Notwithstanding any provisions of By -Law Number 1994 to the
contrary, no person shall within any C1-6 Zone use any lot, or erect,
alter or use any building or structure for any purpose except the
following:
an administrative office of the Corporation, the County, the Province
of Ontario or the Dominion of Canada;
a business or professional office;
an eating establishment;
a parking lot;
a public use in accordance with the provisions of Section 5.19 hereof.
11.3.6.2 Notwithstanding any provision of By -Law Number 1994 to the
contrary, no person shall within any C1-6 Zone use any lot, or erect,
alter or use any building or structure except in accordance with the
following provisions:
11.3.6.2.1 That all the provisions of the C1 Zone in Section 11.2 to By -Law
Number 1994, as amended, shall apply, _and further that all other
provisions of By -Law Number 1994, as amended, that are consistent
with the provisions. herein contained shall continue to apply mutatis
mutandis."

3. This By -Law comes into force in accordance with Sections 34(21) and (30) of the
Planning Act, R.S.O. 1990, as amended.

A BY-LAW to amend Schedules "I - Prohibited
Parking" and "J - Restricted Parking" to By -
Law 2103, as amended, to regulate traffic in
the Town of Tillsonburg.
WHEREAS it is deemed necessary and expedient to amend Schedules "I
- Prohibited Parking" and J - Restricted Parking" on the north side
of Brock Street between Bidwell Street and Rolph Street in the Town
of Tillsonburg.
BE IT THEREFORE RESOLVED THAT the Council of the The Corporation of
the Town of Tillsonburg enact as follows:
1. THAT Schedule "I - Prohibited Parking" to By -Law 2103, as
amended, be amended to include the following as if written and
incorporated therein:
