3989 To amend Zoning By-Law 3295, as amendedTHE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER 3989 A By-Law to amend Zoning By-Law Number 3295, as amended. WHEREAS the Municipal Council of the Corporation of the Town of Tillsonburg deems it advisable to amend By-Law Number 3295, as amended. THEREFORE, the Municipal Council of the Corporation of the Town of Tillsonburg, enacts as follows: 1. That Section 5.24.2.2 to By-Law Number 3295, as amended, is hereby deleted and replaced with the following: "5.24.2.2 5.24.2.2.1 5.24.2.2.2 5.24.2.2.3 ACCESSIBLE PARKING Accessible parking spaces are to be provided in two sizes for all non-residential and multiple residential uses including, an aparlment dwelling, boarding or lodging house and multiple unit dwelling, as identified on Schedule "C-3": (i) Type A shall have a minimum width of 3.4 m (11.2 ft) and a minimum length of 5.5 m (18 ft). (ii) Type B shall have a minimum width of 2.7 m (8.9 ft) and a minimum length of 5.5 m (18 ft). REQUIRED NUMBER OF ACCESSIBLE PARKING SPACES As part of the required off street motor vehicle parking spaces required under Section 5.24.2.1, parking spaces dedicated for Accessible Parking shall be provided as follows: 101 -200 201 -1,000 1,001 or greater 1% of total required parking spaces + 11 LOCATION OF ACCESSIBLE PARKING SPACES Accessible parking spaces shall be: Where an even number of accessible parking spaces are required an equal number of Type A and Type B spaces must be provided. Where an odd number of total accessible parking spaces are required the additional space may be a a) constructed at the same grade as the entry to the building or entry to the access ramp or structure designed to facilitate entry for those requiring accessible parking; b) located within close proximity to the building or access ramp or structure; and, c) clearly identified and reserved for the exclusive use of as accessible parking spaces. The Corporation of the Town of Tillsonburg By-law Number 3989 Page2 5.24.2.2.4 ACCESSIBLE PARKING AISLE REQUIREMENTS A parking aisle shall be provided for all accessible parking spaces and may be shared by two adjacent parking spaces, in accordance with the following provisions: (i) A parking aisle shall have a minimum width of 1.5 m (4.9 ft) and extend the full length of the parking space. (ii) A parking aisle shall be marked with high tonal contrast diagonal lines, which discourages parking, where the surface is asphalt, concrete or some other hard surface." 2. That Section 6.5.13 'North Side of Fairview Street (Part Lots 11-13, Plan 517) R1-13' to By-Law Number 3295, as amended, is hereby deleted and replaced with the following: "6.5.17 6.5.17.1 6.5.17.1.1 6.5.17.1.2 6.5.17.2 LOCATION: NORTH SIDE FAIRVIEW STREET {PART LOTS 11-13, PLAN 517}, R1-17 {KEYMAP2) Notwithstanding any provisions of this By-Law to the contrary, no person shall within any R 1-17 Zone use any lot, or erect, alter, or use any building or structure for any purpose except in accordance with the following provisions: PROVISIONS FOR A HOME OCCUPATION (ESTHETICIAN) FLOOR AREA LIMIT Not more than a cumulative total of 32.9 m2 (354 ft2) of gross floor area of the residential dwelling unit shall be used for the purposes of the home occupation use. EMPLOYEES A maximum of one person may be employed who is not a member of the family residing on the lot. That all of the provisions of the R1 Zone in Section 6.2 of this By-Law, as amended, shall apply; and further, that all other provisions of this By-Law, as amended, that are consistent with the provisions herein shall continue to apply mutatis mutandis." 4. That Section 9.5.3 to By-law Number 3295, as amended, is hereby amended by deleting 'RM-3 (H)' and replacing it with 'RM-3'. 5. That Section 13.2 to By-Law Number 3295, as amended, is hereby amended by adding the following subsection at the end thereof. "13.2.7 LOCATION OF A PLACE OF WORSHIP Notwithstanding the permitted uses in Table 13.1, a place of worship shall not be permitted on lands fronting or flanking onto Broadway within the CC zone." 6. That Section 19.3.1 'Glendale West, West Side of Quarter Town Line Road' to By-Law Number 3295, as amended, is hereby deleted. The Corporation of the Town of Tillsonburg By-law Number 3989 Page4 7. That Section 19.3 to By-Law Number 3295, as amended, is hereby amended by adding the following subsection at the end thereof. "19.3.2 19.3.2.1 19.3.2.2 19.3.2.3 LOCATION: GLENDALE WEST, WEST SiDE OF QUARTER TOWN LINE ROAD, IN1-2 (KEY MAP 11) Notwithstanding any provisions of this By-Law to the contrary, no person shall within any IN 1-2 Zone use any lot, or erect, alter, or use any building or structure for any purpose except in accordance with the following provisions: PROVISIONS FOR A PLACE OF WORSHIP Notwithstanding Table 19.1, there shall be no maximum gross floor area for a place of worship within an IN1-2 Zone. That all of the provisions of the IN1 Zone in Section 19.2 of this By-Law, as amended, shall apply; and further, that all other provisions of this By-law, as amended, that are consistent with the provisions herein shall continue to apply mutatis mutandis." 8. That By-law Number 3295, as amended, is hereby amended by adding Schedule "C-3" Accessible Parking Standards, after Schedule "C-2". 9. That the contents of Schedule A to By-law Number 3295, as amended, are hereby further amended by replacing Key Maps 2, 6, 11, 16, 19, 21, 24 and 30 with the attached Key Maps. This By-Law comes into force in accordance with Sections 34(21) and (30) of the Planning Act, R.S.O. 1990, as amended. READ a first and second time this 81h day of February, 2016.
