4128 To abandon a portion of the Paget Municipal Drain within the limits of the Town of TillsonburgTHE CORPORATION OF THE TOWN OF TILLSONBURG BY-LAW NUMBER 4128 BEING A BY-LAW to abandon a portion of the Paget Municipal Drain within the limits of the Corporation of the Town of Tillsonburg. WHEREAS the Paget Municipal Drain By-law, being By-law 2650 passed on January 9, 1996, pursuant to the Drainage Act, R.S.O. 1990; WHEREAS pursuant to the provisions of Section 84 of the Drainage Act, R.S.O. 1990, c. d. 17 states a Council may by by-law abandon the Drainage Works, and thereafter the Municipality has no further obligation with respect to the Drainage Works. AND WHEREAS The Corporation of the Town of Tillsonburg is of the opinion that abandonment of a portion of the Paget Municipal Drain as identified in Schedule A is desirable, pursuant to Section 84 (5) of the Drainage Act, R.S.O. 1990, as amended; AND WHEREAS The Corporation of the Town of Tillsonburg has complied with the notification requirements of Section 84 (1) of the Drainage Act, R.S.O. 1990, as amended and no objections to the proposed abandonment have been received; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF TILLSONBURG ENACTS AS FOLLOWS: 1. THAT the southern portion of the Paget Municipal Drain be abandoned and reconstructed into an open storm channel from the north limit of the abandoned CASO railway to North Street. All responsibility for the maintenance and repair and the cost of this work will be assumed by the Town of Tillsonburg. 2. THAT the section of 400mm diameter concrete pipe within the road allowance of North Street be abandoned. This section of the drain will be replaced with a 750mm diameter concrete storm sewer which will outlet into the open storm channel. All responsibility for the maintenance and repair and the cost of this work to be assumed by the County of Oxford. 3. THAT the northern section of the pipe'drain, located north of North Street and east of Falcon Road and Tanager Drive, which is comprised of a 350mm and 400mm diameter concrete pipe remain unchanged and in service. 4. THAT the eastern section of the pipe drain comprised of a 350mm diameter concrete pipe remain unchanged and in service. 5. This by-law shall come into full force and effect on the day of passing.
