A BY-LAW to authorize the sale of certain lands
and the entering into of a licence agreement with
Canada Post Corporation.
WHEREAS lands being part of Lots 1131 and 1136, Lots 1137 and
1138 and Part of Lot 1188 were acquired by the Corporation of
the Town of Tillsonburg along with certain other lands under
authority of By -Laws 1863 and 1953 for the purpose of implementing
a Redevelopment Plan as adopted by By -Law 1899, as amended by
By -Laws 2012 and 2028.
AND WHEREAS for the purpose of the said development plan, it
is deemed necessary and expedient to sell certain land and enter
into a licence agreement with Canada Post Corporation to implement
Phase II of the Development Plan.
BE IT THEREFORE enacted by the Council of the Corporation of
the Town of Tillsonburg as follows:
1. That the Corporation of the Town of Tillsonburg does hereby
agree to sell and convey to Canada Post Corporation the
lands being parts of Lots 1131, 1136, 1137, 1138 and 1188,
Plan 500, more particularly described as Part 1 on Plan
of Reference 41R-3952, as deposited in the Registry Office
for Oxford (No. 41) at a sale price of $100,000.00 in
accordance with and subject to the terms of Offer to Sell
attached as Appendix "A" to this By -Law.
2. That the Corporation of the Town of Tillsonburg does hereby
agree to enter into a licence agreement with Canada Post
Corporation with respect to lands being Part of Lots 1137,
1138 and 1188, Plan 500, more particularly described as
Part 2 on Plan of Reference 41R-3952 as deposited in the
Registry Office for Oxford (No.41) in accordance with and
subject to the Terms of Licence attached as Schedule "C"
to Appendix "A" to this by-law.
3. That Appendix "A" attached hereto is declared to be a part
of this by-law as if written and incorporated herein.
4. That the Mayor and Clerk are hereby authorized to execute
on behalf of the Corporation of the Town of Tillsonburg,
a deed to Canada Post Corporation for the lands described
in Clause 1 hereof and to execute such documents on behalf
of the Corporation of the Town of Tillsonburg to give effect
to the licence agreement provided for in Clause 2 hereof.
