The Committee hears appeals in accordance with the Town’s Property Standards By-law. The Committee is an independent quasi-judicial body consisting of a minimum of three citizen members
chosen by Council for a four-year term to coincide with the term of Council.
The appeal hearing is conducted in accordance with the rules established by the Town’s By-Laws, pursuant to the Statutory Powers and Procedures Act and the Building Code Act.
Appellants may authorize an agent to act on their behalf. Appellants can submit evidence to be presented at the Hearing. All evidence must be provided and distributed prior to the start
of the Hearing.
Hearing Procedure
The Chair will call the meeting to order.
The Chair will ask if any member wishes to disclose a pecuniary interest.
The Chair will call for a resolution to adopt the minutes and vote on the same.
The Chair will read an opening statement outlining the procedure/format of the Hearing.
The Committee will consider each appeal in the order listed on the agenda. Prior to dealing with an appeal, the Chair will announce what the appeal is for, the appellant’s name, and
the street address.
The Chair will call for the municipal representative to present their case and evidence first and will then allow members of the Committee to ask questions. The appellant will have opportunity
to ask questions to the municipal representative which should only relate to information presented by the municipal representative.
The Chair will ask the appellant or their representative if they wish to present their case and evidence. If the person is not the appellant, the relationship to the appellant should
be stated. The appellant is permitted to bring documentation or even a witness to help support his/her position (P.Eng. Report, quotes, a
contractor, purchase of sale, etc.) When the appellant or their representative is finished with their presentation, the Chair will allow for the Committee members to ask questions, if
any, of the appellant, or their representative. The municipal representative will have opportunity to ask questions of clarification to the appellant.
The municipality and the appellant will have opportunity to make a closing statement.
The role of the Committee is to hear all the evidence and information provided and make a decision regarding the Order. The Decision made by the Committee is final and binding. The Chair
will call for a resolution to:
Confirm the Order as issued
Rescind the Order
Extend the time limit for compliance
Modify the terms of the Order
The Chair will then proceed to the next appeal on the agenda using the same process.
Following the completion of all appeals as listed on the agenda, the meeting will be adjourned.
The municipality in which the property is situate or any owner or occupant or person affected by a decision may appeal to the Superior Court of Justice by notifying the clerk of the
municipality in writing and by applying to the court within fourteen (14) days after a copy of the decision is sent.
