Comprehensive Zoning By -Law Presented By: Mr. Paul Michiels and Mr. Harry Shnider, County of Oxford Planning it- I Summary Report, as provided at the September 10, 2007 Council Meeting... 2007-267 Till 05-0.pdf Page 1 MINUTES: Meeting for the Committee "Open Council' • Mr. Michiels and Mr. Shnider appeared before Council. Opportunity was provided for questions and comments from Council. • In response to a question regarding the appeal process, Mr. Shnider explained that the board that would hear an appeal on any zoning matter is the Ontario Municipal Board (OMB), and there is a process that the Board goes through for an appeal. Also, there are opportunities for the OMB to investigate matters before going to a full hearing. If the OMB feels the reason for an appeal is reasonable, it would schedule a hearing as such. • Appeals to the OMB, have to be made within 20 days following third and final reading of the by-law. • The zoning on some specific properties was discussed. • With respect to possible contamination of sites, it was noted that we rely on the Ministry of the Environment (MOE) to provide information. • In response to Mayor Molnar, Mr. Shnider made comment that he is satisfied with the definitions and terminology being used in the by-law. • Mr. Michiels noted that legislation constantly changes. Therefore, Official Plan amendments may be yearly, just to keep in step with Provincial legislation. We will likely see a housekeeping amending by-law on a yearly basis. • Mayor Molnar noted that he had additional questions, and would email Mr. Shnider with those. • Mr. Shnider added, if there is something Council wishes to re -visit, there will be opportunities for that. • A report to be prepared for October 9th. 7:00 P.M. "Carried" PRESENTATIONS PUBLIC MEETINGS 2. Committee of Adjustment - Vanacker - (A-14/07) E Presented By: Mr. Harry Shnider, Planner, County of Oxford Mr. Harry Shnider, Planner, County of Oxford, reviewed the application and the County of Oxford Planning report, as attached. The owner of the subject property, Ms. Nicole Vanacker, appeared before Council. She noted that they had purchased the house six years ago, with the assumption that the existing sunroom had gone through the proper legal process. She noted that there are two reasons she is before Council at this time. The first reason is to ask for the building permit, and the second is to request a reduction in the fee that she paid, as she is now paying for a Minor Variance for a larger piece than what they are adding on. She added that it was suppose to have been paid for. In response to a question from Mayor Molnar, Mr. Shnider noted that an additional fee had been applied, for an after -the -fact application. No other persons appeared in support of, or opposition to, the subject application. The following resolutions were passed. Resolution > No. 4 Moved by Councillor Stephenson Seconded by Councillor Rosehart AND RESOLVED THAT Tillsonburg Committee of Adjustment approve Application A-14107 for 3 Lowrie St., subject to the following condition: 1) A building permit for the proposed dwelling shall be issued within one year of the date of the Committee's decision. Application for Zone Change - Sul2plementary Report (Non -Profit Housing) Presented By: Harry Shnider, Planner, County of Oxford 7-332t. pdf Mr. Harry Shnider, Planner, County of Oxford, reviewed the application and the County of Oxford Planning report, as attached. A representative from GSP Group Inc., agent for the applicant, appeared before Council in support of the subject application. A representative from Non -Profit Housing was also in attendance. No other persons appeared in support of, or opposition to, the subject application. The following resolution was passed. Resolution > No. 6 Moved by Councillor Stephenson Seconded by Councillor Rosehart AND RESOLVED THAT the Council of the Town of Tillsonburg approve the application by Tillsonburg Non -Profit Housing Inc. to rezone the subject lands from `Special Residential Fourth Density (R4-1)'to an amended `Special Residential Fourth Density (R4-1)" to allow for the proposal of thirteen additional ^1N apartment units to the existing building; AND FURTHER THAT the Tillsonburg Non -Profit Housing Inc. enter into an agreement with the Town of Tillsonburg pursuant to Section 37(3) of the Planning Act allowing an increased net residential density of 157 dwelling units per hectare on the subject site, in exchange for the provision of affordable housing. Proposed Resolution RE: NDSB Program Enhancements No. 10 Page 6 MINUTES: Meeting for the Committee "Open Council" Moved by Councillor Lamb #0011) Seconded by Councillor Beres AND RESOLVED THAT WHEREAS the Corporation of the Town of Tillsonburg remains committed to all educational and training opportunities available to the students and residents of our community, and; WHEREAS through a resolution of December 12, 2005, Council indicated to the TVDSB an interest in being "kept informed of any and all directives relative to the future of any public school properties within the Town", and; WHEREAS Council supports the efforts of the local Community Councils at both Annandale and Glendale schools, and; WHEREAS the NDSB is supportive of the "program enhancement" opportunity that would result from a transfer of Grade 9 students from Annandale to Glendale, therefore; BE IT RESOLVED THAT, the Council for the Town of Tillsonburg request a substantial response from the TVDSB regarding the status and timelines of any "program enhancement" and resulting renovations to satisfy the transfer of students within the Town of Tillsonburg.
