3152 To authorize an agreement between the the corporation of the town of tillsonburg and firemans associationBY-LAW NUMBER 3152 A BY-LAW TO AUTHORIZE AN AGREEMENT BETWEEN THE CORPORATION OF THE TOWN OF TILLSONBURG AND FIREMAN'S ASSOCIATION WHEREAS the Corporation of the Town of Tillsonburg deems it necessary and expedient to enter into an agreement with Tillsonburg Fireman's Association; THEREFORE the Council of the Town of Tillsonburg enacts as follows: 1. THAT the Agreement attached hereto as Schedule "A" and forming part of this By-law between the Corporation of the Town of Tillsonburg and The Tillsonburg Fireman's Association is hereby approved; 2. THAT the Mayor and Clerk be hereby authorized to execute the attached agreement marked as Schedule "A" on behalf of the Corporation of the Town of Tillsonburg. READ A FIRST, SECOND AND THIRD TIME PASSED THIS 11 th DAY OF APRIL, �nn_� MAYOR -Stephen Molnar CLERK -Michael Graves MEMORANDUM OF UNDERSTANDING BETWEEN The Corporation of the Town of Tillsonburg, "The Town" -and- Tillsonburg Fireman's Association "The Association" TT IS MUTUALLY UNDERSTOOD THAT, if Council of the Town of Tillsonburg finds it desirable to provide a tiered response system in the Town of Tillsonburg, the Association shall be consulted prior to any such action being implemented. IT IS FURTHER UNDERSTOOD THAT this Memorandum of Understanding shall remain in force and effect until December 317 2007. TILLSO BUR 'R A r ' �yASSTION r A THE CORPORATION OF THE TOWN OF TILLSONBURG Mayor i A iCler A % t ire Chief Tl -11S AGREEMENT made in triplicate this 31 day of March, 2005 BETWEEN: TtI_LSONBURG FIREMAN'S ASSOCIATION Hereinafter referred to as "the Association" OF THE FIRST PART -and- THE CORPORATION OF THE TOWN OF TILLSONBURG hlereinafter referred to as "the Corporation" OF THE SECOND PART WHEREAS the Town of 1 illsonburg is desirous of entering into an Agreement for volunteer firefighting services, NOW THIS AGREEti1ENT WITNESSETH AS FOLLOWS: 1. The Corporation recognizes the Association in representing the Tillsonburg Volunteer Firefighters. 2. The Corporation shall pay to the Members of the Association an honorarium and training pay as set out in Appendix "A" to this Agreement, attached hereto and forming part of this Agreement. 3. The Corporation shall pay to the Members of the Association who are authorized to attend fire prevention and/or protection, special or public education events at the same rate as training pay as set out in Appendix "A" to this Agreement, attached hereto and forming part of this Agreement. 4. The Corporation shall pay to the Members of the Association who are designated from time to time to respond to non -emergency calls in the absence of the Fire Chief or Deputy Fire Chief to be compensated at the same rate as training pay (minimum of one (1) hour) as set out in Appendix "A" to this Agreement, attached hereto and forming part of this Agreement. 5. The Corporation shall pay to the Association a standby pay for Halloween Eve and Halloween Night as set out in Appendix "A" to this Agreement, attached hereto and forming part of this Agreement. b. The Corporation shall pay to the Members of the Association a per diem for authorized out-of-town attendance for fire training or authorized attendance at work related functions on behalf of the Corporation as set out in Appendix "A" to this Agreement, attached hereto and forming part of this Agreement. 7. The Corporation shall contribute to the Association towards the cost of a "Ladies Night" for each Member in active employ of the Corporation including the Fire Chief and Deputy Fire Chief as set out in Appendix "A" to this Agreement, attached hereto and forming part of this Agreement. S. The Corporation agrees that actively employed Members, from whom no coverage is available at their regular place of employment, be permitted to enroll in the Corporation's medical and/or dental insurance policy, on the provision and clear understanding; that the cost of such benefits be deducted from the Member's salary and is not to be paid for nor contributed towards by the Corporation. 9. The Corporation agrees to provide group life insurance coverage to each Member in the amount of z' $35, 000 triple indemnity. The cost of such insurance shall be paid by the Corporation. 10. The Corporation agrees to provide accident insurance coverage from American Home Assurance Company as developed by Volunteer Firemen's Insurance Services, Inc., as per outline of coverage set out in Appendix "B" to this Agreement, attached hereto and forming part of this Agreement. The cost of such insurance coverage shall be paid by the Corporation. 11. The Corporation agrees that Members be provided with the opportunity to purchase RRSP's through the payroll deduction plan, as administered and registered by the Corporation. 12. During the term of this Agreement, Members shall receive an aruival dry-cleaning/Clothing damage allowance payable in July of each year during the term of this Agreement as set out in Appendix "N' to this Agreement, attached hereto and forming part of this Agreement. 13. The Corporation agrees that the blazer type uniforms, consisting of shirt and tie, a blue blazer and a grey pair of trousers, as supplied to the Members of the Association, will be replaced for each Member after every fire (5) years of service, if requested. The initial such uniform will be issued to new Members on completion of a six-month probationary period. 14. For the use of his/her personal vehicle, each member shall receive an annual Emergency Response fuel reimbursement, payable in July of each year during the term of this Agreement as set our in Appendix "A" to this Agreement, attached hereto and forming part of this Agreement. 15. The term of this Agreement shall be from January 1, 2005 to December 31, 2007. IT WITNESS WHEREOF the said Parties hereto have hereunto set their hands and seals this 31 day of March, 2005.
