3514 Pre-Consultation By-lawTHE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER 3514 A by-law to require an applicant to consult with the Town of Tillsonburg prior to making an application for Zone Change or Site Plan Approval as per the Planning Act. WHEREAS Subsections 34(10.0.1) and 41(3.1) of the Planning Act. R.S.O. 1990, c. P. 13, as amended (the "Act"), permit Town Council, by by-law, to require an applicant to consult with the Town before submitting a request to amend Zoning By-law No. 3295 or prior to submission of an application; AND WHEREAS the purpose of consultation prior to making an application is to permit the Director of Development and Communication Services, or his/her delegate and the County Development Planner to have an opportunity, in consultation with the applicant, to clarify the information and materials that the applicant may be required by the to submit concurrently with the application; NOW THEREFORE the Town Council of The Corporation of the Town of Tillsonburg enacts as follows: 1. Definitions: the "Act" shall mean the Planning Act, R.S.O. 1990, c. P. 13, as amended "Applicant" shall mean: i. a person or public body applying to Council to amend Zoning By-law No. 3295, under section 34 of the Act; or ii. a person applying for Site Plan Approval of plans and drawings under section 41 of the Act; "Application" shall mean: i. an application or applications to amend Zoning By-law No. 3295 under section 34 of the Act; and ii. a submission or submissions of plans and drawings for Site Plan Approval under section 41 of the Act; "Council" shall mean the Council of The Corporation of the Town of Tillsonburg; "Formal Consultation Meeting" shall mean a meeting with the Director of Development and Communication Services or his/her designate and the County Development Planner, and additional Town/County staff or applicable provincial agencies, as the case may be, as permitted in subsections 34(10.0.1) and 41 (3.1) of the Act; The Corporation of the Town of Tillsonburg By-law Number 3514__________________________________________ "Director of Development and Communication Services" shall mean the person who holds the position of Director of Development and Communication Services for The Corporation of the Town of Tillsonburg or his/her designate; "County Development Planner" shall mean the person who holds the position of County of Oxford Development Planner responsible for providing Planning services within the Corporation of the Town of Tillsonburg, or his/her designate; "Record of Formal Consultation" shall mean a written document (included as 'Appendix A' to Site Plan Control By-law 3513) that includes the following information: i. the date, or dates, that the Formal Consultation Meeting or any further Formal Consultation Meeting is held; ii. a copy of a written summary of the proposed application provided by the applicant to the Director of Development and Communication Services and/or the County Development Planner, as the case may be; iii. a copy of a written statement identifying the information and materials from Section 10.5 that may be required; iv. a copy of any written minutes of the Formal Consultation Meeting; and v. a statement that the Consultation Meeting has occurred. "Section 10.5" shall mean Section 10.5 of the Official Plan of the County of Oxford, as approved by the Ministry of Municipal Affairs and Housing, as amended. 2. An applicant shall consult with the Director of Development and Communication Services and/or the County Development Planner, as the case may be, as follows: i. for applications to amend Zoning By-law No. 3295, prior to filing application to amend said Zoning By-law under subsection 34(10) of the Act; and ii. for submissions of plans and drawings for Site Plan Approval, prior to submitting the said plans and drawings for approval under subsection 41 (4) of the Act; The Corporation of the Town of Tillsonburg By-law Number 3514 ___________________________________________ 3. An applicant shall deliver to the County Development Planner, a written summary of the applicant's proposed application, including the location of the subject property, the current use of the property, and a short summary of the proposed application including servicing requirements and any prepared drawings. 4. The Director of Development and Communication Services and/or the County Development Planner, shall: determine the written form or format of the Record of Consultation; determine whether the applicant's written summary shall be submitted at the date of the Formal Consultation Meeting or prior to the Formal Consultation Meeting; iii. determine whether additional information or material is required from the applicant other than the information contained in the written summary, for the purpose of conducting the Formal Consultation Meeting; iv. determine whether more than one Formal Consultation Meeting is required and, if more than one Meeting is determined to be required, shall make all necessary arrangements with the applicant; v. prepare the Record of Consultation; and vi. deliver a copy of the Record of Consultation to the applicant within seven (7) business days of the date of the last Formal Consultation Meeting. Delivery may be personal, by email or by regular letter mail, at the discretion of the Director of Development and Communication Services and/or County Development Planner. 5. This by-law comes into force and effect on the date that it is passed.
