Members: Dave Mason, Vice-Chair, Ron Bradfield, Jim Hevenor, Sam Lamb, Also Present: Dave Free, David Morris, Fran Bell, Brad Bartlett, Gundy Gtouski, Ron Chatten A. Adoption of Minutes Moved by Sam Lamb Seconded by Jim Hevenor AND RESOLVED THAT the minutes of May 8, 1997 as amended are adopted. Adoption of Agenda Moved by Sam Lamb Seconded by Ron Bradfield AND RESOLVED THAT the agenda for the date of July 17, 1997 be adopted as amended. 11 Carried" C. Business Arising From the Minutes 1. Staff Direction Staff are directed to contact Rick Nevill to see if he is satisfied with the actions to date on the results of the meeti.ng between Mr. Nevill and the Town of Tillsonburg and Village of Vienna with respect to drainage issues on his property. D. Reports and Discussion 1. Update -Master Planning Exercise Brad Bartlett gave an update with respect to the exercise being completed by the IMC consultants he further stated that a report with recommendations will be available in the very near future to committee by the consultants Moved by Sam Lamb Seconded by Jim Hevenor AND RESOLVED THAT the final meeting of the master planning for the Otter Valley Recreational Trail and Utility Corridor and its open house be held in the Village of Port Burwell at the Parish Hall on September 11th, 1997 at 7:00 P.M. "Carried" 2. Discussion -Board of Management Moved by Sam Lamb Seconded by Jim Hevenor AND RESOLVED THAT the Otter Valley Recreational Trail and Utility Corridor Committee recommend back to their respective Councils to appoint the existing members of the committee to a Board of Management for the Otter Valley Recreation Trail and Utility Corridor for the balance of the 1994 -1997 term of Council ''Carried'' 3. Restructuring Ramifications An update was given to committee with respect to restructuring proposals in the Township of Bayham, Village of Vienna, Village of Port Burwell by Vice-chair Dave Mason see point 4. 4. Discussion proposed letter to adjacent Landowners Re: Trail Issues and Policing Staff was directed to proceed with a letter to adjacent landowners along the abandon railway line advising them that trail issues can be directed to either Clerk's of the participating municipalities and for any criminal activity they should be directed to the police. The Deputy-Clerk was directed to contact the local O.P.P. detachment and ask them to forward any complaints with respect to the trail and utility corridor to the committee so that they would be aware of any or all activities 5. Risk Management -Mqtorized Uses & Liability Moved by Jim Hevenor Seconded by Sam Lamb AND RESOLVED THAT the Otter Valley Recreation Trail & Utility Corridor approve the shared use of the trail with recreational motorized uses on a restrictive and probationary period to location and time and further that the IMC consultants recommend the appropriate level of activity, restrictions, signage, gating, fencing, etc. and to be incorporated into the appropriate drawings for the Master Plan Exercise. "Carried" \~ Moved by Jim Hevenor Seconded by Ron Bradfield AND RESOLVED THAT the Otter Valley Recreational Trail and Utility Corridor Committee recommend to the respective Councils to direct staff to prepare for approval by Committee of a Risk Management policy and further that the said policy be brought back to this committee for final approval and further that the operations departments of each participating municipality be authorized to identify and remedy any existing situation of risk and or maintenance prior to the formation of a Board of Management to an upset limit $500 per occurrence. Other Business Mr. Jim Hevenor stated that he has been approached by the Otter Creek Outfitters and that they would like to incorporate a canoe Trail into the Otter Valley Recreational Trail and Utility Corridor. E. Adjournment and Next Meeting Date Moved by Ron Bradfield Seconded by Jim Hevenor AND RESOLVED THAT the committee move into closed session to discuss matters of potential litigation. Easement Agreements with Pembina 1) Easement to Processing Plant 2) Easement for Balance of Lands Both easement agreements were received by the Committee and a memo was received dated July 17, 1997 from the Economic Development Officer. The Executive Committee directed that the easement agreements be reviewed by their solicitors. The Economic Development Officer was further directed to incorporate into the conditions of the easements a restoration plan, review of preliminary plans by the municipality and bring back any changes. 2. Request for Right-of-Way -George Moore, Eden, Ontario The Economic Development Officer was requested to talk to Maureen Beatty, Township of Bayham to see if the Township will be interested in taking the Gray Street to the lot as opposed to allowing a right-of-way to the subject lands. The Economic Development Officer was requested to reporr back to the next executive committee regarding planning policies, and the severance on the lot and if any other access to the lot would be appropriate. Bell August 11, 1997 Request for Right of Way to Property OWned by George Moore Background A request was received by the committee from Angie Harder requesting a right of way across the forme~ CP lw.1ds to a property owned by George Moore. The property is known as Part Lot 23, Concession 8, Eden Fax (519) 842-9431 on the east side of the CP lands, at the end of Grey Street. It is approximately 2 acres in size. At present the lands are landlocked. Mr. Dwayne Daniel, Building Official for the Township of Bayham, has advised that normally frontage on a public road "- is required for a building permit. Bayham Township has not ~ been approached by the owner to date regarding extending Grey Street to the property line. Mr. Daniel also advised that granting a right of way across our lands would not necessarily be adequate for a building permit. Recommendation It is recommended that the a right of way across the frequest from Angie Harder for · ormer CP lands be denied.
