3231 To authorize the purchase and sale of certain lands.BY-LAW NUMBER 3231 OF THE CORPORATION OF THE TOWN OF TILLSONB URG A BY-LAW to authorize the purchase and sale of certain lands. WHEREAS pursuant to Section 8 of the Municipal Act , 2 0 01 , S.O. 200l, C . 2 5 , a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act,; AND WHEREAS The Corporation of the Town of Tillsonburg has agreed to purchase certain lands and agreed to sell certain lands of approximately 140 acres as described in the Agreement of Purchase and Sale dated September 29, 2005; THEREFORE the Council of the Town of Tillsonburg enacts as follows: 1. THAT by-law 3226 is hereby appealed. 2. THAT Council of the Town of Tillsonburg does hereby authorize the purchase of lands from Willowhawk Farms being Part of Lot 7, Concession 4, North of Talbot Road, more particularly described as Part 1, on reference plan 37R- 7645, in the County of Norfolk, save and except part 1, 37R-9089. 3. THAT Council of the Town of Tillsonburg does hereby authorize the purchase of lands from Willowhawk Farms being Part of Lot 1612, Plan 500 more particularly described as Part 1, on reference plan 41 R, 7399, in the Town of Tillsonburg, County of Oxford 4. THAT Council of the Town of Tillsonburg does hereby authorize the purchase of lands from Carol Lee Gubesch being Part of Lot 1612, Plan 500, more particularly described as Part 1 on reference plan 41 R-6116, save and except Part 1 & 2, on reference plan 41 R-7399, in the Town of Tillsonburg, County of Oxford. 5. THAT Council of the Town of Tillsonburg does hereby authorize the purchase of lands from Carol Lee Gubesch being Part of Lot 7, Concession 4, North of Talbot Road, more particularly described as Part 1 on reference plan 37R- 9089, in the Town of Tillsonburg, County of Oxford. 6. THAT Council does hereby authorize the sale of the following lands to the Canadian Sweet Potato Ethanol Alliance: a) Part of Lot 7, Concession 4, North of Talbot Road, more particularly described as Part 1, on reference plan 37R-7645, in the County of Norfolk b) Part of Lot 1612, Plan 500, more particularly described as Part 1 on reference plan 41 R-6116, save and except Part 2, on reference plan 41 R- 7399, in the Town of Tillsonburg, County of Oxford. c) Part of Lot 1613, Plan 500, more particularly described as Part 2, on Plan OXR39, in the Town of Tillsonburg, County of Oxford d) Part of Lot 8, Concession 4, North of Talbot Road, more particularly described as Part 3 on Plan OXR39, in the Town of Tillsonburg, County of Oxford. 7. THAT the Council of the Town of Tillsonburg does hereby authorize the conveyance of these lands being approximately 140 acres as described in the Agreement of Purchase and Sale dated September 29, " 2005; 8. THAT the Mayor and Clerk be hereby authorized to execute on behalf of the Corporation of the Town of Tillsonburg, all documents required to implement the conveyance of lands.
