970106 Otter Valley Trail MINOTTER VALLEY UTILITY CORRIDOR & RECREATIONAL TRAIL VILLAGE OF PORT BURWELL -TILLSONBURG MINUTES of the meeting of the Otter Valley Utility Corridor & Recreation Trail held January 6th, 1997 at 7:00 P.M. in the Village of Port Burwell Municipal Offices. PRESENT: Reeve Tom Nesbitt, D. Mason, J. Hevenor, and D. Free, CAO Port Burwell Tillsonburg Councillors: G. Leachman and S. Lamb D. Morris, Clerk-Administrator B. Bartlett, Deputy Clerk Ron Bradfield ORDER OF BUSINESS: 1. Call Meeting to Order Meeting was called to order at 7:05 P.M. 2. Declaration of Conflcit of Interest None 3. Approval of Minutes of December 12, 1996 Moved by Dave Mason Seconded by Jim Hevenor THAT the Minutes of the meeting of December 12th, 1996 of the Otter Valley Utility Corridor and Recreational Trail Committee Meeting be adopted. "Carried" 4. Business Arising from the Minutes Gayle Leachman reported that he has been in contact with the Board of Management of the Lynn Valley trail and their successes dealing with adjacent property owners can be heard at any time by the Committee. 5. Presentations a. IMC Consultants Ltd. i) Otter Valley Trial Proposal ii) Discussion iii) Funding Sources ••• 2 -2 - Received. Moved by J. Hevenor Seconded by D. Mason THAT the Otter Valley Utility Corridor and Recreation Trail Committee recommend to the respective Village and Town Councils the proposal as submitted by IMC Consultants on the Utility Corridor and Recreation Trail and that the staff of both municipalities prepare the required grant applications seeking sponsorships and that a letter requesting an enquiry for an expression of interest be sent to Bayham Township in a joint ownership of the utility corridor and recreation trail. 11 Carried11 b. Progress Report -David Free Land Acquisition Transfer of Title Project Planing & Development Administrative Cost Sharing Rotary Club Walkathon Received. The Committee discussed administrative cost sharing and it was decided that the costs would be identified by each of the municipalities and then brought forward at a later meeting and discussed. The Committee discussed the setting up of a Board and stated that it should be done internally and not at the cost of ICM Consultants. 6. Delegations None 7. Petitions None 8. Consideration of Committee Reports None 11. By-Laws & Motions i. Proposed Inter-Municipal Agreement ii. Proposed Motion -IMC Proposal Committee discussed a "shot-gun" clause for the Utility Corridor and Recreational Trail Agreement, whereby if one municipality were ever to cease, than the other would immediately take position of that property. Mr. David Morris, Clerk-Administrator, stated that he would investigate this matter further with the Town's Solicitor and report back to Committee at a later date. 12. New Business None 13. Old Business None 14. Committee of the Whole Legal Draft Agreement with Pembina Committee received that draft agreement with Pembina and it was held over until the next meeting. 15. BE1WEEN: THE CORPORATION OF THE VIUAGE OF PORT BURWELL (hereinafter calkJ "Port Burwell") OF THE FIRST PART and THE CORPORATION OF THE TOWN OF TILLSONBURG (hereinafter calkJ ''Tillson1urg") OF THE SECOND PART Page 2at10 .. WHEREAS Port Burwell and Tillsonburg wish to jointly operate a bicycle path, cross counhy ski trail and recreational trail runnmg from Port Burwell to Tillson1urg. AND WHEREAS the parties are permitted by virtue of Section 208, Paragraph 57 of the Municipal Act R.S.O. 19<:() C. 302 to establish joint management boanls for operation or management recreation and other areas and to enter into agreements for canying out such purposes. AND WHEREAS the parties wish to enter into this Agreement to establish the joint board of management to be known as the Big Otter Trail Management Board and to set out the manner of operation of the said board. NOW THEREFORE THIS AGREEMENT WITNESS ETH that in consideration of the mutual covenants and promises herein contained the parties hereto agree as follows: ARTICLE 1 -DEFINffiON AND GENERAL 1.01 Definitions For the purpose of this agreement, the following works shall have the following definitions. a) "Act" means the Municipal Act Ontario or any amendments thereto. b) "Board" means the Big Otter Trail Management Board. c) "Council" means the municipal council of each of the parties hereto.
