A BY-LAW to designate the property located in Part Lot 976 & 977, Plan 500 in the Town of
Tillsonburg, in the County of Oxford.
WHEREAS .Part IV of the Ontario Heritage Act, R.S.O. 1990 as amended provides that by-
laws may be passed by Council to designate a property within the municipality to be of cultural
heritage value or interest:
AND WHEREAS the Cenotaph is located in the Town of Tillsonburg and has been reviewed by
the Heritage Advisory committee as being eligible for designation under Part IV of the Ontario
Heritage Act.
AND WHEREAS Notice of Intention to pass a Designation by-law was given in accordance with
Section 29 of the Ontario Heritage Act in the manner as set out. in Schedule "A" of this by-law
on the 19th day of
AND WHEREAS the Town of Tillsonburg is the property owner.
AND WHEREAS the Council of the Corporation of the Town of Tillsonburg deems it expedient
to designate the Cenotaph as a property of cultural heritage value and interest under Part IV of
the Ontario Heritage Act.
THEREFORE the Council of the Town of Tillsonburg enacts as follows:
L THAT the Cenotaph is a property of significant cultural heritage value and interest.
2. THAT the reasons for designation are hereby included within the Notice of Intention to
pass a designation By-law and are attached hereto in Schedule "B" and Mayor and
Clerk be hereby authorized to execute the attached agreement marked as Schedule
"A" on behalf of the Corporation of the Town of Tillsonburg.
3. That the Clerk shall cause a copy of this By-law together with its Schedules to be
registered against the property in the Land Registrars Office and shall serve a copy of
the By-law together with its Schedules upon the property owner and the Ontario
Heritage Trust.
4. THAT the by-law shall take force and effect upon final passage hereof.

I, Michael Graves, Clerk of the Corporation of the Town of Tillsonburg hereby swear or affirm
that Notice of Intention to pass a designation by-law for the Town Cenotaph being part of lot 976
& 9771, Plan 500, in the Town of Tillsonburg, under Part IV of the Ontario Heritage Act was
given in accordance with Subsection 29(3) of the Act as follows:
1. Notice of Intention was published in the November 4th, 2009 edition of the Tillsonburg
News; and
2. Notice of Intention was sent together with a copy of the proposed Designation By-law
and Schedules to:
a) Property Owner
b) Ontario Heritage Trust
3. Notice of Intention, together with a copy of the proposed Designation By-law and
Schedules, werep osted on or before November 4th, 2009 at the following locations:

TILLSONBURG CENOTAPH IN THE TOWN OF TILLSONBURG IN THE PROVINCE OF
ONTARIO
NOTICE OF INTENTION TO DESIGNATE
TAKE NOTICE that the Council of the Corporation of the Town of Tillsonburg intends to
designate the following property as being of cultural heritage value or interest under Part IV of
the Ontario Heritage Act, R.S.O. 1990, Chapter 0.18, as amended.
Tillsonburg Cenotaph
Description of the Property
The property is located in front of the current Town Centre Mall and has not moved from where
it was originally located in front of the old Town Hall for the Town of Tillsonburg.
First unveiled November 11, 1929
Statement of Cultural Heritage Value or Interest
Given the rather large amount spent on building the cenotaph a statement was made by our
ancestors that they never wanted to forget the sacrifice made by the individuals that served in the
war. As such the responsibility is handed to us to ensure that the culture of acknowledging the
important efforts of our forefathers is not forgotten.
Description of Heritage Attributes
The cenotaph was built in 1929 as a monument to the Great War. Later World War 11 and Korea
were added to the monument. On each side of the Cenotaph are the battles in which Tillsonburg
residents participated.
The granite used for the *Tillsonburg Cenotaph is the same granite used for the gargoyles on the
Peace Tower at the Canadian Parliamentary buildings.
The cenotaph is generally along the lines of the famous cenotaph in Whitehall, London, England.
The cenotaph has been the focal point of all remembrance day ceremonies since its unveiling in
1929.
Despite all the changes in the downtown, the cenotaph has remained the one constant not moving
since its construction some 80 years ago.
Objections to the proposed designation must be received by the Clerk of the Town of Tillsonburg
by Registered Mail or hand -delivered together with a statement of the reasons for the objection
and all relevant facts, not later than 4:00 pm on the 18th day of November, 2009. Objections
will be referred to the Conservation Review Board for a hearing and report.
