3001To prohibit/regulate bicyles, skateboards, roller skates, roller blades, inline skates, scooters etc. on certain sidewalks, parking lots or roadwaysCORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NO. 3001 BEING A BY-LAW TO PROHIBIT AND/OR REGULATE BICYCLES, SKATEBOARDS, ROLLER SKATES, ROLLER BLADES, INLINE SKATES, SCOOTERS OR CONVEYANCES OF SIMILAR DESCRIPTION ON CERTAIN SIDEWALKS, PARKING LOTS OR ROADWAYS WITHIN THE TOWN OF TILLSONBURG WHEREAS The Municipal Act, R.S.O. 1990, c. M-45, Section 207 (42) provides that Councils of all municipalities may pass bylaws to prohibit carriages, wagons, bicycles, sleighs and other vehicles and conveyances of every description, and whatever the mode power, or any particular kind or class of such vehicles or conveyances being upon, or being used, drawn, hauled or propelled along or upon, any sidewalk, pathway or footpath used by or set eipart for the use of pedestrians and forming part of any highway or bridge, boulevard other means of public communication, or being in or upon any highway, boulevard, park, parking lot, garden or other place set apart for ornament or embellishment or for public recreation. AND WHEREAS it is deemed expedient for the safety and welfare of pedestrians to prohibit and /or regulate the use of certain types of conveyances within the Town of Tillsonburg. BE IT THEREFORE ENACTED by the Council of the Corporation of the Town of Tillsonburg as follows: 1. No person shall use, ride on or operate any conveyance, which may be described as a "skateboard"on any sidewalk, boulevard, square, parking lot or on any roadway within the downtown core area as marked in Figure 1 hereto. 2. No person shall use, ride or operate any bicycle, motorized vehicle or similar conveyance other than a conveyance designed for the handicapped, on any side walk or walkway, square, or boulevard within the downtown core area as marked in Figure 1 hereto. 3. In areas other than the area set out in Clauses 1 and 2 hereof, any person who uses rides on or operates any bicycle, skateboard, roller skates, roller blades, inline skates, scooters or similar wheeled conveyances on any public sidewalk or walkway within the Town of Tillsonburg, shall at all times give right-of-way to pedestrians using such sidewalks or walkways. 4. Any person who contravenes any provision is, upon conviction, guilty of an offence and is liable to any penalty as provided in the Provincial Offences Act. 5. The court in which the conviction has been entered and any court of competent Jurisdiction thereafter, may make an order prohibiting the continuation or repetition of the offence by the person convicted and such order shall be in addition to any other penalty imposed on the person convicted. 6. By-law #2488 and all its amendments are herby repealed. 7. This By-law shall come into force and effect upon final passing. READ A FIRST AND SECOND TIME this 10th day of December, 2001. thREAD A THIRD TIME AND FINALLY PASSED this llin day of February, 2002 RESTRICTED AREA REFERRED TO IN CLAUSES 1 AND 2 "Downtown Area" (See figure 1 below) means that portion of the Town of Tillsonburg commencing at the intersection of the production westerly of the northerly limit of Bridge Street and the westerly limit of Rolph Street; thence southerly along the westerly limit of Rolph Street, to the production westerly of the southerly limit of Baldwin Street; thence generally in a easterly direction to a point at the intersection of the southerly limit of Baldwin Street, and the westerly limit of Coon Alley; thence southerly along the westerly limit of Coon Alley to a point at the intersection of the southerly limit of London Street, and the westerly limit of Coon Alley; thence easterly along the southerly limit of London Street to a point at the intersection at the southerly limit of London St. and the westerly limit of Bidwell St; thence generally in a southerly direction along the westerly limit of Bidwell Street, to a point at the intersection of the westerly limit of Bidwell Street, and the northwesterly limit of John Pound Road; thence from the point commencing at the intersection of the production of the southeasterly limit of John Pound Road, and the southwesterly limit of Bloomer St.; thence generally in a easterly direction along the southerly limit of Bloomer St., to a point of the intersection of the northeasterly limit of Bloomer St., arid the southerly limit of Simcoe St.; thence generally in a northerly direction along the easterly limit of Tillson Avenue to the production easterly of the northern limit of Brock Street East.; thence generally in a westerly direction along the northerly limit of Brock Street East to a point at the intersection of the northerly limit of Brock St. East and the easterly limit of Lisgar Avenue.; Thence generally in a northernly direction along the easterly limit of Lisgar Avenue to a point at the intersection of the easterly limit of Lisgar Avenue and northerly limit of Bridge St.East; thence generally in a westerly direction along the northerly limit of Bridge St. to the point of commencement.
