support of the applied for Minor Variance.

Committee of Adjustment approve the applied for Minor Variance
under File A-07/99 for a property at 35 Hillyndale Road by Larry
and Louise Bond, as amended to include a further variance to
Section 5.25.3.2 to Zoning By -Law 1994, as amended, to allow a
further encroachment of 6.3 feet for a deck into the required rear
yard.

1. Overview of Proposed Police Restructuring
i) Ms. Shelagh Morris, Ministry of the Solicitor General, presented to
Town Council a report on the restructuring of Police Services in
Ontario under The Police Services Act.
Mr. David Morris, Clerk -Administrator, and Mr. John Arts,
Treasurer, presented to Town Council a cost saving comparison
between the Tillsonburg Police Services Department and the
Ontario Provincial Police.
Acting Chief of Police Chris Coles presented a comparative
operational analysis between the Tillsonburg Police Services and
the Ontario Provincial Police.

Summer Place
Mr. Pat Carroll, on behalf of the Kinsmen Club of Tillsonburg, presented
to Town Council a proposed expansion to Summer Place to accommodate

RE: Permission to attend meeting to have plaque & check presented to Jeff Hawel from the
Fairboard.
Dear Dave:
We, the 7i11sonburg Tri-County Ag. Soc., are asking if it would be possible to have a plaque &
check presented by the Mayor and 2 members of the Fairboard at your next Council meeting
scheduled for Thursday, April 22199.
This award was won by Jeff Hawel, a grade 9 student of Annandale School. He(Jef17 won the
Youth Poster Competition for all of Ontario at the Annual Association of Fairs & Expositions
(OARS) convention in February. This convention is held yearly in Toronto. All Fairs in the
Province have this competition in their prize books.
Jeff has won the poster competition for District 7 in either 1st or 2nd place for the last three
years. 1999 brought the 1st place rosette for the whole province home to Tillsonburg. We are
very proud of Jeffs accomplishment and we hope that his winning will give other students a
chance to also give this competition a try. The town of 7711sonburg has quite a few accomplished
student artists. We would also like to congratulate the Art Teachers that teach in our local
schools.

APPLICATION REVIEW:
(a) Proposal
An application for consent has been submitted to permit the creation of a residential
building lot. The rear yard of the existing property presently contains no buildings or structures
and it is proposed that it will be severed to create a building lot. It is proposed that the existing
single detached dwelling will remain on the lot to be retained.
A number of minor variances have been submitted in conjunction with this application
for consent to permit the proposed development. Both the lot to be severed and the lot to be
retained would be deficient in lot area and lot depth and the new rear yard of the existing single
detached dwelling will also be deficient.
Plate 1, Existing Zoning, indicates the location of the subject property, as well as the
existing zoning in the immediate vicinity. The subject property is surrounded by other low
density residential development to the west, east and north. Lands to the south contain a parcel
of land which was recently re -zoned and re -designated to permit a restricted service commercial
development.
Plate 2, Applicant's Survey Sketch, is a site plan of the subject property showing both the
lot to be severed and the lot to be retained, as well as the location of the existing single detached
dwelling. Should this application be approved, the applicant has indicated that the steel sheds
attached to the rear of the garage would be removed.
b) Official Plan
The subject property is located within the `Low Density Residential' designation on the
Residential Density Plan for the Town of Tillsonburg in the County Official Plan. The low
density residential designation is intended to permit all types of low density residential
development including single detached dwelling, semi-detached and duplex dwelling units.
The Official Plan states that in order to efficiently utilize the designated residential land
in municipal servicing infrastructure, infill housing will be supported in low density residential
areas. Infill housing is defined as the placement of new residential development into established
built-up areas.
The Official Plan provides a number of policies by which the County Land Division
Committee and Town Council will be guided when considering proposals for infill development
in low density residential areas. The Official Plan states that the introduction of new residential
housing into an established streetscape pattern will only be permitted if the proposed lots were
deemed to be consistent with the characteristics of existing development on both sides of the"
same street. The Land Division Committee and Town Council should ensure that the proposal is

consistent with the street frontage, setbacks and spacing of existing development within a two -
block area.
Based on our review of the existing properties in the immediate vicinity, it is evident that
both the lot to be severed and the lot to be retained will be the smallest lots in the area. Although
the subject property has a relatively large rear yard which is free of buildings and structures, it is
the opinion of this Department that it is not large enough to permit the division of the property.
It is the opinion of this Department that the proposed consent does not comply with the policies
for infill development for the Town of Tillsonburg in the County Official Plan.
(c) Zoning By-law
The subject property is zoned `Residential Second Density (R2)' in the Town of
Tillsonburg Zoning By-law No. 1994. As previously stated, both the lot to be severed and the lot
to be retained will be deficient in terms of the lot area and lot depth requirements of the R2 Zone.
The applicant has requested relief from the lot area, lot depth and rear yard provisions for the lot
to be retained.
The R2 Zone requires a lot area of 465 sq. m (5,005 sq. ft.) while both the lot to be
severed and the lot be retained will have a lot area of 460 sq. in (4,952 sq. ft.). The R2 Zone
requires a lot depth of 30 m (98.4 feet), while both the lot to be severed and the lot to be retained
will have a lot depth of 22.9 in (75 feet).
It is the opinion of this Department that the requested variances cannot be considered to
be minor. With a lot depth of only 22.9 in (75 feet), coupled with a required front yard of 7.5 in
(24.6 feet) and required rear yard of 10.5 m (34.4 feet), the remaining building envelope is only
4.9 m (16 feet) in depth. A 4.9 in (16 feet) deep building envelope does not provide sufficient
area to permit the construction of a single detached dwelling. Should this application be
approved, it is likely that the applicant would be required to appear before the Town of
Tillsonburg Committee of Adjustment to request relief from either the rear yard and/or front yard
provisions of the R2 Zone.
The applicant has also requested relief from the rear yard provisions for the existing
single detached dwelling on the lot to be retained. As previously stated, the R2 Zone requires a
rear yard of 10.5 m (34.4 feet). Should this application be approved, the existing single detached
dwelling would have a rear yard of 5.5 m (18 feet). It is the opinion of this Department that the
requested variance for rear yard represents a significant reduction and it would not provide the
required open space and amenity area in the rear yard which is intended for a single detached
dwelling in the Town of Tillsonburg.
It should also be noted that the exterior side yard and front yard of the existing dwelling
on the lot to be retained are deficient. The R2 Zone requires an exterior side yard and front yard L S

of 7.5 m (24.6 feet), while the subject property has an exterior side yard of 0.4 m (1.4 feet) and a
front yard of 5.8 m (18.9 ft).
(d) Agency Comments
This application has been reviewed by a number of public agencies.
The Tillsonburg PUC has indicated that it has no objection to the application, however,
the PUC states that the owner or his agent shall consult with the PUC early in the design stages to
ascertain the availability and requirements, including financial conditions, of both hydro and
water servicing for the new development. The PUC adds that if re -location of its electrical
and/or water plant is required due to construction, the owner shall bear all costs associated with
the re -location.
The Town Director of Public Services and the Town Chief Building Official have
indicated that their departments have no objection to the application provided:
"1. All service connections that are required, and restorations are to be
completed to Town satisfaction and entirely at the applicant's expense, ie.
Sanitary sewer connection could be made to the existing lateral at House
#14, subject to maintenance agreement between the existing property and
proposed severed property.
2. Storm drainage plan is to be approved and registered against both properties"
The remaining responding agencies, consisting of the Oxford County Director of Public
Works and the Long Point Region Conservation Authority had no objections to or comments
with this application.
(e) Planning Review
The applicant is proposing to sever the rear yard of an existing dwelling to create a new
residential building lot. The applicant has requested relief from the lot area and lot depth
provisions for both the lot to be severed and the lot to be retained, as well as the rear yard
provisions for the lot to be retained to permit the proposed severance.
Although this property has a relatively large rear yard, it is the opinion of this Department
that it is not large enough to permit the creation of another building lot. As previously stated, the
depth of the building envelope on the lot to be severed would only be 4.9 m (16 feet) in depth
which would not permit the construction of a single detached residence without further relief
from the Town Committee of Adjustment. It is the opinion of this Department that this L 4
application does not comply with the infill policies for residential development for the Town of

Tillsonburg. We do not believe that a building lot should be created unless the building envelope
is large enough to accommodate the construction of a single detached dwelling.
RECOMMENDATION:
Whereas the variances requested are not minor variances from the provisions of the Town
of Tillsonburg Zoning By-law, are not desirable for the appropriate development or use of the
land, building or structure, are not in keeping with the general intent and purpose of the Oxford
County Official Plan, and are not in keeping with the general intent and purpose of the Town of
Tillsonburg Zoning By-law, it recommended that the Town of Tillsonburg advise the Land
Division Committee that it is not in favour of the variances requested.
It is recommended that the Council of the Town of Tillsonburg advise the Oxford County
Land Division Committee that it is not in favour of the application for consent submitted by
Steve Wagner, for property located at 14 Charles Street, being Lot 8, Reg. Plan 500, Tillsonburg
for the following reasons:
1. The application does not comply with the .policies for residential infill development for
the Town of Tillsonburg in the County Official Plan.
2. The depth of the building envelope on the lot to be severed is not large enough to
accommodate the construction of single detached dwelling.
3. The rear yard -of the lot to be retained would not provide sufficient area to accommodate
the required open space and amenity area in the Residential Second Density Zone (R2).

APPLICATION REVIEW:
(a) Proposal
An application for zone change has been submitted to the Town of Tillsonburg to permit the
construction of a single detached dwelling. The subject property has a frontage of
approximately 56 m (184 ft.), a lot area of 3,418 m2 (36,800 ft.) and presently contains no
buildings or structures. The proposed dwelling is to be serviced with a private well and a
private septic system.
A zone change is required as the present "Development (D)" zone only recognizes an
existing single detached dwelling but does not permit the construction of a new dwelling.
The D Zone is intended to act as a holding zone until such time as the property is fully
serviced and can be better utilized for residential purposes in the future.
Plate 1, Existing Zoning, indicates the location of the subject property as well as the existing
zoning in the immediate vicinity. The subject property is located in a strip of residential lots
along the north side of Potters Road. Lands to the south are used for farming purposes.
(b) Background
This property was subject to a previous application for consent to permit a small boundary
adjustment. At its meeting of September 4, 1997, the Oxford County Land Division
Committee granted application for consent #B-71 /97 to sever a small triangle of land from
the southeast corner of the property and add it to the abutting property to the east.
(c) Oxford County Official Plan
The subject property is located within the 'Low Density Residential' Designation on the
Residential Density Plan Town of Tillsonburg in the County Official Plan. All forms of low
density residential development are permitted within this designation. However, the Official
Plan states:
"All new development in the large urban centres shall be fully
serviced and shall be developed on centralized water supply
and waste water treatment systems...."
Although the Official Plan states that residential development will be directed to
residentially -designated lands within the Official Plan, it also clearly states that all new
development must proceed on full services, which includes municipal water and municipal
sanitary sewers. In this instance, the lands are to be developed with a private well and a
private septic system.

Permitting development with full services ensures Town Council can prioritize the location
of its capital works projects and proceed with orderly, planned development of its
infrastructure. Continued development in small pockets of partially serviced lands can lead
to the demand for full services should problems occur due to failures of septic systems or
contamination of ground water.
(d) Zoning By -Law
The subject property is presently zoned 'Development (D)' in the Tillsonburg Zoning By -
Law. The D Zone is intended as a holding zone until the lands are developed. The D Zone
permits a variety of farm uses, as well as residential and non-residential uses which were
in existence on the date of passing of the Zoning By -Law. The applicant has requested a
'Residential First Density (R1)' zone to permit the construction of the proposed dwelling.
It should be noted that the Tillsonburg Zoning By -Law states that where a single-family
dwelling house is permitted within the zone, it may be constructed on a lot without full
municipal services with the permission of Town Council and the Medical Officer of Health,
provided there is a minimum of 23 m (75.4 ft) of frontage and 1400 sq m (15,069 sq ft) of
lot area. The subject property complies with these lot frontage and lot area standards,
however, the D zone does not permit the construction of a new home.
(e) A eg�ncv Comments
The Oxford County Board of Health has indicated that it has no objection to the approval
of the application but notes that these comments do not imply approval of the sewage
system as shown on the site plans forming part of the application.
The Town Director of Public Services and the Town Chief Building Official have indicated
that they have no objection to the application subject to the following:
01. The applicant does not object to any future local improvements;
2. Stormwater drainage plans be approved and registered against the property,
3. Entrances are to be approved by the County of Oxford,
4. Any costs incurred by the Corporation of the Town of Tillsonburg and the
County of Oxford are at the applicant's expense. It
The Tillsonburg Public Utilities Commission has indicated that it has no objection to the
application, however, the owner or his agent shall consult with the PUC early in the design
stages to ascertain the availability and requirements of electric and water servicing for the
new building and if relocation of electric and/or water plant is required due to construction,
the owner shall bear all costs associated with the said relocation. The PUC adds that no
water main is in front of the property and they cannot provide water service to the property.

The Oxford County Director of Public Works has indicated that the applicant will need an
application for an entrance permit prior to driveway installation.
The remaining responding agencies consisting of Bell Canada, Union Gas, the Long Point
Region Conservation Authority, and the Town Economic Development Officer have no
objections to or comments with this application.
(f) Planning Review
The applicant has requested to rezone an existing lot from a D Zone to an R1 Zone to
permit the construction of a single detached dwelling. The County of Oxford Official Plan
states that development in the Town of Tillsonburg shall not take place without full
municipal services. In this instance, the applicant is proposing to service the dwelling with
a private well and septic system.
Although the Tillsonburg Zoning By -Law permits the construction of dwellings on private
services provided they meet minimum lot frontage and area requirements, the use must still
be allowed in the zone. In other words, the zone must permit a single detached dwelling
if the section of the Zoning By-law dealing with private servicing is to be utilized. In this
instance, the D Zone does not permit a new single detached dwelling and the section of the
Zoning By-law dealing with private servicing cannot be utilized.
It is the opinion of this department that the application does not comply with the policies for
residential development in the Town of Tillsonburg and the application should not be
supported.
RECOMMENDATION:
It is recommended that the Council of the Town of Tillsonburg deny the Zoning By -Law
Amendment submitted by the Estate of George Gilvesy Sr. for lands located in Lot 7 and
Part Lot 6, Registrar's Compiled Plan No. 1653 in the Town of Tillsonburg.

APPLICATION REVIEW:
(a) Proposal
An application for Official Plan Amendment has been submitted to amend the
Highway Service Commercial policies for the Town of Tillsonburg in the County of Oxford
Official Plan to permit a church. Although the Highway Commercial (C2) Zone presently
existing on the property currently permits a church, the applicant has requested a change
to the Official Plan policies to ensure that a church continues to be permitted should the
permitted uses in the Zoning By -Law change in the future.
This property was recently created under a consent application. At its meeting of
December 3rd, 1998, the Oxford County Land Division Committee approved application
#B-100/98 to create a lot to permit the construction of a church.
Plate 1, Existing Zoning, indicates the location of the subject property as well as the
existing zoning in the immediate vicinity. Lands to the west contain existing low density
residential development while lands to the north contain the former offices and works yard
of Gilvesy Construction. Lands to the east contain a proposed highway commercial building
lot which was severed at the same time as the subject property. Lands to the south contain
a mix of highway commercial uses.
(b) Official Plan
The subject property is located within the Highway Service Commercial designation
for the Town of Tillsonburg in the County of Oxford Official Plan. The applicant has
requested an amendment to the Highway Service Commercial policies to permit a church
on the subject property in addition to all the uses presently permitted.
The Official Plan states that service commercial areas provide locations for a broad
range of commercial uses that, for the most part, are not suited to locations within the
central area because of their site, area, access, or exposure requirements, or due to
compatibility conflicts with residential development. Service commercial uses generally
cater to vehicular traffic, single -purpose shopping trips where customers are generated from
passing traffic or a wide ranging market area. The Official Plan provides a sample of uses
to be permitted within the Highway Service Commercial designation. These uses include:
"hotels, motels, hotels/conference facility, automotive services, furniture
warehouses, farm implement sales, personal business services, convenience
commercial uses, recreation entertainment uses, restaurants, fast-food outlets, uses
which require large areas for on -site storage of goods or vehicles and other types
of commercial uses that offer service to the travelling public, business and industry."
This list does not contain a church. The Official Plan states that churches are
permitted in the Central Business District, the Entrepreneurial District, and all residential

designations in the Town of Tillsonburg. However, a church emulates many of the
characteristics of a highway service commercial use. New churches typically require larger
parcels of land to accommodate the sanctuary and accessory buildings as well as the
required parking spaces. In addition, visitors to churches attend for a single purpose and
visitors to larger churches are generated from a wide ranging market area.
(c) Zoning By -Law
The subject property is located within the 'Highway Commercial (C2)' Zone. The C2
Zone permits a 'church'. No site plan of the property has been submitted at this time,
however, the building will be required to conform with all standards of the C2 Zone.
If the applicant was to submit an application for building permit today, a church would
be permitted. However, the applicant is concerned that with the review of the Tillsonburg
Zoning By -Law, a church may be eliminated from the list of permitted uses in the C2 Zone.
To ensure a church remains as a permitted use on this property, the applicant has
requested this application for Official Plan Amendment to ensure the long term use of this
property includes a church.
(d) Agency Comments
The Town Director of Public Services and the Town Chief Building Official have
indicated that this application represents a large decrease in highway commercial
development along Vienna Road as is desirable under the Official Plan. They state that any
approval will require, but is not limited to, site plan agreements between the Town of
Tillsonburg and the applicant to address parking, lighting, and entrance approvals, etc.
The Tillsonburg Public Utilities Commission has indicated it has no objection to the
application provided the owner or his agent consult with the PUC early in the design stages
to ascertain the availability and requirements of electric and water servicing for the new
building and if relocation of the electric and/or water plan is required due to construction,
the owner shall bear all costs associated with the said relocation.
The remaining responding agencies consisting of Ministry of Municipal Affairs and
Housing, the Long Point Region Conservation Authority, Bell Canada, County Director of
Public Works had no objections to or comments with this application.

(e) Planning Review
The applicant has requested an amendment to the Official Plan to ensure a church
remains as a permitted use on this property in the future. Although the Tillsonburg Zoning
By -Law currently permits a church, the applicant is concerned that it may be removed from
the list of permitted uses during the comprehensive review of the Tillsonburg Zoning By -
Law.
Our Department believes that a church meets many of the criteria of a service
commercial use as churches typically cater to vehicular traffic, the people arrive for a single -
purpose trip, and the congregation is typically generated from a wide ranging market area.
Although the construction of a church at this location will reduce the inventory of lands
available for highway service commercial development, it is the opinion of this Department
that the location is suited to the construction of a larger church. We believe that the
application is appropriate and should be supported.
The Tillsonburg Site Plan Control By -Law stipulates that the construction of a church
will require approval under the Town's Site Plan Approval process. Site plan approval will
help address any potential conflict with the surrounding industrial and highway commercial
uses.
RECOMMENDATION:
It is recommended the Council of the Town of Tillsonburg advise the Oxford County Public
Health and Planning Committee that it is in favour of an Official Plan Amendment submitted
by Gilvesy Enterprises Inc. to amend Section 8.3.3.2.1, Highway Service Commercial
Policies, of the County of Oxford Official Plan to permit a church in addition to all uses
presently permitted in the Highway Service Commercial Policies.

Chair D. Beres called the meeting to Order at 7 p.m.
Chair D. Beres explained the purpose and role of the Court of
Revision under the Local Improvement Act, RSO 1990 for a sanitary
sewer and private drain connection project in the area of London
Street in the Town of Tillsonburg.
A notice dated March 22, 1999 from the Treasurer, Mr. J. Arts, was
received.
Chair D. Beres asked if there were any members of the audience that
would like to address the Court with respect to the project under
the Act.
Mr. John Vance, 4 Fox Alley, ( Roll # 2-094 ) addressed the Court and
stated that the sewer and private drain connection was provided and
that he did not connect to the line. M. Cowan explained that the
service is provided to the property line in the eventuality that he
may need to connect to that line in the future. Mr. Vance commented
that he was concerned for paying for a future connection and that
the actual costs of the project should have been closer to the
estimated costs and the ratepayers advised accordingly.
In response to a question from Mr. Jim Mercer, 60 London Street
West, (Roll # 2-319) to the Court, M. Cowan explained that the Town
assumed the cost for the sidewalk, curbs and gutter and road work,
and the ratepayer was responsible for the sanitary sewer and the
private drain connection costs across the frontage of their
property.
Mr. Peter Petropoulos, 43 Oxford Street, (Roll # 3-346) addressed
the Court and stated that he was assessed for his entire frontage
(17.4 m) when the works only went a portion (9.3 m) along that same
frontage. In response to his question, Chair D. Beres stated that
staff would investigate if he was assessed for the work along
Oxford Street some eight years ago and further that staff would
report back to him after their investigation is complete.

Mr. Julius Pozsgai addressed the Court with respect to properties
at 21 Broadway (Roll # 2-131), 23 Broadway (Roll # 2-132), 8
Bidwell Street (Roll # 2-097 ) and 4 Prospect Street (Roll # 2-398) .
In response to a question from Mr. Pozsgai, M. Cowan explained that
there was a discrepancy with respect to the number of laterals from
his property at 4 Prospect Street as it is a multi -family
residential building and that they are sometimes not uncovered
until construction of the project. M. Cowan further explained that
private drain connections are provided at the time of construction
to all lots including vacant parcels so that in the future when
those lots are developed there will be no need to reconstruct the
roads. Mr. Pozsgai stated that he was awaiting a response from the
contractor, Sierra Construction on a claim. M. Cowan stated that he
would investigate the matter further with the contractor.
Mr. Jamey MacRae, 7 Bidwell Street, (Roll # 2-076) addressed the
Court and explained that he had an unfortunate incident with the
contractor, Sierra Construction that involved lost wages, plumbing
costs, cleaning costs and advertising costs for a new tenant due to
the incorrect connection to the sanitary sewer project. M. Cowan
stated that he would contact the consulting engineer's office and
have his rear parking area restored to an acceptable condition. M.
Cowan further requested Mr. MacRae to forward any outstanding claim
to his Office so that he may forward them on to the contractor and
their insurer.
Mr. Dale Nowell, 20A Broadway, (Roll # 2-154) addressed the Court
and stated that we would like his property restored to its original
condition being an added step, grade restoration and wall
restoration. M. Cowan stated that he would meet with Mr. Nowell on
site to discuss those matters further.

Comments:
Staff have confirmed that Balazs Court is available to use as a
residential street name in the Town of Tillsonburg.
Recommendation:
It is therefore recommended that Town Council approve the use of
Balazs Court as a residential street name in the Hickory Hills
residential community (Lot 22, Plan 41M-87) as requested in a
letter dated April 15, 1999 from Hickory Hills Developments Inc.

our health care system should adapt,
to suit the needs of our aging

concerns expressed by seniors across
the province, the Ontario government
has undertaken mojor improvements
in the long-term Care system over the
last three years to ensure that Ontario
seniors enjoy high -quality health care

These major improvements include:
• a 40 por cent increase in funding
from 1995 to 1998 for community
services such as visiting nurses,
meals -on -wheels and homemnkers;

our annual spending on

safely and comfortably;
• opening new long-term care
facilities to accommodate 20.000

new facilities are built to

• rebuilding 13.200 of our existing
long-term care facility bods to
inert now standards for safety,

My understanding is that the relocation of the Parks Shop has been authorized to
proceed on a "Phase In" basis.
Office and workshop construction is to be put on hold until approval for Phase 2 has
been received from Council. On this basis I have accumulated the costs associated with
the proposed workshop and office space and deducted them from the total estimate
provided to Council. This estimate totals $6,500.
The project as approved is proceeding with a facility to accommodate storage,
washrooms and a 10 x 16' storage room for Minor Ball.
It is my sincere hope that this information addresses the concerns raised by Council.

1. Hearing dates are fixed unless the Board orders that an adjournment (postponement) will be
granted.
2. If all of the parties agree to an adjournment, a request must be made in writing to the Board as

rescheduling request must come from one of the parties.
Commentary.
The Ontario Municipal Board's statistics show that approximately 15% of the Board's hearing and
travelling time is lost due to postponing and rescheduling hearings that do not proceed on the date set
for the hearing. This results in delays in completing hearings, and substantial cost to the Board.
Hearings are usually scheduled well in advance. The Board expects that parties will conduct any
settlement negotiations, prepare their cases and raise preliminary issues well before that date and be
prepared to proceed on that day.
Lawyers and professional witnesses accepting a retainerclose to a hearing date when there is insufficient
time to prepare for the case may wish to specify to their clients that the retainer includes the seeking of
an adjournment and that if the adjournment is not granted, they may be unable to reasonably represent
the client.
Where a status hearing is held, the parties shall attend and the Board may set a time for completion of
any steps necessary before the hearing and may set a date forthe hearing orgrant a furtheradjoumment
on any reasonable terms. The Board may hold the status hearing by telephone conference call.

1. ACCOUNTING POLICIES
The financial statements of the Commission are the representation of management prepared in
accordance with accounting policies for Ontario municipalities by the Ministry of Municipal
Affairs. Since precise determination of many assets and liabilities is dependent upon future events,
the presentation of periodic financial statements necessarily involves the use of estimates and
approximations. These have been made using careful judgements.
Basis of accounting
(i) Sources of financing and expenditures are reported on the accrual basis of accounting with the
exception of principal and interest charges on long-term liabilities which are charged against
operations in the periods in which they are paid.
(ii) The accrual basis of accounting recognizes revenues as they become available and measurable;
expenditures are recognized as they are incurred and measurable as a result of receipt of goods
or services and the creation of a legal obligation to pay.
(iii)Fixed assets
The historical cost and accumulated depreciation for fixed assets are not recorded for
municipal purposes. Fixed assets are reported as an expenditure on the Statement of Operations
in the year of acquisition.
(iv) Capital outlay to be recovered in future years
"Capital outlay to be recovered in future years", which represents the outstanding principal
portion of unmatured long-term liabilities for municipal expenditures or capital funds
transferred to other organizations, is reported on the Balance Sheet.
2. SHORT-TERM INVESTMENTS
Short-term investments consist of term deposits which mature within 1999 and bear a fixed interest
rate of 4.75% (1997 — 4.1 %).

3. NET LONG-TERM LIABILITIES
(a) The balance of the net long-term liabilities is made up of the following:

The Waterworks has assumed responsibility for the payment of
principal and interest charges on certain long-term liabilities
issued by other municipalities. At the end of the year, the utility's
share of this outstanding liability is $ 30,000 $ 60,000
(b) The net long-term liabilities reported in (a) of this note are payable in 1999. Such payments
are to be recovered from users.
(c) Approval of the Ontario Municipal Board has been obtained for the long-term liabilities in (a)
issued in the name of the municipality.

5. NON -ACCRUAL OF INTEREST ON LONG-TERM LIABILITIES
No provision has been made in these financial statements for the accrual of interest on net long-
term liabilities. Had this provision been made in the financial statements, the municipal fund
balance as at December 31, 1998 would have been decreased by $527 (1997-$1,053).
6. PENSION AGREEMENTS
The Commssion makes contributions to the Ontario Municpal Employees Retirement Fund
(OMERS), which is a multi -employer plan, on behalf of three members of its staff. The plan is a
defined benefit plan which specifies the amount of the retirement benefit to be received by the
employees based on the length of service and rates of pay. The amount contributed to OMERS for
1998 was $3,758 (1997 - $9,130) for current services and is included as an expenditure on the
Statement of Operations. Effective August 1, 1998, OMERS declared a contribution holiday which
temporarily suspended payments to the plan until August of 1999.

9. YEAR 2000
The Year 2000 issue arises because many computerized systems use two digits rather than four to
identify a year. Date -sensitive systems may recognize the year 2000 as 1900 or some other date
resulting in errors when information using year 2000 dates is processed. In addition, similar
problems may arise in some systems which use certain dates in 1999 to represent something other
than a date.
The effects of the Year 2000 issue may be experienced before, on, or after January 1, 2000 and, if
not addressed, the impact on operations and financial reporting may range from minor errors to
significant systems failure which could affect an entity's ability to conduct normal business
operations. It is not possible to be certain that all aspects of the Year 2000 issue affecting the
entity, including those related to the efforts of customers, suppliers or other third parties, will be
fully resolved.

1. ACCOUNTING POLICIES
The financial statements have been prepared in accordance with generally accepted accounting
principles for municipal electrical utilities in Ontario as required by Ontario Hydro under the
authority of Section 115 of The Power Corporation Act, and reflect the following policies as set
forth in the manual "Accounting for Municipal Electrical Utilities in Ontario". Except for the
treatment of grouped assets, Note 1(c), and the treatment of contributions to capital costs, Note
1(d), all principles employed are in accordance with generally accepted accounting principles.
a) Revenue Recognition
Service revenue is recorded on the basis of regular meter readings and estimates of customer
usage since the last meter reading date to the end of the year. Estimated customer usage
from the last billing date to the year-end (unbilled revenue) is included in revenue.
b) Inventories
Inventories of materials and supplies are valued at average cost.
c) Property, plant and equipment
Capital assets are depreciated over the estimated useful lives using the straight-line method
over the following periods:

When a non -grouped capital asset is sold or otherwise disposed of, the related cost and
accumulated depreciation are removed from the respective accounts and any gain or loss on
disposition is recognized in earnings.
Grouped assets are, by their nature, not readily identifiable as individual assets. The related
cost and accumulated depreciation is therefore removed from the respective accounts at the
end of their estimated useful lives regardless of actual service life. Any proceeds on
disposition are recognized in earnings in the year of disposition.
d) Contributions received during the year
Contributions to capital costs are received from developers and contractors and included as a
permanent component of capital surplus. The related capital assets are set up and
depreciated at their full cost.

Customer deposits held as security for energy consumption bear interest at a rate of 3% per annum,
as per Commission policy. Interest is paid at the time of refund of the deposit to the customer.
The amount of these deposits that are estimated to be potentially refundable in the current year

Under the Power Corporation Act, the price payable to Ontario Hydro for power is the cost of

As of December 31, 1998, the accumulated net appropriations in respect of debt retirement to
Ontario Hydro was not available for financial statement disclosure (1997 - $3,056,674).
Prior to 1997, the Commission disclosed the amount on the balance sheet as an asset and Ontario
Hydro Sinking Fund Equity, however, due to the inability to assess the value of this asset or its
likelihood of ever being realized, the Commission has determined that these amounts should not
appear in the financial statements.

10. LAW SUIT
A class action claiming $500 million in restitutionary payments plus interest was served on
Toronto Hydro on November 18, 1998. The action was initiated against Toronto Hydro Electric
Commission as the representative of the Defendant Class consisting of all municipal electric
utilities in Ontario which have charged late payment charges on overdue utility bills at any time
after April 1, 1981.
The claim is that late payment penalties result in the municipal electric utilities receiving interest at
effective rates in excess of 60% per year, which is illegal under Section 347 (1)(b) of the Criminal
Code.
The Municipal Electric Association is undertaking the defense of this class action. At this time, it
is not possible to quantify the effect, if any, on the financial statements of the Commission.
11. DEREGULATION IN THE UTILITIES INDUSTRY
Bill 35 (the Energy Competition Act, 1998) received Royal Assent on October 30, 1998. Bill 35
establishes two primary Acts, the Electricity Act 1998 and the Ontario Energy Board Act 1998.
These Acts restructure the electrical industry in Ontario, providing for a gradual transition from
the Power Corporation Act, and creating competition in the generation and the sale of electricity in
the year 2000.
The Ontario Energy Board Act transfers the regulatory authority for municipal electric utilities
from Ontario Hydro to the Ontario Energy Board (OEB). The OEB has new and expanded powers
for regulating rates and licensing participants in the new competitive market.
By November 7, 2000, all municipal electric utilities are required to incorporate under the Ontario
Business Corporations Act with a Board of Directors. Initially, the Town of Tillsonburg will be
the sole shareholder of the new Hydro Corporation.
While the Energy Competition Act, 1998 has received Royal Assent, the rules and regulations to
establish the competition market have not been fully defined at this point in time. As a result, the
future operating environment of the electrical industry is still evolving.

12. YEAR 2000
The Year 2000 issue arises because many computerized systems use two digits rather than four to
identify a year. Date -sensitive systems may recognize the year 2000 as 1900 or some other date
resulting in errors when information using year 2000 dates is processed. In addition, similar
problems may arise in some systems which use certain dates in 1999 to represent something other
than a date.
The effects of the Year 2000 issue may be experienced before, on, or after January 1, 2000 and, if
not addressed, the impact on operations and financial reporting may range from minor errors to
significant systems failure which could affect an entity's ability to conduct normal business
operations. It is not possible to be certain that all aspects of the Year 2000 issue affecting the
entity, including those related to the efforts of customers, suppliers or other third parties, will be
fully resolved.

Throne Speech Stresses Stron conomy

The Honourable Hilary M. Weston, Lieutenant Governor of Ontario, presented the Speech from the
Throne today at the opening of the current legislative session. The Throne Speech spoke of the
importance of a strong economy as a means of enhancing the quality of life in Ontario, and the need
for strong leadership and clear actions on the part of the government. The government has projected
a balanced budget for 2000 - 2001.
The Throne Speech outlined 4 key steps to achieve the government's mandate - to continue to reduce
taxes, to eliminate red tape in legislation and regulations, to eliminate barriers to internal trade, and
to enhance economic and industrial competitiveness through job creation and by attracting investment.
Today's speech also included references to a number of government programs, including:
wr Educatipn, calling for the creation of a new Charter of Educational bights and Responsibilities,
and a new province -wide code of conduct for students that will provide clear standards of
behaviour and spell out the consequences of breaches of the code;
wr Welfare, and the need to continue to reduce dependency, as well as the need to consider
amendments to the Child and Family Services Act;
wr Public healthcare, citing the importance of a strong economy to allow continued reinvestment in
the healthcare system, and the importance of returning increases in federal funding to provincial
healthcare, to provide more nurses and new long term care beds.
The Throne, Speech also provided that the government would be considering legislation to ensure
protection f r taxpayers, by limiting taxation levels, as well as legislation requiring any future provincial
government to operate on a balanced budget within any fiscal year, as previously proposed by Bill 99.
The governent also recognised the need to further consult on its proposed disability legislation before
it is introdu d again.
Status:
Today's Throne Speech contained very little new information, and did not reference municipalities
directly. AMO will monitor the activities of the House now that it has reconvened, and will report any
significant legislative announcements and provide an analysis of the 1999 - 2000 Ontario Budgetwhen
it is presented in May.
