BY-LAW NO. 4268
A BY-LAW TO APPOINT A MEETING INVESTIGATOR FOR THE CORPORATION OF
THE TOWN OF TILLSONBURG.
WHEREAS section 239.2 of the Municipal Act, S.O. 2001 c. 25 authorizes the Town to
appoint an investigator to investigate in an independent manner any complaint as to
whether the Town has complied with the Act or a Municipal procedural by-law in
respect of a meeting (or part of a meeting) that was closed to the public;
AND WHEREAS the investigation of the relevant Town or local board must be
undertaken by an Investigator appointed by the Town pursuant to Sections 9, 10, 11
and 239.2 of the Act or by an Ombudsman appointed pursuant to the Ombudsman
Act if the Town has not appointed an Investigator under the Act;
AND WHEREAS the Town deems it desirable to appoint Gregory F. Stewart as the
Investigator to investigate all requests received by the Town after January 1,
2019 pursuant to the Act respecting any meeting of the Council of the Town, a local
board or a committee of Council;
NOW THEREFORE the Council of The Corporation of The Town of Tillsonburg hereby
enacts as follows:
1. That pursuant to Section 239 .2 of the Municipal Act, S.O. 2001, c. 25, Council hereby
appoints Gregory F. Stewart as the Meeting Investigator for the Town of Tillsonburg.
2. That the Mayor and Clerk are authorized and directed to execute on behalf of the
municipality, the agreement with Gregory F. Stewart substantially in the form
attached hereto as Schedule "A".
3. That the term of such appointment shall be five years commencing the 1st day of
January 2019, in accordance with the terms and conditions of the agreement
attached to this by-law as Schedule "A".
4. That this by-law shall be effective upon the passing thereof.
