PRESENT: Mayor Cam McKnight, Councillors: I. Horton, D. Beres, B. Carroll, S. Lamb, G. Leachman, C. Rosehart, R. Smith and F. Welsh ORDER OF BUSINESS: A. Adoption of Minutes No. 1 Moved by Councillor Horton Seconded by Councillor Beres AND RESOLVED THAT the Minutes of Council under date of September 8th, 1997 be adopted as printed and circulated. Mrs. Katherine Stephenson - Monthly Volunteer Recognition Award for the Month of September 1997 Mayor Cam McKnight presented the Special Volunteer r"�I Recognition Award to Mrs. Katherine Stephenson for her volunteer contribution in and for the Town of Tillsonburg for the month of September 1997. E. Appointments/Delegations 1. Mare Brown, Treasurer, County of Oxford RE: TAP Grant - Telecommunications Access Partnerships Mare Brown presented to Town Council the requirements for Telecommunications Access Partnership Grant between all the local municipalities and the Town of Tillsonburg with the County of Oxford and also presented the County and local municipality estimated cost impacts for the downloading of services onto local government as it effects the County of Oxford and its local municipalities. No. 3 Moved by Councillor Horton Seconded by Councillor Beres AND RESOLVED THAT Town Council advise the County of Oxford that it supports, in principle, the application to the Province of Ontario for a Telecommunications Access Partnerships Grant. "Carried" F. Public Hearings 1. Application for Zone Change - Sharon Fletcher Mr. Mike Barrett presented Report #97-169 from the County of Oxford Planning and Development Department. There were no persons present in the audience expressing interest in the subject Application for Zone Change. "Carried" No. 4 Moved by Councillor Beres Seconded by Councillor Welsh AND RESOLVED THAT the Council of the Town of Tillsonburg deny the zone change submitted by Sharon A. Fletcher, for lands located in Lot 1674, Plan 500 in the Town of Tillsonburg requesting a zone change from 'Highway Commercial (C2)' to Special 'Highway Commercial (C2 -Special)'. "Carried" 2. Application for Zone Change - Gilvesv Enterprises Inc. Mr. Mike Barrett presented Report #97-170 from the County of Oxford Planning and Development Department. Mr. John Gilvesy, on behalf of Gilvesy EnterprisesInc. was in attendance in support of the recommendation in Report #97-170. No. 5 Moved by Councillor Beres Seconded by Councillor Horton AND RESOLVED THAT the Council of the Town of Tillsonburg advise the County of Oxford that it is in favour of an Official Plan Amendment for an application submitted by Gilvesy Enterprises Inc. whereby lands located in Part Lot 6, Concession 12 (Dereham), in the Town of Tillsonburg are changed from "Medium Density Residential" to "Low Density Residential" on Schedule "ST -211, Residential Density Plan for the Town of Tillsonburg; AND FURTHER RESOLVED THAT the Council of the Town of Tillsonburg approve "in principle" the rezoning application submitted by Gilvesy Enterprises Inc., whereby lands located in Part Lot 6, Concession 12 (Dereham), in the Town of Tillsonburg, are rezoning from "Special Residential Third Density (R3-12)" to "Residential First Density (R1)" to permit the construction of a single-family dwelling; AND FURTHER RESOLVED THAT the Council of the Town of Tillsonburg delete Schedule "B-13" to the Town of Tillsonburg Comprehensive Zoning By -Law Number 1994. "Carried" No. 9 Moved by Councillor Carroll Seconded by Councillor Welsh AND RESOLVED THAT the Traffic Committee Minutes of September 18th, 1997 be received and recommendations contained therein be adopted. "Carried" No. 10 Moved by Councillor Welsh Seconded by Councillor Beres AND RESOLVED THAT the Town of Tillsonburg request the Minister of Finance to negotiate with railway companies operating in the Province of Ontario, the exchange of property tax liability on their rail right-of-way corridors P"'1 on the condition that the railways will pass title of any rail line they abandon or have abandoned, to the province and/or the local municipality at no cost. The right-of-way is to include all existing rail infrastructure. This proposal is to include all existing rail infrastructure. This proposal would be compatible with regulation at the provincial level that would reserve these rights- of-way for return to rail use when required. The rights-of-way could be used for other purposes such as nature trails, in the interim. "Carried" No. 11 Moved by Councillor Lamb Seconded by Councillor Leachman AND RESOLVED THAT Town Council grant the 153 Varnavair Royal Canadian Air Cadet Squadron permission to hold their annual Tag Day on the 17th and 18th of October, 1997. Closed Session No. 12 Moved by Councillor Horton Seconded by Councillor Beres AND RESOLVED THAT Town Council now move into Executive Committee - Closed Session to consider a matter of potential litigation.
