2991 To authroize the Mayor and Clerk to execute an agreement between the Town of Tillsonburg and the County of Oxford to lease space for the provisions of the Land Ambulance ServicesCORPORATION OF THE TO" OF TILLSONIBURG BY-LAW NO. 2991 BEING A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CORORATION OF THE TOWN OF TILLSONBURG AND THE COUNTY OF OXFORD TO LEASE SPACE FOR THE PROVISION OF THE LAND AMBULANCE SERVICES. WHEREAS subsection 113(1) of the County of Oxford Act, R. S. 0. 1990 Chpt. C.42 provides that County Council may pass By-laws under section 201, paragraph 23, of the Municipal Act R. S.0. 1.990 Chpt. M.45 for the use of another Municipality's staff and facilities. AND WHEREAS section 27 of the Interpretation Act R.S.O. 1990 Chpt. I - I I stipulates the right of a Municipal Corporation to contract without further express provisions in Statute. AND WHEREAS Council of the Town of Tillsonburg is desirous of entering into an agreement with the County of Oxford for the purpose of leasing space to accommodate the needs required to provide Land Ambulance Services in the Tillsonburg area. THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF TILLSONBURG ENACTS AS FOLLOWS: 1, THAT the Mayor and Clerk are hereby authorized and instructed to sign an Agreement with the Corporation of the County of Oxford for the use of a portion of the Tillsonburg Fire Station,, municipally known as 80 Concession Street East, Tillsonburg, for Land Ambulance Service purposes and such other related appurtenances in accordance with the Agreement attached hereto as Schedule "A" to this by-law. 2. AND THAT this by-law shall come into force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME, AND FINALLY PASSED this 12th day of November, 2001. MEMORANDUM OF AGREEMENT -between - THE CORPORATION OF THE COUNTY OF OXFORD ("Oxford County") - and - THE CORPORATION OF THE TOWN OF TIILLSONBURG ("Town of Tillsonburg") Whereas Council for the County of Oxford has approved the interim re -location of ambulance services in the Town of Tillsonburg; And Whereas an ambulance station location in Tillsonburg is required; And Whereas the Tillsonburg Fire Hall is a suitable facility to house ambulance crews and vehicles; The Parties therefore agree as follows: 1. Ambulance services will be re -located from the Tillsonburg District Memorial Hospital (TDMH) to the Tillsonburg Fire Hall located at 80 Concession Street East, Tillsonburg, Ontario, N4G 4Z8 2. The re -location will commence in October 2001, where: The Town of Tillsonburg will: a. cement and sea[ the floor at the "fire pole" in the Fire Training Room, as identified in Appendix A; b. repair or replace the window blinds in the ambulance crew quarters, as identified in Appendix A; c. paint the ambulance crew quarters; d. remove all equipment and items, except the air tank refilling station, in the ambulance bay, as identified in Appendix B; e. paint the ambulance bay; f. add additional lighting in the ambulance bay; g. repair, at their cost, the drainage system in the ambulance bay; and h. remove the reserved parking spaces in front of the ambulance bay, as identified in Appendix B; i. install a divider wall with a doorway in the current training room to separate the ambulance crew quarters from the fire training room, as identified in Appendix A; j. install a lock on the male washroom door in the ambulance crew quarters,, and; k. install exterior electrical outlets suitable for providing AC power to heat ambulances parked outside the fire hall. The County of Oxford will: 1. arrange with Bell Canada for the installation of a residential telephone line in the ambulance crew quarters, as identified in Appendix A; m. be responsible for the installation and service costs of the residential telephone; n. arrange with the local coaxial company for the installation of cable TV in the ambulance crew quarters; o. be responsible for the installation and services costs of the coaxial line; p. furnish the ambulance crew quarters; q. arrange the installation of an exhaust ventilation system in the ambulance bay; r. furnish locked equipment and supply cupboards in both the ambulance bay and the storage area, as identified in Appendix B; 3. The Emergency Health Services Branch (EHSB} of the Ministry of Health will install, at no cost to the Town of Tillsonburg,, a communication/base paging/telephone system for ambulance services at the Tillsonburg Fire Hall; The Town of Tillsonburg will provide EHSB access to the fire hall for communication installation purposes; 4. On December 1, 2001, ambulance services will operate from the Tillsonburg Fire Hall; a. The paramedic crews will be primarily within the ambulance crew quarters; b. The 24/7 ambulance vehicle will be accommodated in the ambulance bay; and c. Two ambulances will be located outside the fire hall, as identified in Appendix B; 5. The Town of Tillsonburg will supply an access key to the entrance door identified in Appendix B; Oxford County will duplicate the key in order to provide an access key to each paramedic assigned to Tillsonburg; 6. The Town of Tillsonburg will ensure access to the female washroom located on the main floor of the Fire Hall to be used by female paramedics. 7. Oxford County will pay the Town of Tillsonburg, Eleven Hundred Dollars per Month ($1,100.00/month) for the use of the Fire Hall for ambulance services as described in paragraph 4. The payment will be advanced semi-annually. 8. This agreement expires December 31, 2003; 9. Either party may terminate this agreement, at any time,, where six months prior written notice is provided; 10. With mutual consent by both parties, this agreement may be extended or renegotiated after December 31, 2003; 11. Dispute Resolution In the event a dispute occurs between staff of the respective parties: The dispute, concern, and/or complaint will be forwarded to a senior officer by staff. In turn, the senior officer will forward the dispute, concern and/or complaint to the Fire Chief, or the Manager of Ambulance Services, as the case may be. The Fire Chief and the Manager of Ambulance Services will cooperatively find resolution and respond to the senior officer of the resolution. Both the Tillsonburg Fire Department and Oxford County EMS will develop respective policy on the dispute resolution process that will be forwarded to staff. 12. This agreement may be amended from time to time upon the mutual consent of both parties. A* Dated this Of 2001.
