ADOPTION OF AGENDA Resolution No. 1: Moved by: Councillor Rosehart Seconded by: Councillor Getty AND RESOLVED THAT the Agenda as prepared for the Closed Session and Open Session of the Council Meeting of June 13, 2011 be adopted. MINUTES & BUSINESS ARISING OUT OF THE MINUTES Resolution No. 3 Moved by: Councillor Getty Seconded by: Councillor Rosehart AND RESOLVED THAT the Minutes of the Closed Session and the Open Session of Council for May 24, 2011, be approved. "Carried" PUBLIC MEETINGS 1. Committee of Adjustment Application A-03111, Terry Foutre & Janine Coldham, 37 Tillson Avenue Presented By: Development Planner, County of Oxford Mr. Jason Juhasz, Planner, County of Oxford, appeared before Council and commented with respect to the attached application and County Report. Opportunity was given for comments and questions. Council suggest that staff review the penalty fee during the review of the Rates and Fees by-law. The Applicant Terry Foutre was in attendance and was available to answer questions. He addressed council's questions and requested that the penalty fee be removed as a condition. No other persons appeared in favour of or in opposition to the application. Resolution No. 4: Moved by: Councillor Getty Seconded by: Councillor Rosehart AND RESOLVE THAT this application is acceptable from a planning point of view and should be granted subject to the following conditions: 1. A building permit for the duplex dwelling shall be issued within one year of the date of the Committee's decision. 2. The applicant shall create a parking space (as indicated on Plate 2 of Report No. 2011-131) on the north side of the existing detached garage, as per Section 5.20 - Parking Provisions (most notably Section 5.20.1.8 - Parking Surface) to the satisfaction of the Building Department. 3. Minor Variance approval is granted only to permit development that is substantially and proportionally in accordance with that shown on Plate 2 of Report No. 2011-131. 4. The applicant shall pay to the Town $250.00 for the "Minor Variance Application After 14 ' Construction Begins" fee in accordance with the Town of Tillsonburg Rates and Fees By -Law 3195. AMO Request for Nominations to the 2010-2012 Board of Directors D Presented By: CAO Resolution No. 5: Moved by: Deputy Mayor Renaud Seconded by: Councillor Klein AND RESOLVED THAT Council receive the Requests for Nominations for the Board of Directors for the Association of Municipalities of Ontario, as information, FURTHER RESOLVE THAT Council nominate Mayor John Lessif as a Board of Director for the /0001 2010- 2012 term on the Association of Municipalities of Ontario Board. "Carried" 4. Oxford Regional Labour Council -Delegation Follow -ug Presented By: CAO On May 24, 2011 a Delegation from Oxford Regional Labour Council - FCM Resolution from December 2010 regarding changes to the CPP plan. The Town of Tillsonburg did not receive a request from the FCM to support the resolution. The Resolution was forwarded by the FCM to the appropriate federal agencies for action in December 2010. 5. Report CSD 2011-10 RFP Results Skateshop and Concession Operations D Presented By: Acting Director of Community Services Councillor Beres left the room as he has declared a pecuniary interest in this item. Resolution No. 8: Moved by: Councillor Klein Seconded by: Deputy Mayor Renaud AND RESOLVE THAT Council receive Report CSD 2011-10 Request for Proposal Results Skate Shop and Concession Operations, as information; FURTHER RESOLVE THAT Council award the Skate Shop Operation to Tillsonburg Skate Shop for a period of three years commencing September 1, 2011 AND FURTHER RESOLVE THAT Council awards the Concession Operation to Beres Catering 100*\ for a period of three years commencing October 1, 2011. "Carried" 8. CSD11-10 Ground Penetrating Radar Scanning [) Presented By: Acting Director of Community Services & Parks & Facilities Manager Councillor Beres returned to the meeting. Council suggest to Staff to consider splitting this work up over a few years to reduce costs. Resolution No. 9: Moved by: Councillor Beres Seconded by: Councillor Klein AND RESOLVE THAT Council receives report CSD 2011-10 Ground Penetrating Radar Scanning, as information; FURTHER RESOLVE THAT Council award the Ground Penetrating Work (GPR) work to Global GPR Services as a single sourced supplier as per the Town of Tillsonburg Procurement By -Law at the Tillsonburg Cemetery at a maximum cost of $16,000 plus HST be funded from the 2011 Cemetery Operating Budget. Council has also requested that staff investigate if it would be beneficial for the Craft Guild to be open on Sundays.
