971027 Regular Council Meeting Minutes000M% October 27th, 1997 MINUTES of the meeting of the Municipal Council of the Town of Tillsonburg held Monday, October 27th, 1997 at 7:30 P.M. in the Council Chambers, Municipal Offices, Tillsonburg, Ontario. PRESENT: Mayor Cam McKnight, Councillors: I. Horton, D. Beres, B. Carroll, S. Lamb, G. Leachman, C. Rosehart, R. Smith and F. Welsh ORDER OF BUSINESS: A. Adoption of Minutes No. 1 Moved by Councillor Horton Seconded by Councillor Rosehart AND RESOLVED THAT the Minutes of Council under dates of October 10th and 14th, 1997 be adopted as printed and circulated. A-21/97 - Tracey Covey Mr. Mike Barrett, Planner, County of Oxford, was in attendance and presented memorandums to Committee of Adjustment under date of October 9th, 1997 and October 27th, 1997. Mr. Terry Covey was in attendance in support of the recommendation as contained in the memorandum from the County of Oxford Planner. No persons were in attendance in opposition to the application under File A-21/97. No. 3 Moved by Councillor Horton Seconded by Councillor Rosehart AND RESOLVED THAT application to Committee of Adjustment of Tracey Covey, File #A-21/97, to permit the change of use of the northern single-family detached dwelling house at 52 Earl Street to a modified single-family dwelling use as applied for, be approved, subject to conditions as ,.•� contained in County Planning memo under date of October 27th, 1997. No persons were in attendnace in opposition to the proposed condominium development. No. 4 Moved by Councillor Smith Seconded by Councillor Leachman AND RESOLVED THAT the Council of the Town of Tillsonburg recommend to Oxford County Council that it approve the exemption from condominium process for the application submitted by 1173644 Ontario Inc., for Phase 1 of the rowhouse units located in Part of Second Street (closed) and Third Street (closed), Registered Plan 214, Lots 432 and 433, Pt.Lots 436 and 437, Plan 500, in the Town of Tillsonburg. "Carried" oonm� -+wml► No. 9 Moved by Councillor Welsh Seconded by Councillor Beres AND RESOLVED THAT whereas Section 363 of the Fair Municipal Finance Act requires the establishment of a set of tax ratios for municipal tax purposes to be passed by by-law by March 15th of each year by the upper tier municipality, in which case, a single tax ratio for the upper tier municipality and its lower tier municipalities shall be established; AND WHEREAS Section 364 of the Fair Municipal Finance Act provides that Council of an upper tier may by by-law passed before January 15th of a year delegate to the Council of each of its lower tier municipalities the authority to pass a by-law establishing the tax ratios for the year within the lower tier municipality for both lower tier and upper tier purposes; AND WHEREAS it is the wish of the Council of the Town of Tillsonburg to maintain the historic taxation levels between property classes in 1998 in the Town of Tillsonburg which can be implemented by using tax ratios established at the lower tier; BE IT RESOLVED THAT the Council of the Town of Tillsonburg request County Council to delegate the setting of tax ratios pursuant to Section 364 of The Fair Municipal Finance Act to the Town of Tillsonburg for 1998. "Carried" No. 10 Moved by Councillor Smith Seconded by Councillor Leachman AND RESOLVED THAT the Treasurer's report on 1997 Budget Variances, under date of October 24th, 1997, be received. "Carried" NO. 11 Moved by Councillor Beres Seconded by Councillor Smith AND RESOLVED THAT WHEREAS, the Ministry of Transportation of Ontario and the Town have been negotiating since the middle of 1980's for the Town of Tillsonburg to assume this section under connecting link agreement. WHEREAS, the Ministry of Transportation of Ontario, over the years, have reviewed this section as a total reconstruction, ie: widening, etc. and at 100% Capital Expenditure to the Ministry of Transportation of Ontario. WHEREAS, the Ministry of Transportation of Ontario, due to reduction in Capital funding, have continually bumped this much needed project. WHEREAS, Ministry of Transportation of Ontario have now placed this project within the latter part of their Five Year Capital as preservation, minimal 1 repairs, milling and resurfacing only. WHEREAS, the Town of Tillsonburg has decided that this proposal is not satisfactory to the Town, as it would only be a cosmetic approach, which would not address widening, infrastructures, traffic and pedestrian safety. WHEREAS, the Town of Tillsonburg has agreed to contribute 10% of the cost of total reconstruction of this Provincial Highway. WHEREAS, the Town of Tillsonburg have determined that this priority project needs to be completed in 1998. WHEREAS, the Town of Tillsonburg believes that it would be most desirable and expedient to enter into a Connecting Link Agreement to reconstruct Provincial Highway No. 19. THEREFORE, BE IT RESOLVED: THAT the Town of Tillsonburg agrees to extend our existing Connecting Link Agreement to include Highway No. 19 from Concession Street to our north limit, with the underst4nding that there is no future maintenance payments receivable and this Connecting Link total reconsti°ti tion:- will be 90% Ministry of Transportation of Ontario, -10% Town.
