Monday, January 22nd, 2001 at 7:00 P.M. in the Council Chambers, Tillsonburg, Ontario.

F. Appointments/Delegations
1. The Ontario Flue Cured Tobacco Growers' Marketing Board
A delegation appeared before Council asking for Council's support, and
the following resolution was passed, unanimously.

Seconded by Councillor Beres AND RESOLVED THAT WHEREAS the
Tobacco Industry within Canada impacts upon many sectors of the
Canadian economy, such as Agriculture, Manufacturing, Printing,
Transportation, Wholesale, Retail, Tourism and Hospitality;
AND WHEREAS within Ontario, the tobacco industry, from seed to
processor, provides $453 Million in family income and 9,423 full-time
equivalent jobs;
AND WHEREAS because of the scope and importance of the Tobacco
Industry to the Canadian economy, public policy initiatives, including
regulations and legislation, must recognize that Tobacco and its
consumption as a product, is both a health and an economic issue;
AND WHEREAS Canada's Tobacco Industry also understands the need
for an effective program of information and education that alerts the
public to the risks associated with tobacco consumption. In particular, we
fully support youth information and education programs that are targeted
at young persons and are rooted within our public education systems as a
part of the day-to-day school curriculum. Since 1994, tobacco companies
have paid a corporate surtax of $400 Million to provide youth education
programs. Additionally, $5 Billion is paid annually as Provincial and
Federal Taxes and we believe a percentage of these revenues should be re-
directed to this purpose;
AND WHEREAS as long as society and governments continue to
recognize tobacco as a legal product, adults exercising their choice to use
these products are entitled to consideration as consumers in the
formulation of public policy;
AND WHEREAS efforts to de -normalize the Tobacco Industry must be
recognized for what they are — efforts to destroy the Canadian Industry
and those who depend upon it for their livelihood. Those who fail to
distinguish the difference between anti -tobacco and anti -Canadian
Tobacco Industry are directly undermining the economic security of
individuals, their families and their communities;
AND WHEREAS the development of these far-reaching policies,
governments, at all levels, have an obligation to engage in thoughtful,
thorough and productive consultation with all stakeholders within the
industry so as to ensure that the rights of both smokers and non-smokers
are recognized and accommodated;
AND WHEREAS disproportionately higher taxation upon tobacco
products is simply an unfair tax levied against family incomes and should
be brought in line with other consumer products;
THEREFORE, the Council of the Town of Tillsonburg fully supports this
industry and its employees, farmers, manufacturing and retail workers, and
calls upon the Provincial and Federal Governments to begin a consultation
process involving all stakeholders, with the objective of addressing all
economic and health issues associated with the Canadian Tobacco
Industry. Overly excessive and misguided legislation and regulation raises
the spectre of a return of large scale smuggling, and the loss of
manufacturing and agriculture jobs, to other countries.

2. Ms. Nancy Walther, President and Mr. Joe Wilson, Second Vice -
President, Oxford County Federation of Agriculture RE: Oxford, Elgin
and Middlesex Counties Agricultural Economic Impact Study

Copies of the Study are available from Ms. Walther, at the cost of $10.00
per copy.
G. Committee of Adiustment
1. A-01101— Doris and Larry Curry
i) Report from the County Planning Department
Mr. Jim Hill, Oxford County Planning Department, appeared before
Council and reviewed the County Report.
No persons appeared in support of, or opposition to, the subject
application.
A representative of the applicants was present and advised that the
Hickory Hills Residents Association had provided written notification that
it had no objections to the application.
The following resolution was passed by Town Council.

Tillsonburg Committee of Adjustment approve application A-
01/01 for 57 Wilkins Crescent, subject to the following conditions:
1) A building permit be issued within one year of the date of

H. Public Hearings
1. E & E McLaughlin Ltd. — Application for Zone Change
Mr. Jim Hill, Oxford County Planning Department, appeared before
Council and reviewed County Report No. 2001-5.
Mr. Ken Rosehart, appeared before Council, representing the applicant.
Mr. Rosehart circulated information and the proposed operation.
No persons appeared in support of, or opposition to, the subject
application.

Seconded by Councillor AND RESOLVED THAT the Council of
the Town of Tillsonburg approve the rezoning of the subject lands
owned by E & E McLaughlin Ltd., located on the east side of
Broadway, from "Special Highway Commercial (C2-18)" to an
amended "Special Highway Commercial (C2-18)" Zone to permit
the addition of an amusement arcade as a permitted use.

I. Reports
1. County of Oxford Planning Department RE: Draft Approval of Plan of
Subdivision — AnnandaIe Heights Ltd.
Mr. Jim Hill, Oxford County Planning Department, appeared before
Council, and reviewed County Planning Report No. 2001-9.
An area resident was present and expressed concerns about the area from
the railway tracks to Concession Street, as very young children are
�"'� traveling this area, and are forced to walk on the road.
Mayor Horton responded that this is not part of the subdivision plan, but
recognizes that there is a problem. Assurance was given that snow
clearing in this area would receive attention.
Mr. Cyril Demeyere appeared before Council. He noted that he had
reviewed the report, with recommendations attached, and he is in
agreement.

Seconded by Councillor Smith AND RESOLVED THAT the
Council of the Town of Tillsonburg recommend to the Oxford
County Public Health and Planning Committee approval of draft
plan of subdivision, File No. 32T-00005, submitted by Annandale
Heights Ltd., prepared by Kim Husted Surveying Ltd., shown as
Plate 3, Revised Draft Plan, dated December 20th, 2000,
comprising Part of Lot 270, Plan 500, in the Town of Tillsonburg,
subject to the conditions, as detailed in County Report No. 2001-9,
being met prior to final approval of the plan for registration.

2. Director of Operations RE: Pearl, Pine, Joseph and Prospect On -Street

Mr. Vanderhaeghe, resident of Joseph Street, appeared before Council
with the recommendation of a 3 -way stop or all -way stop at Concession
and Maple Lane. He also suggested green florescent signs be posted.
Others expressed concerns with the safety of children, the width of the
street in the winter months, speeding, by-law enforcement, property value
and convenience of parking for visitors.

Seconded by Councillor Lewis AND RESOLVED THAT the Staff Report
from the Director of Operations dated January 4, 2001 be received;
AND FURTHER THAT Joseph Street (north side), and Tillson Avenue to
the dead end (east of Maple Lane) be signed in accordance with the
existing Traffic By -Law;
AND FURTHER THAT Traffic By -Law 2103, Schedule I, Prohibited
Parking, be amended to include Pearl Street (north side) and Pine Street
(south side) from Tillson Avenue to Maple Lane anytime, and Prospect
Street (north side), Broadway to Bidwell (Dec. l to Mar. l ).

3. Director of Community Services RE: SuperBuild Infrastructure — Arenas

Seconded by Councillor Lewis AND RESOLVED THAT WHEREAS the
Council of the Corporation of the Town of Tillsonburg has received and
considered the Government of Ontario SuperBuild Corporation Sports,
Culture and Tourism Partnerships ("SCTP") initiative Round 1
Application Guidebook (The "Guidebook");
AND WHEREAS Council has assessed its capital priorities against the
SCTP initiative Round 1 application requirements as set out in the
Guidebook and intends to submit a letter of intent for qualifying the
"Community Centre/Arena" project (the "Project") for funding under
Round 1 of the SCTP initiative;
AND WHEREAS Council confirms that the Municipality is compliant or
in the process of gaining compliance with the new Ministry of
Environment Drinking Water Protection Regulation, Ontario Regulation
459/00 made August 9, 2000 ("DWPR");
AND WHEREAS Council considers the Project to be its highest sport,
recreational, cultural or tourism infrastructure priority for the
Municipality;
AND WHEREAS Council confirms that the Municipality will be
addressing any outstanding public health and safety issues and projects
affecting its existing sport, recreational, cultural and tourism facilities, as
part of this proposal;
AND WHERAS Council has made this resolution on the understanding
that the recitals set out herein will be relied upon by the Ontario
SuperBuild Corporation in considering the Project application for funding
under Round 1 of the SCTP initiative;
NOW THEREFORE the Council of the Corporation of the Town of
Tillsonburg hereby resolves that the Clerk is directed to submit a letter of
intent to the Ontario SuperBuild Corporation respecting the qualification
of the Project for funding under Round 1 of the SCTP initiative.
