3444 To delegate executive authority for Decisions to the Chief Administrative Officer, and in her absence the Director of Finance, in the event Council finds itself subject to Section 275 of the Municipal Act regarding "Restricted Acts After Nom'113 Dill BY-LAW NUMBER 3444 A By -Law to delegate executive authority for Decisions to the Chief Administrative Officer, and in her absence the Director of Finance, in the event Council finds itself subject to Section 275 of the Municipal Act regarding "Restricted Acts After Nomination." WHEREAS Section 275 of the Municipal. Act, 2001, S.O. 2001, c.25, limits the executive authority of Counci l during an election year should three-fourths of the sitting council members not file nomination papers and/or if three-fourths of the sitting council are not declared elected after voting day; AND WHEREAS Section 275 (3) of the Municipal Act, 2001, S.O. 2001, c.25 restricts council from taking action on the following: a) The appointment or removal from office of any officer of the municipality; b) The hiring or dismissal of any employee of the municipality; c) The disposition of any real or personal property of the municipality which has a value exceeding $50,000 at the time of disposal; and d) Making any expenditure or incurring any other liability which exceeds $50,000. AND WHEREAS Section 275 (6) of the Municipal Act, 2001, S .O. 2001, c.25, allows a council to delegate such authority to a person prior to the nomination day for a new council: BE IT RESOLVED THAT the Council of the Corporation of the Town of Tillsonburg, delegate's executive authority for decisions to the Chief Administrative Officer, and in her absence to the Director of Finance, in the event Council finds itself subject to Section 275 of the Municipal Act, regarding "Restricted Acts After Nomination" pursuant to the following protocols: 1. Prior to making a decision, the matter will be discussed with the sitting Council. 2. The decision must have concurrence of the sitting Council by two-thirds consensus. 3. If due to the urgency of the situation, a decision must be made prior to receiving the concurrence of the sitting Council, the CAO and Directors, will proceed with the decision and inform the sitting Council at the earliest convenience and incorporate any subsequent permissible revisions. 4.
